APPROVAL OF PLANNING COMMISSION MINUTES 📄

Kristina Feller clarified that the requested EDAC presentation should cover a retail and business strategy for all of Sausalito, not just downtown, acknowledging different area needs. She stated they had asked for this at the beginning of the year and on July 28th to report with a presentation on the ideal proper retail and business mix, emphasizing it was a strategy rather than just a retention plan. Director Whalen confirmed he would communicate this to the EDAC subcommittee. 📄

The item was a request to continue the hearing to a date certain. Director Whalen stated staff supports the continuance and did not provide a staff report, only a memo requesting continuance to September 22 📄. 00:06:01.76 Jeffery Luxenberg July 21st, I have two comments. This is a question of how you do minutes. If somebody says, refers to a number in the minutes, but when the signed resolution happens, it's different. I think we should make the minutes match the signed resolution. Does that make sense, Willie? For example, there are two items in this case. On page 3, 3 line 30 it says that the new condition it says number 17 but in the assigned resolution it's number 21 so I think the minutes should just say 21 even though I'm sure somebody said 17 in the meeting but that's not what got Well, I should.

So in line 30, it should be number 21, not 17.

And similarly, in line 38, the new condition came in at 15C instead of 18. At the meeting, we said 18, but it ended up being 15C.

00:07:27.91 Kristina Feller Director Whalen, I think that sounds correct, because I believe that you're taking what was verbally said in the hearing, and if there were additional conditions as part of the resolution, that's why the numbering is off. Is that correct?

One other comment about the footnotes They come up in the draft as blue, like they're links, but the first footnote says that you go to a certain page for the resolutions, which is a fine way to do it. So I think when you finalize these, somehow get the link coding off of the footnotes that aren't links, if you see what I'm saying. In other words, they look like links, but they're not anymore. So just change them to black or white, and then that problem goes away.

This the building the existing building is listed as a contributor to the downtown Salt Slavo Historic District More information on the building's history can be found in the historic resource evaluation for the property.

which is attachment six within the staff Well, As mentioned previously, the application includes a design review permit to modify the existing exterior of the existing building storefronts.

A minor use permit for outdoor dining located within an expanded public sidewalk along El Portal.

and an encroachment agreement for outdoor sidewalk seating guardrail.

And thank you for the revised draft resolution that you sent out today, which incorporated some of the changes. I won't go through those questions, but I do have two follow-on questions.

One is related to signage for the building. I do understand that you indicated signage is coming later I think that we should add a condition if other commissioners agree to this application approval that indicates that the signage when it comes in needs to be consistent I'm seeing two issues one is the cafe sign and the gallery sign are different sizes and different types. So it would be nice to have them the same. I also see that the Tenant to the left, which is also part of the building, which is the Chamber of Commerce Visitor Center, has recently added a bunch of signs. And I think it would be good if the signage for that long term, maybe the applicant can talk to this, would be also in the sign band like the others, where it would say, you know, Chamber of Commerce Visitor Center, rather than the four signs that they have attached to awnings. And I don't know if those are temporary or not. So that was my first question. The second is you indicated on the site plan that there's this one loading space, which I don't have an issue with, which would be on El Porto at Bridgeway. But currently the water flows from Bridgeway down into a catch basin at the end of El Porto. And there's gonna be this sidewalk in the middle. I know any water hidden in that extension will get to that catch base and I'm worried in front of where that one loading space is whether water will pool if they don't slope the curbs properly or whatever. So I don't know if that's a question for you or public works or for the applicant, but I just want to make sure that they design that so that no water has been pooling in that loading space.

So I don't know if those are for you or for the applicant, but if you comment, that would be great.

However, what the condition is saying is that those items still need to go back for review by the HPC. If the HPC says, looks good just the way the planning commission approved them then they don't need to come back to the planning commission If there are changes to requested changes by the HPC, or if it's denied, this certificate appropriateness, then the project would come back to you as a modification of the designer view permit.

So but I do throw that out idea out there because if this was to be addressed, this would be the time. So I don't have a strong opinion one way or the other on it.

and We have, it's quite an honor to be able to participate in the enhancement of this fine building downtown. I think it's one of the most prominent buildings in our historic district.

It's amazing to the extent that the second floor has been changed so little And yet as so common, the ground floor has been altered drastically. And this is an opportunity to improve it. And that's what we're proposing. We have a great team. We started with historical architect Mark Holbert, who did all the historic analysis and determined what has historic value and guided the design that you see tonight. Dan McGee on my team has, my staff has prepared all the drawings.

And, And I want to thank us city staff, Louie's been great, Jeffrey, Graham, thanks for your very clear staff report. You came in kind of late on this, so it came up to speed very quickly. And Kevin McGowan from the Department of Public Works has been helping guide the solution because it involves a portion of the street.

um, The tenants, as you heard, Petri Gallery is only open for appointment. Cafe Tutti's been vacant for quite a while. The other tenant is the Chamber of Commerce that moved in recently at the Far East End.

And the goal is to have some new tenants that can bring style and quality to this heart of our town. The gallery will no longer be Petri Gallery, but Ian Ellie, he's a photographer, and this will be his private personal gallery to show his own work.

He does very large and colorful photography and he's requested a large amount of windows so people can see and appreciate his artwork.

The Cafe Tutti will be under a new owner, or tenant, I should say. Jody Harris, he's here tonight. He can maybe answer some questions. I think he would like to speak.

We're very excited about having his involvement. His architect, Steven Sutro is a very high-end quality architect. I think the interiors will be as exciting as the exterior.

Um, Our goals have been to preserve the historic value of the building, honor its heritage, to strengthen it structurally. We found that it has deficiencies to resist earthquake and enliven the street as best we can.

and create more vitality and have tenants that provide quality products that would benefit not just residents, but the visitors too. So I'm gonna share a screen here and walk you very quickly through a short slideshow.

00:56:53.83 Michael Rex Um, Well, just a week ago, we found this photo. We think shortly after the building was completed, the building was built in 1916. You can tell by the automobiles that this had to be soon thereafter. You can see pilasters down at the east end. We don't see pilasters at the west end And there's two of these plasters that remain, at least the capitals remain, and I'll show you that in a minute. Almost no change whatsoever to the second floor. There used to be transom windows above and a little purple wall at the bottom.

But the building had a lot of glass.

Okay, here's the original drawing of the building. And you can see the plasters at the east end, no plasters at the west. The corner was open here. You can see it in this photo. This is from a movie in 1938.

And it was a Rexall drag on the corner, all glass and a small little skirt at the bottom, all storefront windows. And it had a corner column that was freestanding. And then at the far end, you can see the pilasters.

Okay, next slide.

This next slide shows the corner open.

and we'd like to restore this open corner.

That should help congestion at that corner because the building comes to a very sharp point and everybody has to squeeze around it.

So by opening, moving the entry to the corner and restoring this open portion should help enhance the circulation, but also it restores a portion of the original building. Next slide, please.

Here you can see what the corner looks like today. Gene Heller enclosed it with small windows. Apparently he wanted his men's clothing store to be more private. The gallery wants just the opposite. They want to show off the work instead of hide it. It has little light fixtures on the exterior. We think they're kind of small and mousy. We want to keep this emergency exit you see here but we want to restore the transom windows that were removed in addition to restore the open corner.

Okay, next slide.

And Cafe Tutti, actually, I was the architect for Cafe Tutti probably 20 years ago. It's fun to be involved again. We basically want to keep the openings where they are, keep the entry where it is, but bring the windows all the way down to the sidewalk.

and make them operable doors. So the interior and exterior can flow together.

However, there's not enough shear walls on this building, and so we want to put a concrete shear wall at each end of Cafe Tutti.

and one at the very far south end of the gallery. Next slide. Oh, and here you can see on each side of the hotel entry are the pilasters. The first one on the left is the original location. The one on the right was moved.

to widen the entry to the hotel.

and it has, these Corinthian columns at the top.

Those are the only, we think those are original.

01:00:28.70 Michael Rex Okay, and then you can see the rest of the facade. We'd like to repeat the plasters on each side of the windows at the Chamber of Commerce stores, so we can keep that rhythm going.

This is the existing drawing just showing the ground floor, and you can see when you put it to graphics, it's kind of all over the map. Proportions are pretty horrible. It's not as attractive as it could be. This is an opportunity to enhance it.

01:01:07.26 Michael Rex So this is what we're proposing.

And we started with the historic guidelines and followed them as best we could, which call for store windows right up to the sidewalk, transom windows above display windows, a small little wall at the base, and We're restoring the corner entry with the freestanding column. We're keeping the tablature. You see the concrete share wall on the right side of the gallery with a decorative light fixture on that blank wall. And then you can see the new concrete share walls on each side of Café Tutti.

But the pilasters will now wrap all the way around the building.

and we're gonna keep the two original blasters at the hotel.

but we didn't wanna replicate them. Mark felt that we shouldn't be building something new that pretends to look old. So what we did was we followed the details of the building.

We didn't have to look far for a model. The second floor is a very simple detailing with light cream banding. And so the capitals or the pilasters will have a very similar band at the base. And then the capital will be a simple band at the top. There'll be stucco pilasters and they'll look like, I think for the first time this building will look like it all hangs together as one architectural style.

Um, And you can see the cafe pretty well there. Those awnings will be retractable. They'll have a little heater in them.

very tiny little strip that's electric there'll be some lighting in them as well and we'll be submitting that to each PC.

And coming around the corner, you can see the gallery and the proportions. We, the sash will be aluminum. It'll be the same color as what's above. And the whole idea is that the proportion of those windows kind of emulate the proportion of the windows on the second floor. So it all looks like one building.

Here is the site plan to show how the circulation works. The planner boxes in the middle will come out. There's, this was reviewed by the Department of Public Works. They found it acceptable. There's two travel lanes each like there is now. When the bikes are closing off Tracy Way, Al Patel turns into a cul-de-sac for two lanes.

And there'll be a stripe down the middle. There'll be arrows to indicate that. There's a 12 foot traveling for each car at its narrowest point, which is the industry standard.

The sidewalk is a foot wider than required. And that came from our last hearing with the planning commission for Langston building. We had four feet between the guardrail at that cafe, outdoor cafe and trees.

and we were requested to make it five. And that, the curb is another six inches, in addition to the five.

and the length of 45 feet plus the curves at the end for a total of 51 feet and the length of Al Patel is 150 feet so this is about a third you can see the parking there's plenty of room for loading and we talked to the to the neighbors I'll tell you about that in a minute and they were fine with this There was some discussion about taking the sidewalk cafe all the way, or not the cafe, but widening the sidewalk all the way down to Bridgeway. And that has not been proposed. That's an additive cost.

The gallery owner was afraid that the chairs might start and tables might start migrating in front of his his art gallery and express concern about it so we have not proposed that. As far as drainage there's a condition of approval in the resolutions from the Department of Public Works. We have to submit a drainage plan that's on page five of the conditions of approval. So part of our building permit application will be showing how the drainage will be managed for stormwater anti-pollution.

Um, And here you can see the layout for the sidewalk cafe.

The planners will kind of help make it feel a little cozy.

Uh, The exiting will all be brought up to legal standards, for egress, so we're also improving safety. Also the sidewalk right now has a greater than 2% slope. So it's not, it's actually a liability for the city. When we rebuild this portion of the sidewalk, that slope will be brought into conformity with ADA. So that saves the city that expense and avoids liability to the city.

We probably won't have so many circles at the top. We might omit the ones at the bottom, but other than that, we like this concept.

It's not too fussy, but it's still decorative. And the last slide are the light fixtures. There's only three decorative ones that the Historic Reservation Commission was most concerned about. They wanted to see what kind of decorative fixture. Can you go to that slide, Jeffrey?

but I think that's a good question.

Yeah, I looked at probably 35 different fixtures and this is the one we ended up with. It has a scale and it'll look appropriate on the building. It'll have this brown color tone, but not clear glass. The glass will be more amber color so you won't see the light bulbs. Okay, so that concludes my slides and hopefully I answer some of those questions that you asked.

let me see if I missed any. Oh, on signage. We could do a master plan for signage for the whole building. And what we like about that is then the tenants don't have to submit each one separately. In fact, their approval wouldn't have to go to the planning commission. Their approval could be administrative as long as staff concluded that their proposal was in line with the master plan that you would approve. So that's common solution that we could do. I'm going to go. that their proposal was in line with the master plan that you would approve. So that's common solution that we could do, okay.

I think with that, we got good support. We haven't got a single complaint yet. Historic Preservation Commission approved it the first night unanimously without a single change. That's pretty rare.

uh, that the code requires And we reviewed this with the fire department and public works and they concluded that it conformed to the code So we're confident that what you see here is what will work. And the planter box is set off to the side, so there should be plenty of room to flow outward. In fact, because the public will move out and around the sidewalk cafe, that'll leave this corner area more clear pedestrians also if you go to the right jeffrey if you shift to the right the cafe also requires two means of egress and it has it now it has the double doors at the entry although we're going to be widening those doors to conform to ADA. We're pulling them back so they don't swing over the sidewalk, which is prohibited by the code.

We're going to keep the door on the right, which is opening into that little vestibule at the hotel. That's existing, and there's no change to that door. Again, Public Works and the Fire Department reviewed this. We didn't submit to you those sheets that show how all the exiting and path of travel worked, but they were submitted to city staff and as part of deeming our application complete, they found them satisfactory. However, they will go through one more check when we apply for a building.

permit. The last thing I want to point out is you asked about congestion on the sidewalk and while the sidewalk is about eight feet now wide Cafe 2D had tables and chairs out in front

I have a couple questions and I'm asking these questions on behalf of a general historical preservation committee process question. I've not had the occasion to speak with the whole team about this.

Question one would be, I've heard some changes here. What date is this plan that you're looking at compared to the date that we reviewed I'm hearing that and I acknowledge that we did not see several things While we may have appeared to have no objection, we had nothing to look at. So I'm looking forward to seeing specific railings, light fixtures, signage, and the lights and planner issue.

And I would urge you to not approve this without us seeing this because it may bounce back and forth. This is clearly just process. This didn't come to us completely. We knew about the signage program. And I think you've talked about a great solution that if you find something, the applicant can find compatible The others could come in and match that administratively, but the HPC would certainly like to see that. That's written clearly in our ordinance for the historic district.

I'd also ask that any changes to this not be made over the counter. This is a very prominent building downtown. We know in several instances we've had buildings replaced. There's been structural problems and the staff was not contacted. Any changes should be stopped and come back to our staff.

And we go from there.

Um, And so I guess I'm asking mainly, please don't bifurcate this or if you have to bifurcate it, I don't think it should, I'm not, I think that's where things get lost in the translation. Michael Rex and his team have done such a good job. These are very minor things.

actually aspects, but we sure would like to see them. And I don't think it's appropriate that the commission approved something without having had a complete certificate of application, we knew that this would not be included when we looked at it before.

I do think I disagree in this case specifically only because I think that what we have in front of us is I think I can personally make the findings.

for for the remainder of this project. I think it's a great project. I'm also a huge fan of the concept of a signage program. I don't disagree that it is it's a very prominent building. It is historic and we want to make sure it's compliant But if there can be a signage program.

THAT I DON'T KNOW HOW THAT WOULD WORK WITH in tandem with the HPC. I mean, something that they can sign off on as well. I think it could be beneficial to the to the applicant and to move this along. So we don't all have to come back just to approve signage. So if there's an opportunity to have the applicant create something that HPC looks at as well, I think it would be beneficial. So I personally can make the findings. I think it's a wonderful project. I think it's beautifully designed. I also love that opening. It is very congested there.

I think we all are with how crowded it can get. So I think that opening is a big win.

And and I think I can make the findings and let the part that needs to go back to HPC go back to HPC.

We don't need to keep ping-ponging back and forth between the two commissions.

until we've got exact agreement, I think some of these details can be left there.

What the city attorney just said that I'm a little confused about. I really, I thought we had the authority to impose a signage program.

I don't see anything wrong with that.

It's a you know, logical, way to expedite things and you know, efficiently deal with the signage question here. I'm not sure why we can't I mean, by creating a signage program, you're saying this is the uniform manner in which signage is gonna be put on this building. We approve that. And then the tenants, if they wanna change that, then they'd have to come back to us. But if the tenants are okay with what we've already approved in terms you know, lettering size and fonts and whatever colors and locations.

I mean, I've seen signage programs work pretty consistently around the Bay Area and I'm not sure why we couldn't do them.

I mean, clearly they can't put up any unpermitted signs, they'd be subject to code enforcement.

Um, But if you're concerned is that business identification be in place prior to occupancy. Is that accurate? Is that what you're concerned about?
01:57:42.17 Jeffery Luxenberg I'm concerned that there's a program for the whole building and I think there might be signs that are up there that have not yet been permitted, that I have gone up. So that is an issue. I'm concerned that I don't see an issue with a timeline. There are conditions that say, this approval is only good for two years.

or whatever i i don't know that i would tie it to the building permit if that's an issue i just want want them to proceed to develop a sign program as part of the finalization of their drawings i don't know that we have to tie it to the building permit i i just want to tie it to something you know so just so it happens and i i think mr rex has indicated he'll do this so I don't think that's mean, uh, uh, so I just want to have some idea of when it, you know, it'll occur.

City council heard that appeal on the 31st of August and unanimously denied the appeal and approved the planning commission's approval of the condominium conversion permit.

Moving on to the housing element update, we have, we're working towards setting up our first HIAC meeting in October.

I will be coordinating with the HEAC on that first date.

and we'll be announcing the first meeting soon. In the meantime, staff are working internally on a data request from our consultant while they continue with our data gathering mode here.

Moving on to the objective design and development standards, the city council adopted a resolution which listed all the objective standards in the city's municipal code that relate to multifamily housing projects. That was phase one. Phase two that the subcommittee is hard at work at is to objectify our more subjective standards. And our next subcommittee meeting will be at the end of September. And then we anticipate bringing the item to the historic preservation commission, the planning commission, and then the city council for review.

are recruiting right now for three positions and the recruitments have closed and we are conducting interviews and making offers out to some excellent candidates that I had the pleasure of meeting.

And so that's the permit services coordinator, assistant planner and principal planner. And so we'll hopefully be bringing them on in the next month or so.

Another update on kind of recruitment and assistance in the department, we are starting an intern program with Sonoma State.

And so we'll soon be having some student assistance in the planning world.

with some planning related tasks that we need some help on.

We also initiated an internship with a high school student, a local high school student who is assisting the department with sustainability items. And she's very interested in that work and she's already gotten started and has done some excellent work already.

Moving on to the historic context statement, Mr. Verplank gave a presentation to the council on the 31st regarding the historic context statement COUNCIL WAS VERY PLEASED WITH THE REPORT.

However, they did ask for some additional enhancements to the report to include a diversity equity and inclusion lens to the report.

in Sausalito's history.

building off of some of the policies and programs that we have in our newly adopted general plan. So we're taking another look at the report and we'll be making some modifications pursuant to the council's direction.

North street stairs, an update on that. The soil has been, soil removal has been completed.

The next step is to install more the railing and more railing is needed in that area than was there originally in order to bring it up to code. And so that's driving the cost up And it's been difficult to, to, um, be able to find the manufacturer to make the railings. We did receive a quote this week, but revisions are needed and we're working on getting them going. We don't have a completion date yet, but we'll keep the commission updated.

Two more items here, the Landside Task Force recommendations, the Department or the Director of Public Works will be presenting to the council a request at their next meeting on the 14th related to the development of a geologic hazard study for the city. And so be prepared to see that on the council's agenda for next week.

And finally, we have had some some code enforcement issues with some trees being cut in the city. And so I just wanted to let the commission know that our code enforcement officer um, is reaching out to the trees companies that have allegedly performed that work to try to get some information to see if there needs to be citations that are issued.

And then Just to go back to the EDAC presentation that we're looking for Again, I just want to make sure we're on the same page with what we've been asking EDAC to do since in the year, we just want to get feedback from them. And that way it's really helpful to us as we're looking at conditional use permits what's happening in each of our different districts, whether it be the Old Town, whether it be downtown, whether it be Caledonia or elsewhere, So we have a better understanding about what their larger vision and strategy is for business and retail and attracting and retuning those.

folks and then One of our task forces, or liaisons I should say, is also on the enforcement, which we've also asked EDAC to come and present as well on the 22nd, if it's deferred till then.

We'd love to hear about that plan at the same time, because I think they go hand in hand.

So I thought that it would be really worthwhile to have a joint hearing so that they could do that presentation once to both parties. It affects, you know, we deal with that quite a lot on the commission. They certainly deal with that quite a lot on the council.

and then really try to help carve out a task force focused on disaster preparedness, not a committee or a task force, but a separate task force, but something very specific to making sure that this is communicated to everybody and all of our residents here in Sausalito and that we are aware of how to help applicants clear areas near power lines and more vulnerable areas as well. So I've asked for that and hope to hear back from them.
