| 00:03:55.93 | Ted Hanick | Okay. Good afternoon. My name is Ted Hanick. I'm a 67 year old, 25 year visitor and live aboard resident in Sausalito. I came there somewhat by accident, by client demand, and I fell in love with your city and the people there. And I think it's one of the most beautiful communities. Thank you. I'm probably one of the few experts on the public trust doctrine I started writing on in 1983 at the beginning of my legal career. I've lectured even in England on the subject. And I can assure you, I believe there are very serious violations of the public trust doctrine in what is going on there. But I've also represented members of the indigent community all the way up to the California Supreme Court and got a unanimous decision. And that's a very long process, even if you're absolutely correct. And the stress that it causes on people and the trouble in the community on the way up is a problem at the expense. There's a very simple solution here for Sausalito, and that's to modify the conditional use permit number 467. And that goes through a public hearing process. It's very rapid. It is due process. And I have a list of recommendations for modification to the conditional use permit. Your lease, I've reviewed. I have reviewed over 1,000 commercial leases during my career. I have some experience there. And that lease has a provision that allows for modification of the conditional use permit and the tenant is obligated to follow it. I would only recommend things that I believe are completely legally enforceable and supported by public policy. The current operator who I have questions about the assignment, but regardless of that, he denies that AB 1482 applies. I believe it does, but regardless, you can put that into the conditional use permit and they will be bound by it. And there's a strong public policy supporting CUP 467, but even more so in the public trust. And there are a number of other issues in the public trust that I'm quite willing to assist the city attorney on because I do have |
