APPROVAL OF PLANNING COMMISSION MINUTES 📄

Those items will be continued to a special meeting. Commissioner Luxenberg added that a Notice of Intent for the Liberty Wharf project (70-74 Liberty Wharf) was noticed online for February 17 but will be heard on March 17, and he wanted that on the record for anyone who saw the notice. NEW BUSINESS 📄

Commissioner Saad asked if documents for previous agenda items that had been moved could be resent or posted, as they were no longer accessible from the agenda link 📄. Mary Wagner confirmed the agenda would be posted the next day or Friday and offered to provide copies. The chair then asked for any other commissioner communications; there were none.

The notes for January 20th, page 305, line number 42, about It says that as everyone will remember, we made some specific changes to recommended changes to the general plan.

So I would like to amend the minutes for the 20th to add the amendments either in the text or an attachment to these minutes and then have approve the maybe approve the six tonight, but have the 20 to send back to us. And that would be true of page three line 42.

And it would also be true of notes here. Um, page four.

line 36. So on the amendments to the zoning amendment recommendations. We made some specific changes which we've never actually seen. So I would like to get those on the record. So if we can hold that January 20th till we can see it with those amendments, that would be my suggestion. I don't know how other commissioners feel.

00:07:30.73 Morgan Pierce I would echo Commissioner Graff or Vice Chair Graff's statement is that staff and I believe the public is typically relied on the content in the record video and audio for the content. And we've called out items like this in the past and staff has reminded us of that.

Protocol so unless there's something different for this issue, then I'd be happy to address it, but if it's just standard order of procedure, then I'm not sure we need to address anything specific.

I would at a minimum like the notes to reflect language that would reference where the public could go look for the information that's referenced there in terms of the amendments.

because we all have a fresh memory, but, you know, five years from now, we might not so i i see the city attorney um and hopefully give us some guidance here.
00:08:40.39 Mary Wagner Just a suggestion, that information is reflected in the City Council staff report that went to the Council when they were considering certification of the final EAR and adoption general plan so if that's at all helpful it does exist and live in all the public records on the decision on the general plans.
00:09:03.83 Morgan Pierce I guess I would add that obviously we're very interested in information, making sure that public as well as members of the various commissions have as easy access to it as they possibly can. And perhaps this is more of a protocol discussion to be had with staff, on an agendized item or some future data on a non-agendized item, just to address how this material is conveyed. Because I think they've established protocols for how it best works for staff to elucidate the relative information that's been conveyed at a public hearing. Obviously, there are time requirements and other obligations that feed into that. I just want to make sure that we are sensitive to their...

restrictions, their workload, et cetera, but at the same time, make sure that we're balancing that with the needs of the community. So perhaps that's another conversation for us to have.

I mean, I think in the case of the general plan item and in the case of the ordinance item, I understand the staff constraints on time and that kind of thing. But this ordinance is going to come back to us.

I don't want to have to one go through a video of a couple of hours to find the language. And what the staff said at that time, they clean up the language. So we don't actually see it. So I think when we make a specific change to language related to an ordinance or policy, that it would be useful that those get in the minutes or the minutes for the city council get attached to this somehow then, if that's easier for the staff, because I think that, you know, that, this would just be too hard to find. And we'd say when, for example, Okay.

City Council adopted a general plan, so that's a little different now.

for the Zoning ordinance, we added a special section that we wanted And it had to be in a certain place. And so those changes need to be shown somewhere in our records, not just go to look in the video or go to look in the city council. I mean, I think we want it here so that we can go back on our own and check it if that makes sense to somebody.

I'm hearing what you're saying that, you know, when you're making recommendations on a policy document to the council, you would like that reflected if you make changes to the staff, or the documents in your staff report, you'd like that reflected in the minutes that are brought back to you?

So if there's consensus from the commission on that, we can certainly go back on the minutes that you have in front of you tonight.

and see if that meant that the Commission is raising. But I also understand, you know, we don't do verbatim minutes anymore.

Much to the chagrin of your city attorney, I was probably the only person or one of the few people who really misses those.

and I fully support the suggestion about attaching this, I would just emphasize that the general plan is done very infrequently and being aware of the staff's workload would not want to add more to their time, but I've got to tell you, trying to bounce between these sources, you know, a video, this or that, sometimes dissuades people, and I believe it's not very transparent. This is a very important document,

on the public hearing part of the agenda. I just note that there was a NOA, NOI, I can't remember, for the Liberty War Project, and it was noticed that it would be at this meeting, and I emailed the staff planner for that, and she indicated it would be March 17th instead of February 17th. And so I thought we should just mention that so that people would be aware of that also.

The council adopted the new general plan last week on a unanimous 5-0 vote.

And it was thanks to all of the hard work of so many community members, including all of you five commissioners rolling up your sleeves to really accomplish that enormous task.

Director Whalen also wanted to let the Commission know that the Department is moving straight away into the housing element update, and the council appointed the commission's Chair Fowler, and Commissioner Luxenberg to advise on a short-term ad hoc proposal review committee.

That group will make recommendations on consultants for the housing element update preparation.

The council's working group for the housing element update, Vice Mayor Kalman and Commissioner Cleveland Knowles are also Karen Hollweg, Preparing recommendations on the formation of a housing element advisory committee, which would be a more long term brown committee.

to streamline the hearing process.

For example, one change being implemented for the next meeting are some clear applicant presentation protocols for the Zoom meetings, which we hope will lead to more streamlined meetings with fewer interruptions.

Another thought the director had was to substantially revise the staff report noticing process.

to allow for more notice and dialogue with the applicant in the neighborhood up front in an attempt to reduce the number of hearings for applicants and neighbors and bring projects forward when they are ready for action one way or the other.

To accomplish this, the director is considering the impact of shifting the staff analysis report production from within 10 days in advance of a hearing and publication six days in advance of a hearing to beginning four weeks prior to the public hearing when story polls go up.

And this would provide additional needed time for staff and neighbors to view the story of polls and the proposals impact on light, air and views.

As well as time for staff and the applicant to review draft conditions of approval.

And a legal period of notice is provided well in advance of a hearing.

issues can be corrected without impacts to the Commission schedule.

And if the commission is inclined, the director would bring back policy changes you would like to see and identify if any ordinance amendments are required to just the story pool ordinance or submittal requirements in the zoning ordinance

I believe that staff's intent is to make those applications as seamless and streamlined as possible, but I understand they've run up for some challenges and anything we can do to help them as we move forward will certainly be welcome, I think.

I don't know if if something I don't know what the obligation is legally if they need to be accepted or if there can be some form of communication back from staff that says please come to the meeting and use the public comment time for that because then it can be on record and everybody can hear it, but I don't know where I don't know what those requirements are.

legally if they just if they have to be inbound and then passed over maybe my fellow commissioner who's raising his hand knows the answer to that. But that has been a little difficult so that might be an area of focus.

And then in terms of.

Um, site visits in general I know it's not a requirement as well but I think it can be something that should be continued to be encouraged at the very least because I think a site visit really really makes or breaks an issue in your head in terms of visualizing and understanding plans are very helpful but also to encourage you know, community members within within bounds and respect of a property. But if if they want to also have some type of input from far and visually see it because I think sometimes the comments are coming from a place of passion and maybe a little bit less of a understanding of maybe there's a certain property that has to be a certain way.

And I don't know if that is something we also, again, what the boundaries are, Not that you want to send the whole public to somebody's property, but just to get a feel let them understand so we can have some really robust conversations when we do get to our meeting.

So they don't get too far down the road and with their time and expense and and can use it constructively to help their the design, the execution, and the input without going to great expense. So I think we have to be mindful of, you know, engaging with applicants and the public properly at the right time. And sometimes we have very straightforward applicants and sometimes we have very complex ones that are not always very clear.

So those are my ads to the conversation.

It might be something if we are allowed to look on our own and maybe bring to a meeting and see just to assist city staffs and I'm sure they're quite busy, but looking to see what they have and they might have a checklist that we can revamp for the city of Sausalito perhaps because I think that's a really good idea. I think there is I've been in so few meetings, but you can hear some of the frustration sometimes coming from the applicants.

And it would, I agree, the word setting them up for success would be the best way to go. And I think would ultimately shorten meetings and move projects forward.

And this is actually an item that I had asked our community development director to.

Um, There are other commissions, as everyone knows here in Sausalito, and theoretically we should be meeting at least once a year with historic preservation perhaps sustainability, we've had joint sessions with city council last year.

specific to the general plan, but on a generally regular basis, we should be communicating and coordinating with our other commissions.

And I think that now that we have a general plan adopted, we have already in February but a new year, I think it's a great time to revisit how we actually work and collaborate with our other commissions and how we can help them.

You know, it's only coming from my viewpoint of the Historic Preservation Commission.

So that's my extent of involvement. So coming from that lens alone, when I first started, we had many joint meetings and I know the roles have changed and the scope has changed. So we don't even do the 50 year reviews anymore. That's now the onus is on the applicant.

But we had talked about this a long time ago in terms of just having that rapport once once we lost the some of our remit, which really streamlined our meetings. It was a benefit, but once we did with some of that shifted, we sort of lost our our open door to the planning commission. And I think now being on the other side of it, it would be a huge benefit if we just even even twice a year get down to sit and go through a lot of the ideas that they have alone. And I'm sure we would come to the table with some as well.

and discuss some of the things that can also benefit residents, like the Mills Act. I feel like it's something that most people don't understand. Why would you if you're not involved in it? But there are a lot of benefits there.

We had also had some discussions around Sausalito walking tours and you know, there's just a lot of ideas that came out that couldn't come to fruition.

as Commissioner Pierce said, with all the staff turnaround, we didn't wanna burden them, but I think maybe we don't need them. Maybe we can have those discussions on our own and then go back and do our own presentations and see what we're allowed to do.

what we're allowed to accomplish together as a group. So I would definitely do a huge vote for for preservation commission two times a year discussion.

It would be great if all of these commissions, and I'm sure some of them do more than others presently, but take a more proactive than a reactive approach. And, you know, a lot of, granted, there is a lot of stuff that the Planning Commission has to review, and so trying to be proactive may not be as easy at times as we might like it to be. But we should at least go forth with the notion that we can change, we can affect change for the better and constantly think about ways and whether that's communications with our fellow boards and commissions or just our own participation in our community and find to do things better and bring those to this body for presentation during communication or as Commissioner Saad mentioned, maybe it is finding ways to have collaborative engagement with the other boards and commissions in some sort of noticed event where we can have conversations that really serve our community in sort of a broader sense.

We did that the last, so it happened in 2002 when I first started as city attorney and I kind of came in on the tail end of that major revamp and we've done some other pretty substantial reviews during the years, but this will be, as you indicated, a major revision. I haven't had a chance to coordinate with your community development director at length. You know, we've obviously talked about it, but at length and what that process is going to look like.

I think that will make a lot more sense and be more, you know, respectful of everybody's time. And as you indicated, you know, there's huge pieces for other boards and commissions to think about and weigh in on too. So going to definitely be a holistic holistic look.

You know, there was past practice of trying to do at least one annual joint meeting of the two bodies, If there's a need to get the Historic Preservation Commission and the Planning Commission together, we can certainly do that. Or any other of our boards and commissions put you together, hopefully someday in person again.

you know, also via Zoom, we can do that too. We just have to notice them accordingly.
