The item before you first up on your business tonight is consideration of a resolution in conformance with AB 361. So as you know, we've been operating under teleconferencing rules that are somewhat different than the standard teleconferencing rules under the Brown Act for quite some time now, since March of 2020 under an executive order issued by the governor. That order expired on September 30th of this year. but recently Assembly Bill 361 was signed into law by the governor and went into effect as an urgency measure. That bill allows the legislative bodies under the Brown Act to continue to meet using the same teleconferencing rules as were in place under the executive order. so long as we're under a gubernatorial declared state of emergency and that findings are made to indicate that meeting remotely is still necessary to protect the health, safety and welfare of the attendees. That would include all the members of the public, yourselves as members of the Planning Commission and staff. The city council is going to take up a resolution on their first meeting in October, which is next Tuesday. that would apply to all boards and commissions, but given that the commission, the planning commission is meeting tonight, in advance of that. And given that the executive order has expired, we are asking the commission to adopt the resolution you have in front of you tonight indicating that we still are under a state of emergency declared by the governor related to COVID-19. and that's necessary to continue to meet remotely for the health, safety and welfare of everyone in attendance. I will note there are other provisions in AB 361 regarding things such as taking public comment, and the manner in which items are submitted we already conformed to all of those regulations in the city of Sausalito so you won't see any difference in the manner in which your meetings are taking place. So with that, I'm happy to answer any questions. |

A majority of the commission would have to be within the jurisdiction of Sausalito, you have to post an agenda at every location that someone is participating from teleconferences cut by teleconference. and their address or location would have to be listed on the agenda. and members of the public would have to be allowed to attend and give public comment from that location. |

Tonight's project is for a design review permit. with heightened design review, non-conformity permit, and the Encroachment Agreement for the project or property, also known as 234 Woodward Avenue. The site is located at 234 Woodward Avenue, fronting Woodward Avenue. It's located in the Um, R-2-2.525. family residential zoning district. And the neighboring properties have a mixture of primarily single family buildings with some multifamily residential buildings. located along Woodward Avenue. As mentioned previously, The applicant tonight is requesting a design review permit. and height and design review for an interior remodel, a 647 square foot addition. Additional crawl space? And added stairwell on the south grade of the building. and approval of a nonconformity permit and approval of a variance. and a recommendation to the city council for approval of an encroachment agreement. which I will describe in further detail in the following slides. Just to give a I WANT TO TALK ABOUT THAT. Uh, The applicant submitted an application on May 13th of 2018 to the Community Development Department. I'm on August 19th. this year. The Historic Preservation Commission conducted a public hearing for the Historic Resource Determination. and determined that the property does not qualify as a historic resource. |

And the project proposes to maintain the nonconformity during the addition and remodel through a non-conformity permit. As described further in the staff report, the project, the addition, and changes to the facade have been designed to match the existing structure. |

The first question is, instead of the applicant being required as a condition of approval to modify the design to eliminate the one square foot above a maximum for area ratio Could the one square foot above the maximum allowable be permitted as part of the design review permit pursuant to the 200 square foot maximum area. So, we're going to have to look at the exemption Staff's response is yes, that is correct. Um, the subject parcel Um, Can The code allows for the subject parcel to exceed the maximum square footage with a design review. I'm going to speak to the architectural merits of the project and then either Chris or Rachel Baker is going to speak to the programmatic requirements or the reasons why we're doing the project. I THINK IT'S A LOT OF you This is a very small lot. in. Pocolito. As you can tell by the amount of coverage that we have from what is a very small house, I WANT TO TALK ABOUT THE The design parameters that I was given early on here was that we wanted to do a sort of sustainable living facilities for mom all on the same level. And um, not have her go up and down through the house. The house is otherwise a very vertical house. We were also limited on the amount of coverage that was existing because the, the, um, carport and the house itself constitute 80% of the lot. So, when you push those two design parameters together, you get a house that by necessity sort of has to occur at the front side of the house. within the footprint of the existing coverage. And that's why we opted to use the I'm not sure. the existing carport. In doing so, we eliminated two of the four parking spaces. I'm not sure. not atypical in Sausalito for people to park on the extension of their that is not with on their property. We thought it was a good compromise between function of the intended program and the parameters of getting to off street in quotation marks parking spots um, for the property. I'm not sure. Other than that, the house itself is a very low profile house. I mean, if you've been out there and stood on Woodward and looked out towards Richardson's Bay, you can only really see. It really obstructs four feet of the view from street level are We only intend to increase that at the center of the property to get like a penthouse for the stairs to come up to carport level. And that is only really necessitated because we need to put a wheelchair lift in there from the carport level to the top living level. in architectural terms is referred to as a mezzanine because it occupies less than 30% of the floor area that it's serving below. That is significant when you get to the building permit stage. but it is the only increase in height that is being proposed for the building. The rest of the addition comes in at the existing roof level. this. Thank you. THE PROPERTY IS UNDERSTANDING although it doesn't show on the site plan, this property is Also, fortunate in that there is no house across the street. So the view corridors across this property are non-existent really. The nearest house is to the north, probably 40 or 50 feet. And I don't. I think there's a house to the south across the street, although I could be wrong on that. If there is, it's quite a ways down. that was the initial thing that we did was walk the site and look for the view corridor. I do know a number of the We have a lot of the residents of the properties of the south. did a mailing. in 2018, soon after submitting this for permit. to engage the neighbors. We had one neighbor from the South come over. He was very nice. I don't know if he still lives there. I do know another resident in that building and she has not mentioned anything about it to me, although she has been notified subsequently. I'm not sure. As far as the rest of the neighbors that were notified, I think 300 feet up and down Woodward and then I actually climbed up the hill to the next adjacent parallel street And dropped a couple of notifications in the mailboxes there but again they are probably 40 50 60 feet above this property anyway i can't see but it had much impact on them I'm not sure if you're THE floor area does max out the allowable for the property. I think we've had I think, Kevin, you're probably the sixth or seventh person to actually run the calculations for floor area on this one. They come out different every time. I'm... I'm pleased beyond belief that we're one square foot over. We did flirt with the 200 square foot addition very early on on this one. Um, We could never really come to clarity on what the 200 square feet thing was for or how it applied to this building, so we never really pursued it. We didn't want to find out later. that it, for some reason we did it wrong and wasn't applicable. Coming in one square foot over is great. Um, Windows. Yeah, so we do have color coordinated plans here. the Starting at the lowest level, you can see the additions are highlighted in color. So if we flip to the next one, Uh... Yep, there we go. The orange is the bulk of the habitable area that's being added and that is living facilities for mom to come in, bathroom, bedroom, and a small laundry area. |

If we go up to the top living floor, we can see grandma's facility. There we go. bedroom, bathroom, a wheelchair lift down next to the stairs up to the carport, and all of that is enclosed in the, we'll call it a penthouse structure, lots of windows facing south. There are no windows facing south on this level. So if we want lights in the south, this is where we're going to get it from. And luckily, it'll go right into the kitchen and sort of central area for the house there. And then next product, I think, The roof? No, this is the mezzanine. So we're looking at... just a minimally configured entry into the house primarily just to accommodate that wheelchair lift and get the garbage cans into their own enclosure area. Okay, next slide. And that's just graphically depicting using colors, the change to the roof, the orange is in line with the existing roof, THE the orange L for the garbage cans is actually lower. I think that's a total low. five feet from the carport height, and then a regular nine and a half footer or so increase in height for the the penthouse. I was suggesting that you use this exemption, which would make it easier for you. But that would obviously be your choice if you were in the process of addressing the problem elsewhere. At this point, I mean, it was three years ago or whatever that we had dropped consideration for it, so I don't remember... where we were considering it or how it was going to be helpful to us. However, for this property, again, because of the lack of windows on the south side of the living level, the primary living level at the top of the house, um, for us to get natural light, south facing natural light into the property. This was really the only nearly constructed wall that we were able to do that in So it's a double-height space. It makes it great. dramatic wall of windows for letting light into the center of the floor plate. I'm not sure. with. sort of a no brainer from, from my standpoint. And again, you know, it, it, It precluded us from doing skylights in that area too, because it's the lowest property on the Hill may have had impact on properties up the Hill. I don't know. |

And then we also have our Housing Element Advisory Committee who we will be staffing. This slide here is also new. It wasn't in the quarterly report, but I thought it's a good snapshot that shows the, volume of permits that the department takes in and issues on a fiscal your basis over the last few years. And you can see here the permits that the planning commission issues annually as well. and you can see that we were Um, ahead of our permits last year and in the fiscal year last year for the planning commission. Um, and right on track. With everything else, there are some caveats here on the screen for when we implemented TrackIt. And then we made some administrative decisions to not require a certain zoning permits as well. So that kind of shifted some of the total permits that were issued on an annual basis. |

We accepted 11 applications for discretionary permits and 59 applications for ministerial permits with a subset of the ministerial permits being seven ADU permits. And this volume of permit applications was relatively consistent with the same period of time in 2019 and 2020. which is good news. And we also collected over $33,000 in planning permitting fees during this quarter compared to the same quarter in 2020 and over $15,000 in fees over the same period of time in 2019. We did have a slight increase to our fee schedule for CPI in 2020. So some of the fees may be attributed to that, but it was a very small increase. |

From during this quarter that we're looking at, the zoning administrator took one, took action on one minor use permit for maritime day at Galilee Harbor. And during the same period of time in 2020, we didn't have any actions taken by the CA. And in 2019, there were four actions taken by the CA. from April through June of this year, the planning commission held six virtual meetings and you took action on nine projects. We see that there's an uptick in activity during this quarter compared to the previous two years with the planning commission. And during this time, subcommittees of the planning commission also worked on a variety of other projects, including objective design and development standards, benchmarking for parklets, and also provided assistance in developing the request for proposals for consultant assistance with the housing element update. and also weighed in on candidates for that committee. |

Thank you. and we received over $138,000 in fees. which exceeded the fees that we collected during the same period of time in 2020 and 2019, which is a good trend for the city. The building inspector also continued to conduct inspections for building permits and was able to conduct 5% of all THE FAMILY IS Sorry, 843 inspections virtually. and we'll continue to pilot virtual inspections through this fiscal year. |

So the PD could put their parking officers on code enforcement and, you know, hopefully save the officers jobs. To be honest, that was the idea was that we could, they could take over some of the work that was needed and they did a great job. We had, I think, close to a hundred cases open and they managed to whittle that down, um, by more than half within a very short period of time. So, um, now that, um, We're on the road to COVID recovery here. They have, you know, respectfully handed that back off to community development and our three day a week code enforcement officer. And if that system was serving us the level that we need to be served in the city of Sausalito. And I've been looking into additional permit tracking systems, We have made the decision at this point to stick with TrackIt and put a little bit more money into it because we're not using, it's a pretty robust system and we are not using it to the best of, its ability, and so we are going to get some training for our staff. We're going to use some additional modules and additional functions that eTracket has that is going to make this, not only the staff's life easier in processing permits and getting things more automated, but also the public will have an easier time with that as well. So that we are hoping to invest a little bit in some existing technologies to make those systems better right now. We are also not, it's not a technology, but we are, looking at space planning in city hall as well, and CDD and using the space that we have. to the best way that we can. and including looking at potentially moving some walls around and opening up the space a little bit too. So that's also on the list of things to look at. |

Staff has a database right now of all of those materials, and we're using that right now as requests come in and doing a little bit of quality control as well. Once we're satisfied with the database, then we are going to make a portal on our website, and the public can access all of those archive files. And so they'll need to, you can do, it it's a very easy very easy pretty basic system and you just add the street number or you can add just the streets you could just put bridge in there or bridgeway in there and it would pop up with all archive files for any address on bridgeway or you could say 660 Bridgeway and then pop up with all the archive files for 660 Bridgeway and go through them. And you would be looking at them just exactly the way that they were digitized from the files in CDD. Does that answer your question? |

The last quarterly report that we had talked about, you had presented, One of the initiatives that we had stressed were digitizing checklists for applications Thank you. And I'd like to make sure that that doesn't fall between the cracks or by the wayside and that I think that's a good question. and so on. And again, anything that this commission can do to help assist that, we will do. We definitely want this to be very, very clear in ECT, not just for the staff, but for the public as well. |
