| 00:02:00.20 | Kristina Feller | Thank you. |
| 00:02:00.22 | Susanna | It's a recording. |
| 00:02:01.89 | Kristina Feller | Terrific. Thank you so much, Maria. And good evening everybody and welcome to the regular planning commission meeting hearing. for Wednesday, January 12th. I'd like to wish everybody happy new year and it's good to see everybody back as we start our 2022 calendar this evening. So we'll have Interim Director Heidi Scovel please call the roll. |
| 00:02:25.78 | Director Scobel | Thank you, Chair Feller, members of the Planning Commission. Before I call the roll, I'll just provide a brief introduction regarding how this meeting is being run. This meeting is being held pursuant to government code section 54953, subsection E. And in light of the declared state of emergency, this planning commission meeting on January 12, 2022, is being conducted telephonically through Zoom and being broadcast live on the city's website. With that, I will go right into our roll call, Commissioner Saund. here. Commissioner Luxembourg. |
| 00:02:59.09 | Jeffery Luxenberg | here. |
| 00:03:00.05 | Director Scobel | Commissioner Junius? President. Vice Chair Graff. Thank you. And Chair Fowler. Here. All of us are present and we have a quorum. |
| 00:03:09.49 | Kristina Feller | Terrific. |
| 00:03:09.89 | Director Scobel | Thank you. |
| 00:03:09.94 | Kristina Feller | Thank you. |
| 00:03:09.96 | Director Scobel | you |
| 00:03:10.48 | Kristina Feller | The next item on our agenda is the approval of the agenda. And before I ask for a motion, I just wanted to orientate those attending by Zoom tonight or those watching at home that we have we're trying out a new structure to our agenda with the Planning Commission we thought it was valuable for the public to hear from the commissioners in terms of some of our communications, our one-way communications and reporting out on any activities that we're involved with, either in subcommittees or working groups, what have you, as well as questions of staff or directives to staff to look into items so you have some insight as to what we are looking at, what we're focused on for this year. I just wanted to provide that brief overview and introduction to that. And with that, I will ask. A motion to approve the agenda. |
| 00:04:13.68 | Richard Graef | Nice one move. |
| 00:04:16.21 | Kristina Feller | Thank you. Thank you, Commissioner Junius. Director Scoble, could you please call the roll? |
| 00:04:22.57 | Jeffery Luxenberg | Commissioner Saad. |
| 00:04:25.17 | Director Scobel | Thank you. |
| 00:04:25.20 | Jeffery Luxenberg | Yes. |
| 00:04:25.48 | Director Scobel | Commissioner Luxembourg? |
| 00:04:27.48 | Andrew Junius | Yeah. |
| 00:04:28.36 | Director Scobel | Commissioner Junia. |
| 00:04:29.68 | Andrew Junius | Yes. |
| 00:04:30.37 | Director Scobel | Vice Chair Grass. Yeah. Carefeller. |
| 00:04:33.24 | Kristina Feller | Yes. |
| 00:04:33.78 | Director Scobel | Motion carries unanimously. |
| 00:04:36.24 | Kristina Feller | Great, thank you very much. So item number three on our agenda this evening, which is the change that everyone might recognize from before are the actual communications and are report outs or one way communications from the commission and from city staff. |
| 00:04:44.63 | Alex Frankel | I'm not sure. |
| 00:04:52.69 | Kristina Feller | So with that, I'm going to ask staff if they have any announcements or updates that they would like to provide. |
| 00:05:01.45 | Director Scobel | The staff does not have any announcements at this time to share with the Planning Commission. |
| 00:05:05.57 | Kristina Feller | Okay, thank you very much. So Commissioner Saad, do you have any communications or updates reporting |
| 00:05:14.97 | Nastassya Saad | I THINK JUST TO CALL OUT THAT WE ARE GOING TO HAVE A SPECIAL SESSION FOR THE committee. for the housing element advisory committee. There will be an extra meeting this month for anyone who wants to attend and I was just looking at the date and I believe it's Monday January 24th, if I'm not mistaken. SO I JUST WANT TO INVITE THE PUBLIC TO JOIN The housing element plan we did go over the previous some of the survey we talked with the consultant in the past meeting, but we're just getting started so I think this next meeting will be a little bit more robust and allow for a lot more input to keep us moving forward. So just January 24th is a call and I think that would be all unless you have anything to add chair Feller. |
| 00:06:00.14 | Kristina Feller | Now, I appreciate you bringing that up, and I want to thank you for sitting on the HIAC. And I, the only thing I would add is that that meeting is going to start at 5 PM. |
| 00:06:12.16 | Nastassya Saad | Thank you. |
| 00:06:12.46 | Kristina Feller | Yes. 6 p.m. which is our usual time just because of everyone's schedule on the committee. So it will be a special meeting at 5 p.m. on Monday, January 24th. we really encourage the members of the public and residents of Sausalito to please attend that. So thank you, Commissioner Saad. |
| 00:06:24.26 | Unknown | And we really, |
| 00:06:24.97 | Alex Frankel | Thank you. |
| 00:06:33.91 | Kristina Feller | Commissioner Luxenberg, do you have anything to report? |
| 00:06:37.50 | Jeffery Luxenberg | The Park Road Working Group continues to meet and is now drafting criteria which they will flush out and bring forward probably sometime in February for a possible way of public hearing sometime. |
| 00:06:52.88 | Kristina Feller | Excellent. Thank you very much. Commissioner Junius. |
| 00:06:57.70 | Andrew Junius | Thank you, Chair Feller. The objective design standards subcommittee is gonna continue its work this month and hopefully we will and I think that's a great question. communities in Marin County are using Opticose. I think they've done a great job with their their big toolkit and handbook that they prepared to assist communities with this effort. and just observing that every community in Marin County is going through this process right now, the news today in the journal, about Belvedere passing their ordinances and moving ahead with their SB9. stuff as well as their objective standard ordinance is something we'll all be looking closely at. Everybody's got the same basic issue before them, and we're going to see how these different communities approach them. It's going to be an interesting year. |
| 00:07:49.54 | Kristina Feller | Excellent. Thank you very much for that update. Vice Chair Graf, do you have anything to report? |
| 00:07:55.08 | Richard Dotter | Um, nothing for report. Thank you. |
| 00:07:57.75 | Kristina Feller | Right. |
| 00:07:58.10 | Richard Dotter | Thank you. |
| 00:07:58.13 | Kristina Feller | Thank you. |
| 00:07:58.25 | Unknown | Thank you. |
| 00:07:58.27 | Kristina Feller | Thank you. Oh, thank you. I just wanted to kind of keep a couple items on the front burner for staff to follow up and report out on a regular basis to the commission. One is we had asked for a report from the city attorney |
| 00:08:17.83 | Alex Frankel | THE EARLY EARLY EARLY EAR |
| 00:08:18.74 | Kristina Feller | on exactly what the structure of what I'm referring to as a tree fund. And that's just a working title that might end up being something else. the situations where applicants are granted a tree removal permit And in lieu of replacing that tree on their property, we have asked that those applicants provide the cash and move the value of the tree into a tree fund. And we just need to prioritize that as something important because There are quite a number of applicants that we have structured this deal as I'll call it and yet we still haven't received any of those funds because there's no place to with the money. And so there's an enforcement issue here on an approved permit so I'd like to ask that perhaps at our next meeting we have a report out on what that looks like. and what that tree fund is. And if we're calling it something else, that's fine too. But let's not forget about it. |
| 00:09:31.89 | Mary Wagner | Sure, Chair Feller, I'm happy to work with staff on that. I think it's, you know, a little bit of a legal question, a little bit of a finance question, and a little bit of a planning staff question. So we'll put our heads together. And there may be, you know, follow-up steps that need to happen that we'll need to coordinate through the City Council and their agenda setting process, but we can at least give you an update of what we know and come put our heads together on a path forward to get that in place for so it's easy for everybody to understand. |
| 00:10:03.01 | Kristina Feller | That would be great and I really appreciate that, Mary. I just, I don't want this to fall by the wayside. |
| 00:10:10.20 | Mary Wagner | It's understood and appreciated and understood. |
| 00:10:10.23 | Kristina Feller | No. Cool. Thank you for that. The only other thing that I'm looking at my notes is I'm looking away from the camera There are just a couple other items that the commission keeps asking for updates on, including the enforcement issue on Platte Street with the 40 some odd trees that were cut down. the issue that we dealt with that we've heard from the public on and asked requested staff to report back to this Commission on the Valhalla access to the beach or to the water Um... And then, you know, we've had some, you know, interesting, thankfully, fairly solid rainstorms in Sausalito, you know, more recently. And so just in hiking around our wonderful city, I've noticed that there's quite a lot of sloughing off. um and you know early warning signs of potential landslide mudslide activity so per the landslide task force and those approved recommendations i think it's just important that this commission do our part to Um, you know, push this issue and just raise awareness and work with staff and DPW or anybody else that need be to make sure that our community is safe and secure that way. So there are some areas over on Edwards and Marian that are pretty extreme. there was a mudslide on Harrison right around, and I'm gonna say approximately 90 Harrison, where there were cones out and mud in the street. Um... So let's make sure that we hear back from staff on the status and stability of those hills. |
| 00:12:10.11 | Director Scobel | Dr. Feller, if I may, would you like a representative of the Department of Public Works to provide that update and presentation as a business item, or would you like it just from staff as a staff update? |
| 00:12:22.36 | Kristina Feller | Well, I think we'd like to hear from DPW and it would be great now that we're starting kicking off 2022 and in our commission calendar, it would be great to also hear from DPW what their priority areas are because of course, you know, again, this commission wants to help support and work smart with all the other departments, applicants, whatever it might be, and the more awareness we have, THE BETTER SO WE CAN DO OUR PART TO SUPPORT DPW AND OUR COMMUNITY So, um... I think that would be worthwhile and maybe we do that collectively with the Southern Marin Fire |
| 00:13:03.52 | Unknown | Thank you. |
| 00:13:03.64 | Kristina Feller | DISTRICT PRESENTATION THAT WE'VE BEEN ASKING FOR. THAT MIGHT BE A REALLY GOOD TOPIC THAT DPW IS PART OF AS WELL SO WE CAN HAVE A MORE SUBSTANTIVE DISCUSSION. And actually, the you know, all be working together and we're all on the same page on that. |
| 00:13:21.83 | Director Scobel | Great, well we can work with you during agenda setting to schedule those dates and times. |
| 00:13:27.50 | Kristina Feller | Great. That would be great. I really appreciate it. And I want to make sure that this year, you know, we're certainly doing our part and being as transparent and fair and open as we possibly can. So I appreciate that. you |
| 00:13:44.38 | Jeffery Luxenberg | Thank you. |
| 00:13:45.39 | Kristina Feller | So there no other items from |
| 00:13:46.52 | Jeffery Luxenberg | So they're, Chair Feller, before you read this item, |
| 00:13:49.15 | Kristina Feller | Let's go. |
| 00:13:50.65 | Jeffery Luxenberg | If we could get an update from staff, either directly as a one way communication or for the next meeting, about the North Streets there, the last three herds, they were supposed to have the railings up in September. So it's now January, so if we could get an update on when they open those and The stairs, they cleared the stairs, but they're now getting a little bit of runoff or a little bit of sliding some more. So, if we could get an update on both that and as well as the health care. |
| 00:14:23.54 | Kristina Feller | Great, thank you for raising North Street stairs as well. I know that staff has been great in updating us in the past and it's about time for another one of those. So thank you for putting that also on the front burner. SO DIRECTOR SCOBEL AND PRINCIPAL PLANNER, THOMPSON, IF WE CAN ADD THAT TO OUR SORT OF HOT LIST OF ITEMS THAT WE NEED TO KEEP AN EYE ON AND WE'D LIKE AN UPDATE ON We'd really appreciate that. |
| 00:14:47.96 | Director Scobel | THE END OF THE END OF THE We can do that for you. |
| 00:14:50.58 | Kristina Feller | Great, thank you. Okay, if there are no other comments at this time, Mary, did you have something to add to that? |
| 00:15:00.82 | Mary Wagner | just jumping in in case there was a question about whether we needed to take public comment or not just want to make sure i was was here |
| 00:15:07.04 | Kristina Feller | Yeah, we're moving. Item number four right after this is public comment. |
| 00:15:07.26 | Mary Wagner | We're making it. |
| 00:15:11.57 | Mary Wagner | We need to take public comment on this item that is on your agenda as well as public comment for items that are not on your agenda. |
| 00:15:18.84 | Kristina Feller | Thank you for the reminder as we have sort of restructured this. I do appreciate that. So thank you for that reminder. So, Director Scoble, if I could ask you to provide some instruction to the public on how to raise their hand in the Zoom application or by cell phone so we can open public comment here. |
| 00:15:39.28 | Director Scobel | Thank you, Chair Feller. Audio or video public comment participation is limited to three minutes per speaker. If you'd like to make a comment, please raise your hand in the Zoom application, and you will be called upon when it's your time to speak. To raise your hand from a phone, press star nine, and each speaker will be notified when the time has elapsed. |
| 00:15:57.40 | Kristina Feller | Excellent, thank you very much. So at this time I will open public comment and I will be looking for raised hands on my screen. |
| 00:16:10.06 | Kristina Feller | Just give anyone a moment. All right, seeing none, I'm gonna go ahead and close public comment. on these items of communication and such And then I'm going to reopen public comment for items not on the agenda this evening. So anything not on our agenda this evening I'm taking public comment on that now. So I'm looking for raised hands from the audience. Just give everyone a moment to do that. |
| 00:16:42.29 | Director Scobel | Chair Feller, if I may, sometimes staff provides a preamble to this item regarding this item on the agenda. Would you like me to provide that as well? |
| 00:16:52.08 | Kristina Feller | That would be very helpful because I'm not seeing any hands right now. So perhaps some direction would be helpful. |
| 00:16:56.95 | Director Scobel | Thank you. This is the time for the Planning Commission to hear from citizens regarding matters that are not on the agenda, except in very limited situations, state law precludes the Planning Commission from taking action or engaging in discussions concerning items of business that are not on the agenda. However, the Planning Commission may refer matters not on the agenda to staff or direct the subject to be agendized at a future meeting. |
| 00:17:21.74 | Kristina Feller | Thank you, Director Spogel. I'm just looking for a raised hand. I am not seeing any. Could staff just confirm that? forming. |
| 00:17:31.73 | Director Scobel | Chair Feller, you are correct. There are no hands raised at this time. |
| 00:17:34.57 | Kristina Feller | Okay, let's go ahead and close public comment at this time and move on to item five on our agenda, which is the approval of the planning commission minutes. I'm not going to call on each of you, but were there any comments on the meeting minutes? published. I'm just looking for any reaction. No, none. In that case, and these are the draft minutes from December 15th, from our hearing on December 15th, If I could get a motion to approve the minutes, |
| 00:18:06.14 | Jeffery Luxenberg | No more. |
| 00:18:07.17 | Kristina Feller | Thank you. Thank you both. Director Scoble, could you please take the roll call? |
| 00:18:12.38 | Director Scobel | Thank you. |
| 00:18:12.43 | Jeffery Luxenberg | Thank you. |
| 00:18:12.55 | Director Scobel | for |
| 00:18:12.97 | Jeffery Luxenberg | Thank you. |
| 00:18:13.03 | Director Scobel | Thank you. |
| 00:18:13.43 | Jeffery Luxenberg | Yes. |
| 00:18:14.07 | Director Scobel | Thank you. |
| 00:18:14.39 | Jeffery Luxenberg | or Luxembourg? |
| 00:18:14.96 | Director Scobel | Thank you. |
| 00:18:15.49 | Jeffery Luxenberg | Yeah. |
| 00:18:16.28 | Director Scobel | Commissioner Gunniewicz. Yes. Vice Chair Grass. Yeah. Carefeller. |
| 00:18:20.69 | Kristina Feller | Yeah. |
| 00:18:21.82 | Director Scobel | You can pass those unanimously. |
| 00:18:23.86 | Kristina Feller | Thank you. Let's go ahead and move on to item six, which is our public hearing items. And Director Scobo will hand that over to you. |
| 00:18:32.16 | Director Scobel | Thank you. Before we get into our public hearing items, this is an opportunity for the planning commissioners to declare any ex parte communications. |
| 00:18:42.27 | Kristina Feller | Okay, Commissioner Junius. |
| 00:18:46.10 | Andrew Junius | no ex parte communication. |
| 00:18:47.92 | Kristina Feller | Thank you. Commissioner Luxenberg. |
| 00:18:50.42 | Jeffery Luxenberg | No expert paid communication. |
| 00:18:52.66 | Kristina Feller | Thank you. Mr. Saad? |
| 00:18:54.76 | Jeffery Luxenberg | Nothing to declare. |
| 00:18:55.95 | Kristina Feller | Thank you. Vice Chair. |
| 00:18:58.59 | Jeffery Luxenberg | Thank you. |
| 00:18:58.62 | Director Scobel | No. |
| 00:18:58.69 | Richard Graef | Bye. |
| 00:18:58.81 | Director Scobel | communication. |
| 00:19:00.51 | Kristina Feller | I have none either. |
| 00:19:02.96 | Director Scobel | Thank you. With that, we'll get right into our first public hearing item. This is a request for a tree removal permit at 620 Nevada Street. In the absence of our assistant planner, I guess absence, Principal Planner Roslyn Thompson will be providing the presentation. |
| 00:19:21.13 | Rozalynne Thompson | Great, thank you. |
| 00:19:23.17 | Unknown | Mmm. |
| 00:19:23.85 | Rozalynne Thompson | Thank you, Director Scoble. I'm gonna go ahead and share my screen. I've prepared a PowerPoint presentation. |
| 00:19:45.10 | Rozalynne Thompson | Okay, can everyone see that? Looks good Roslyn. All right, great. Good evening Chair, Vice Chair, and Commissioners. The agenda item before you is a request for a true mobile permit located at 620 Nevada Street. |
| 00:20:02.54 | Rozalynne Thompson | you If I just close it. |
| 00:20:09.56 | Kristina Feller | No, we see it. |
| 00:20:10.56 | Rozalynne Thompson | Okay, great. Okay, the applicant and property owner, Alex Frankel, requests Planning Commission approval of a true mobile permit to remove a giant sequoia Latin name Sequoia dendron giganteum. due to its size and location near the home, utilities, and power lines. The applicant states in the application that no replacement tree is proposed. As for the description of the tree, the tree measures 35 and a half inches in diameter at breast height or DBH, and the height of the tree is 30 feet. The tree is located near the entryway of the residence at the southeast corner of the property. According to the Arborist Report, the tree has an odd aesthetic due to repeated top pruning for line clearance. Also, the tree has chronic fungal twig blight called but just very ed canker, which causes constant dead branches in the canopy. |
| 00:21:02.25 | Alex Frankel | of the cannabis. |
| 00:21:05.61 | Rozalynne Thompson | Section 11.2.030 of the Sausalito Municipal Code enumerates the required criteria for approval of the tree permit to remove a protected tree. The following slides outline the applicable findings. Staff has analyzed the project against the findings and has concluded that the project meets the findings under one and two and does not meet any of the findings for denial in finding three. So on this slide is finding one On the next slide is finding two. And on the next slide, is finding three. |
| 00:21:54.88 | Rozalynne Thompson | Next slide. The staff recommends that the planning commission adopt a resolution to Review the tree removal request. and required findings and adopt the attached resolution which makes the required determinations for approval of a tree removal permit to allow the removal of a giant sequoia tree to conditions. Alternatively, the Planning Commission may Approve the tree removal permit with modifications. continue consideration of the item for additional information, or move to deny the true removal permit and identify one or more of the findings for denial listed in section 11.2.030B3. That concludes staff's report on this item, and I am available to answer any questions. |
| 00:22:37.29 | Kristina Feller | Excellent. Thank you very much for this presentation. If I could just ask before we open this up to the commissioners for questions to staff, could you let us know if you have received any written public comment on this particular item? |
| 00:22:55.60 | Rozalynne Thompson | staff has not received any written public comment on this item. |
| 00:23:00.22 | Kristina Feller | And has there been notice circulated? |
| 00:23:03.66 | Rozalynne Thompson | there was notice within a 300 foot radius. |
| 00:23:06.52 | Kristina Feller | Excellent. Thank you very much. OK, let's go ahead and stop sharing screen for just a moment. |
| 00:23:14.12 | Rozalynne Thompson | Okay. |
| 00:23:19.41 | Kristina Feller | for that okay here we go okay um let me ask the commissioners if they have any specific questions for staff at this time uh commissioner lexenberg I hope you're on mute. There we go. |
| 00:23:35.79 | Jeffery Luxenberg | Just one. Your slide says object to condition. is one of the conditions that they do replace the tree. I understand that even though they've suggested not replacing the tree, one of the conditions you've included is to replace the tree. Is that correct? |
| 00:23:56.24 | Rozalynne Thompson | Um, Commissioner Luxenberg, let me open up the staff report. and the draft conditions see exactly if that is in there. |
| 00:24:13.61 | Kristina Feller | Yeah, that's a good question. Let's get that answered. |
| 00:24:16.28 | Alex Frankel | an answer. |
| 00:24:24.21 | Andrew Junius | but I think honestly the Chair Feller earlier in the meeting, we're not going to replace the tree. make sure there's a few bucks going to the tree fund. |
| 00:24:35.60 | Rozalynne Thompson | Okay. I see it. So it's general condition number two, the applicant shall install a replacement tree on site in accordance with the observations made in the arborist report. So yes, I... I see that there's a conflict between the staff report and the conditions of approval. I believe the applicant is here and we can ask that question whether or not they agree to that condition. if the Planning Commission chooses to move forward with that condition as is. |
| 00:25:11.27 | Kristina Feller | Okay. |
| 00:25:11.66 | Jeffery Luxenberg | So there is a requirement And the conditions indicate that they will replace it. That's a condition you don't know it takes. agreed to that, but that is what was sent out as the proposed resolution there. |
| 00:25:24.45 | Rozalynne Thompson | That's correct. |
| 00:25:25.73 | Jeffery Luxenberg | OK, thank you. |
| 00:25:28.59 | Kristina Feller | Thank you, Commissioner Luxenberg. Do you have any additional questions at this time? |
| 00:25:33.02 | Jeffery Luxenberg | That was the normal way to go. |
| 00:25:34.04 | Kristina Feller | Okay, great. Commissioner Saad. |
| 00:25:37.93 | Nastassya Saad | I don't have any questions for staff. |
| 00:25:39.88 | Kristina Feller | Okay, thanks. Commissioner Junius. |
| 00:25:42.27 | Andrew Junius | No questions for staff. |
| 00:25:43.74 | Kristina Feller | Thank you. Vice Chair Graff? Thank you. |
| 00:25:45.60 | Andrew Junius | No question. |
| 00:25:46.07 | Kristina Feller | Thank you. OK, great. Roslyn, I wanted to ask you if you've had any conversations with the arborist about a species for a replacement tree. |
| 00:26:02.81 | Rozalynne Thompson | Staff is not aware of any conversation that has occurred between the arborist and staff that was working on this project, Adam East. |
| 00:26:10.65 | Kristina Feller | Yeah. |
| 00:26:11.58 | Rozalynne Thompson | about a replacement tree. |
| 00:26:11.62 | Kristina Feller | about it. Okay, okay, and I know unfortunately he could not be here this evening due to a family matter. SO I APPRECIATE THAT. If there are no other questions from the commissioners at this time, I'd like to ask the applicant to Um, make their presentation regarding their project, and I'm hoping the arborist is available for the applicant as well. Roslyn, do you see those individuals or that individual in the audience here? Thank you. |
| 00:26:46.65 | Nicole Back | Thank you. |
| 00:26:46.67 | Kristina Feller | Let's see. |
| 00:26:47.21 | Nicole Back | Thank you. |
| 00:26:47.24 | Director Scobel | Thank you. |
| 00:26:47.34 | Nicole Back | Thank you. |
| 00:26:47.36 | Director Scobel | And |
| 00:26:48.59 | Kristina Feller | for fellow |
| 00:26:48.89 | Nicole Back | Thank you. |
| 00:26:48.98 | Director Scobel | Yes, I do. |
| 00:26:49.11 | Nicole Back | Thank you. |
| 00:26:50.87 | Director Scobel | Mr. Frankel is in |
| 00:26:53.10 | Kristina Feller | Oh, Mr. Frankel. Okay. Could we unmute Mr. Frankel? and ask him to share a screen And if our Zoom team could prepare the clock, |
| 00:27:09.58 | Kristina Feller | as well and have that on screen. |
| 00:27:14.48 | Kristina Feller | Good evening, Mr. Frankel. |
| 00:27:17.01 | Alex Frankel | evening. Can you hear me? |
| 00:27:18.31 | Kristina Feller | We can absolutely hear you, yes. |
| 00:27:21.70 | Alex Frankel | Okay, thank you. |
| 00:27:23.02 | Kristina Feller | So welcome this evening. We'll get the clock up here as a screen so you can see. You'll have 15 minutes to make any presentation, either yourself or anybody on your team, if you're arborist. IF ANYBODY'S AVAILABLE TO ASSIST YOU. And if we ask you questions, that doesn't count against your 15 minutes. So I'm going to hand the floor over to you if you would like to share your video. And let us know if you have any slides that you want to share. We can, we can give you that option as well. |
| 00:27:51.03 | Alex Frankel | Yeah. |
| 00:27:59.73 | Alex Frankel | Okay. Can people hear me now? |
| 00:28:01.76 | Kristina Feller | We can hear you, we can see you. |
| 00:28:03.70 | Alex Frankel | Okay, excellent. In fact, I did not prepare a long presentation. I was under the impression that I was just gonna be asked questions. And so, essentially, What the staff prepared is a good summary of the arborist report. and to me I've owned this property for 20 years. I've had this tree, sort of been dealing with it for 20 years. You know, it's a tree that was just too large for the site, being a giant sequoia, and it's right under not only power lines, but high voltage power lines. It's been repeatedly topped. to the point where it's just kind of a mess. And it also has this fungal blight which has meant has to be pruned every year, has a number of dead limbs. I've been putting up with it. And in fact, I have planted a tree in its shade about five years ago that could be the replacement. No, I don't think it would be a good idea to plant one exactly where it is because of all the utility lines. So, you know, certainly the one I planted could be the replacement or I could plant something that would grow, you know, to a height that would be underneath the utility lines. I'm totally agreeable to that. In fact, on the property, I've planted over 20 trees in the 20 years I've owned it. to create a privacy hedge in oak trees, maple, other trees. So, you know, I'm not against trees. It's just this one tree is not really, it never was the right tree for this place. I think, you know, There's other, issues, you know, it's sort of a fire hazard being up inside and amidst these power lines. There's been a case of some sparking at one point in which I had to call PG&E. Um, so, you know, that's essentially it. I don't, to me, it's not terribly complicated and I appreciate the work that, um, Adam East did to condense and integrate the arborist report that I presented But yeah, I don't... know if there's you know any I'm open to any more questions of course |
| 00:30:28.54 | Kristina Feller | Great, Steph, let's go ahead and stop the clock there. Thank you for that. And Mr. Frankel, thank you very much. for that. I don't know if your arborist is available either at the moment, but |
| 00:30:41.30 | Alex Frankel | He's not. I talked to him, and he said he'd worked with Sausalito before, and that generally he felt, unless it was multiple trees, his presence wouldn't be necessary, and I sort of agreed with him. |
| 00:30:54.10 | Kristina Feller | Okay. So I'm going to ask if the commissioners have any questions for you. So if you can stay there on camera and on microphone, that would be helpful. Commissioner Junius, do you have any questions for the applicant? |
| 00:31:09.26 | Andrew Junius | Thank you, Chair Feller. Yeah, just Mr. Frankel, one more time, can you clarify again? You said something about you actually have planted some trees that are essentially gonna take the place of this tree. I fully understand your, desire not to replace it in the exact same spot under the wires water pipes, all that kind of stuff. Give us an idea one more time of your Thank you. current replacement efforts. |
| 00:31:30.98 | Alex Frankel | Thank you. Yeah, I mean, in terms of the replacement, I have no problem planting a tree that would grow to a height of maybe 20 feet where, you know, it will would be potentially removed in about five feet behind it. I have planted another tree. um and that tree is slowly grown in the shade of this tree so i'd always seen that as a eventual replacement that would fit into the air space that um is is there as opposed to this one which really doesn't fit because of six lines above it but like again i'm no problem planting another tree |
| 00:32:11.61 | Kristina Feller | Great, thank you. Commissioner Junis, do you have any other questions? |
| 00:32:15.83 | Andrew Junius | Nope, that was it. Thank you, sir. |
| 00:32:16.56 | Kristina Feller | Thank you. Great, thank you. Commissioner Saad. |
| 00:32:24.15 | Nastassya Saad | Thank you, sorry, let me unclick mute. I just had one based on what you just said, Mr. Frankel, the tree that you've, already planted in the shade of this tree. Is there any hindrance to that tree? If you were to remove this one, is it thriving in shade? by any chance or would its health be okay without |
| 00:32:46.20 | Alex Frankel | Oh no, it would actually start really growing. If the other one was gone, then it could get some light. It's got good roots and everything, but it's only six or seven feet tall at this point. |
| 00:32:57.88 | Nastassya Saad | Do you know what kind of tree it is? |
| 00:32:59.48 | Alex Frankel | I think it is also either a fir or redwood. I don't remember exactly. |
| 00:33:03.21 | Nastassya Saad | or Okay, that's all. Thank you, Chair Feller. Thank you. |
| 00:33:09.00 | Kristina Feller | Thank you. Um, Commissioner Luxenberg. |
| 00:33:13.09 | Jeffery Luxenberg | The question I had was the answer when we answered Commissioner Junior's discussion is almost |
| 00:33:20.04 | Kristina Feller | Thank you. |
| 00:33:20.06 | Kristina Feller | Okay, great, thank you. Vice Chair Brown? What? Okay. I just had a couple for you, Mr. Frankel, and again, thank you for also try to take care of this tree. Obviously you've been attentive to it. Um, Did your arborist, has your arborist ever sort of assessed these other 19, 20 trees on your site? YOU KNOW, IN TERMS OF you know, the type of species or Sometimes these giant sequoias really create a very acidic Uh, ground and of course our interest would be that that it was you know anything there would thrive |
| 00:33:57.77 | Alex Frankel | Thank you. |
| 00:33:59.61 | Kristina Feller | and be successful in planting it there One of the things we are always concerned about is the birds, the bees, and and every other squirrel that likes to nest in these types of trees. So could you give us some idea? |
| 00:34:15.41 | Alex Frankel | Okay, the question is what are the other species on site? um, |
| 00:34:18.83 | Kristina Feller | And if the arborist is indicated you know, if they can be successful, |
| 00:34:25.33 | Alex Frankel | Oh, you know, he didn't weigh in on the other trees, but |
| 00:34:25.36 | Kristina Feller | Thank you. |
| 00:34:28.92 | Alex Frankel | I actually planted about 10, 10 or more oak trees from acorns. kind of an amateur gardener and so these trees are doing really well. I mean, In the last 12 years, they've reached 15, 20 feet heights. you know, from Acorns, so they're doing really well, I'm not concerned about their health. Um, And in fact, the property is next to this odd sort of city owned island on Nevada Street. And While I was living there about six years ago, two Monterey cypress trees fell down in the storm. And I've planted oaks in their stead as well as a redwood to sort of fill that area as well. You know, so I think that I've contributed a lot of tree vegetation and it you know although of course we would lose some with this tree It's just not been a very healthy tree. |
| 00:35:38.57 | Kristina Feller | I appreciate the coloring some of that in for us and give us a better understanding about that Yeah, thank you. Um... I don't have any additional questions or comments at this time. unless anybody else does and I'm just looking for Someone raises their hand? No. Um, So we're going to go ahead and open this up for public comment. And so Mr. Frankl, if you can listen into that, I'm looking for raised hands in the audience, either through your Zoom application, or a star nine on your cell phone. And I'll make some notes myself of any questions or comments we might get from the audience. Mr. Frank, no need to respond to these. We'll just make note of those. So are there any anyone in the public who would like to make public comment? I'm looking for raised hands. |
| 00:36:33.97 | Unknown | any Anyone in the world |
| 00:36:42.93 | Kristina Feller | Well, I'm not seeing anyone. We have a very quiet public this evening. So I'm gonna go ahead and close public comment and bring this discussion. back up to our virtual dais here. And would anyone like to start the conversation? |
| 00:37:03.75 | Kristina Feller | Okay. All right, Commissioner Junius. |
| 00:37:05.81 | Andrew Junius | I would just go ahead and make a motion to approve based on the staff recommendation, which I believe includes replacement tree that the owner has said he will he will act on. motion. |
| 00:37:18.04 | Kristina Feller | Okay. Um, Okay, is there any, there's a second, okay. |
| 00:37:21.23 | Andrew Junius | Is there... |
| 00:37:23.78 | Kristina Feller | any other further discussion on that any other comments from anybody Commissioner Saad Okay, Commissioner Luxembourg. I just wanna ask staff in that regard about the recommendation. that they work with you staff on what that what the appropriate replacement tree would be and ensure that, I mean, these giant sequoias, I mean, even though this one is considerably small in terms of how large it could be, Um, that we sort of assess that whatever replacement tree could be successful there and provide some variety to what's already there so we can have a very successful situation on the ground. |
| 00:38:10.63 | Rozalynne Thompson | the staff will work with the applicant. |
| 00:38:12.77 | Kristina Feller | Okay. |
| 00:38:13.11 | Director Scobel | Thank you. |
| 00:38:13.12 | Kristina Feller | you |
| 00:38:13.60 | Director Scobel | Yes, definitely. And staff can also work with the applicant in conjunction with the arborist. And there are many native trees that could be appropriate for the site. And the owner of the property may decide that he wants a native flowering tree that would not interfere with any of the utility lines, deciduous evergreen. So there's lots of options out there. Yeah. |
| 00:38:37.24 | Kristina Feller | For avoidance of doubt, that includes, you know, whatever is an approved species on the Southern Marin Fire, list. |
| 00:38:43.04 | Unknown | Thank you. |
| 00:38:43.06 | Director Scobel | Thank you. |
| 00:38:43.14 | Unknown | Thank you. |
| 00:38:44.76 | Kristina Feller | Okay, great. So we have an active motion on the floor here. We have a motion and a second. If there are no other motions at this time, Director Scoble, could you please take a formal call? |
| 00:38:58.25 | Director Scobel | and the Schiner side. Yes. Commissioner Luxenberg. Thank you. |
| 00:39:02.36 | Jeffery Luxenberg | The office. |
| 00:39:02.75 | Director Scobel | Thank you. Commissioner Arjunia? Vice Chair Graff. Yeah. Chair Feller. |

| 00:39:08.15 | Director Scobel | Thank you. |
| 00:39:08.19 | Unknown | Thank you. |
| 00:39:08.29 | Director Scobel | you Motion carries unanimously. |

| 00:39:31.20 | Kristina Feller | Thank you very much, and Mr. Frankel, thank you, and good luck with the tree removal and replacement. OK, let's go ahead and move on to our next item, 6B, which is 39 Caledonia Street. |
| 00:39:47.35 | Director Scobel | I'll hand that over to you. Thank you. This second public hearing item is a request for a sign permit, as you indicated, at 39 Caledonia Street. Roslyn Thompson will also be providing this presentation. |
| 00:40:01.85 | Rozalynne Thompson | Thank you, Director Scobble. Let me go ahead and share my screen. |
| 00:40:12.62 | Rozalynne Thompson | Can everyone see this? Let the presentation. Okay, great. |
| 00:40:15.42 | Unknown | Yeah. |
| 00:40:17.11 | Rozalynne Thompson | So good evening chair, vice chair and commissioners. The agenda item before you is a request for a sign permit located at 39 Caledonia Street. |
| 00:40:23.96 | Unknown | down here. |
| 00:40:29.27 | Rozalynne Thompson | The applicant, Susanna Svesh, on behalf of Sharon Kahn, requests a sign permit to install a 13 square foot wall sign at the ground floor of 39 Caledonia Street. |
| 00:40:33.29 | Unknown | THE END OF THE END OF THE |
| 00:40:40.97 | Rozalynne Thompson | The purpose of the sign is to identify the business, Zalta Mediterranean, a restaurant. The paint palette of the sign is blue and yellow with a white background. The sign will be illuminated by Goosnep lighting. The font for the lettering is Brandon Proteste. The table in this slide indicates the dimensions of the sign, as well as its purpose and type of illumination. |
| 00:41:07.68 | Rozalynne Thompson | Here's an elevation of the front facade of the 39 Caledonia Street building. As you can see, the sign will be located above the entry to the space. Staff will now analyze the project based on the applicable regulations in the zoning code and the required findings. As to the size of the sign, subsection 10.42.060K of the zoning code allows ground level businesses businesses assigned area of half a square foot of signage for lineal foot of business frontage on an outdoor public area to a maximum of 50 feet. The frontage of the first floor of the 39 Caledonia Street building is approximately 34 feet, and therefore the maximum allowed sign area for this business is 17 square feet. with a proposed area of 13 square feet The proposed sign complies with the standard. As to the lighting of the sign, subsection 1042.060.G of this Sausalito Municipal Code requires that signs be illuminated only by continuous and stationary light sources. Signs that are sternly eliminated are limited to a minimum amount necessary to lie only the sign in accordance with subsection 10.42.060.G2 of the Sausalito Municipal Code. Further external light sources are required to be directed at the sign so that only the sign faces illuminated and they do not cast light onto other properties or in the public right of way. There is an existing goose neck style lighting affixed to the front facade of the building and the applicant is not proposing to add any additional lighting as part of the permit request. As to the font again, it is sans serif font titled Mediterranean Brandon Grotesque. |
| 00:43:01.35 | Rozalynne Thompson | This slide enumerates the signed permit findings. In order to approve the signed permit, the Planning Commission must determine whether the project is in conformance with the following signed permit findings in section 10.42.090D of the zoning code. The findings are outlined in the next four slides and the project's compliance with the findings are detailed in the resolution attached to the staff report. Staff has concluded that the project complies with all applicable findings. So on this slide is our findings one through three. On the next slide are findings four, five, and six. |
| 00:43:44.99 | Rozalynne Thompson | And on the next slide are finding seven, eight and nine. |
| 00:43:52.16 | Rozalynne Thompson | And this slide's findings 10 and 11. And again, staff has prepared an analysis in the resolution and has concluded with the findings that that the project meets all of the findings. |
| 00:44:07.80 | Rozalynne Thompson | Staff recommends that the Planning Commission adopt a resolution to approve the tax draft resolution, which makes the findings to approve sign permit 2021-00327 to allow one 13 square foot wall sign, The options for the Planning Commission are Approve the attached draft resolution, approving the sign permit to allow one wall sign at 39 Caledonia Street. deny the signed permit and direct staff to prepare resolutions with specific findings for denial, or three, continue the hearing for additional information and or project revisions. That concludes staff's report on the item. I am available to answer any questions that the commissioners may have. |
| 00:44:48.89 | Kristina Feller | Outstanding, thank you so much, Roslyn, for that presentation. Let's go ahead and stop the screen share. And let me ask the commissioners if they have questions of staff at this time. Commissioner Saad, do you have any questions of staff? |
| 00:45:06.86 | Nastassya Saad | of staff and future fellowships. |
| 00:45:09.01 | Kristina Feller | Commissioner Ingenius? questions. Thank you. Commissioner Luxembourg? |
| 00:45:14.98 | Jeffery Luxenberg | No question. |
| 00:45:16.75 | Kristina Feller | Instagram. |
| 00:45:18.71 | Richard Graef | Yeah, I was wondering, the white rectangle I couldn't tell from my view standing quite when I was there, but Is that a panel or is that a painted rectangle on the surface up there. Or do you know? |
| 00:45:39.52 | Rozalynne Thompson | Vice Chair, I believe it is painted. I also believe that the applicant is in attendance, so they can answer that any specific question. |
| 00:45:47.96 | Unknown | Thank you. |
| 00:45:47.97 | Kristina Feller | Okay. |
| 00:45:48.50 | Unknown | Thank you. |
| 00:45:50.74 | Kristina Feller | Okay, thank you, Vice Chair Graff. Let's make sure that we ask the applicant to to indicate that to us. And I just wanted a question, clarification, Roslyn. Um, Is there any, is there no additional lighting that is cast onto the new sign. |
| 00:46:16.10 | Rozalynne Thompson | According to the applicant, they're just going to use the existing lighting. |
| 00:46:21.55 | Kristina Feller | Okay. And assuming whatever was there before the lighting that was used was approved under our current standards, AND REQUIREMENTS |
| 00:46:33.30 | Rozalynne Thompson | So, if The staff report If I recall correctly in the staff report, that that was an existing sign and it's been around for about 10 or 12 years. And so with the existing sign, that lighting was approved with the existing sign. |
| 00:46:53.62 | Kristina Feller | Okay. |
| 00:46:53.99 | Kristina Feller | Thank you. Okay, thank you. Any other questions for staff at this time? seeing none, let's go ahead and ask the applicant, to provide any presentation, Um, any statements, anything they would like. Do you see them in the audience here? |
| 00:47:21.70 | Director Scobel | Mr. Feller, I see, I'm sorry, is Susanna S. And I believe she is the owner of the restaurant. |
| 00:47:29.51 | Kristina Feller | Okay. |
| 00:47:32.01 | Director Scobel | Susanna has been co-hosted and has controls to share her video and audio. |
| 00:47:37.44 | Kristina Feller | Excellent. Welcome, Susanna. I don't know the last name, so forgive me. I don't want to... Misstate your name. but welcome this evening. If I could ask staff to please project the timer also. SO WELCOME, YOU'LL HAVE 15 MINUTES TO USE THAT TIME HOWEVER YOU WOULD LIKE TO you know, present your project or give us some insight or you've heard a little bit of our questions to staff if you can help answer those. The 15 minutes is all your time and should we interrupt you with any questions that does not count against your time. So looking forward to hearing from you. So welcome. |
| 00:48:18.58 | Susanna | Thank you. Good evening. I think Rosalind did such a fantastic job presenting that. I don't have too much to add. I will say there has been a sign in that exact same location for about 20 years, well before I was involved in the business. To answer a few of the comments I've heard, we are not changing any lighting. There is, I believe, one gooseneck light that illuminates the sign currently. And I believe that was approved years and years ago, but honestly, I'm not quite sure, as I haven't been involved in. we won't be changing that at all. Um, And the other question, I guess, was the white background, and that is painted on the building, not a panel. and I'm happy to answer any other questions anyone has. |
| 00:49:16.18 | Kristina Feller | Thank you so much. Let's go ahead and stop the clock. Thank you so much, Susanna. LET'S SEE COMMISSIONERS DO YOU HAVE ANY QUESTIONS FOR THE APPLICANT AT THIS TIME COMMISSIONER LUXENBURG |
| 00:49:28.11 | Jeffery Luxenberg | Not at the level. |
| 00:49:30.18 | Kristina Feller | OK, thank you. Commissioner Junius. |
| 00:49:32.90 | Jeffery Luxenberg | No questions. |
| 00:49:33.49 | Andrew Junius | Thank you. |
| 00:49:34.32 | Kristina Feller | Mr. Saad? |
| 00:49:35.68 | Unknown | . |
| 00:49:35.87 | Richard Graef | Thank you. |
| 00:49:36.55 | Kristina Feller | GRAPH. |
| 00:49:38.00 | Andrew Junius | No more questions. |
| 00:49:39.58 | Kristina Feller | I do not have any questions for you either so appreciate that thank you very much we're gonna take a public comment now, so you might want to listen into that. And if we have any additional questions for you, |
| 00:49:45.44 | Kristina Feller | and come with. |
| 00:49:52.20 | Kristina Feller | I will certainly ask. But thank you. Thank you for being here this evening. |
| 00:49:56.37 | Susanna | Thank you. |
| 00:49:57.71 | Kristina Feller | At this time, let's go ahead and open up this item to public comment. To do so, please raise your hand in the Zoom application for Star 9. if you're phoning in from a cell phone. |
| 00:50:09.13 | Unknown | coming in. |
| 00:50:11.86 | Kristina Feller | I'll go ahead and look for any raised hands in the audience. Thank you. |
| 00:50:16.35 | Unknown | Thank you. |
| 00:50:16.37 | Kristina Feller | Thank you. |
| 00:50:16.39 | Unknown | you |
| 00:50:18.97 | Kristina Feller | I do not see any hands in the audience. Give it another moment. Okay, let's go ahead and close public comment on this item. and bring the discussion back up to our virtual dais. Um, I will start off the discussion that seems like a very straightforward request an application, and particularly if all of the lighting is in existing condition. And I know staff has looked at that against our current municipal code requirements. So this seems pretty straightforward to me and I would be in a position to support and approve this project |
| 00:50:50.03 | Unknown | Thank you. |
| 00:50:57.93 | Kristina Feller | Commissioner Junius, do you have any comment on this. |
| 00:51:01.95 | Andrew Junius | I love the font and I totally agree. We should, this seems pretty straightforward. |
| 00:51:06.34 | Kristina Feller | Okay. |
| 00:51:06.66 | Andrew Junius | Thank you. |
| 00:51:06.74 | Kristina Feller | Great. Commissioner Saad? |
| 00:51:08.95 | Nastassya Saad | I agree. make the motion or second a motion to approve this as is the great design. |
| 00:51:15.60 | Kristina Feller | Right. Thank you. Commissioner Luxembourg. |
| 00:51:19.84 | Jeffery Luxenberg | I see no issues with this as well. I would be happy to make a motion or second motion to move on as well. |
| 00:51:26.01 | Kristina Feller | Great, thank you. Voice chair graph. |
| 00:51:29.22 | Richard Graef | Well, I too like the design. I like the graphics of the logo and the word. I... feel it's unfortunate that it's stuck on this big white rectangle on the side of the building. in the way that it is. And I personally would rather see something else. which would be like painting the whole entire background opening this logo. in that space. somehow, I feel like they, they, uh, Whoever put this sign up in the beginning really didn't think too much about the impact of that. quite shape on that building, which I think is a little unfortunate. I'm, I'm, um... Only saying this, kind of as a graphic design nerd and And... and many years of signage design and it's I, I, I would just say, really like to see that logo and and well Kyle Bang. Um, I'm certainly not going to vote no on this. I like the design. I just, I'm not real happy with the way it's staged. So I'll let it go with that. |
| 00:52:52.40 | Kristina Feller | Well, the comments are appreciated and they're very important, and the world certainly needs graphic design nerds, and as well as many others. You always have a wonderful graphic eye for these things, so I appreciate the comments by Sir Graf. Um, So if there are no other comments from the commissioners, I'll entertain a motion to approve this application. |
| 00:53:18.20 | Nastassya Saad | with the motion. |
| 00:53:19.77 | Kristina Feller | Thank you. |
| 00:53:20.04 | Unknown | Second. Thank you. Second. |
| 00:53:20.78 | Kristina Feller | Thank you. THANK YOU, COMMISSIONER SAAD AND COMMISSIONER LEXENBERG. DIRECTOR SCOBEL, IF YOU COULD CALL THE ROLL. |
| 00:53:30.06 | Director Scobel | Thank you. Commissioner Saad? Yes. Commissioner Luxenberg? |
| 00:53:34.40 | Andrew Junius | you all. |
| 00:53:35.11 | Director Scobel | Commissioner Junius. |
| 00:53:36.44 | Andrew Junius | Yes. |
| 00:53:37.10 | Director Scobel | Vice Chair Grass. Yeah. carefeller. |
| 00:53:39.93 | Unknown | Thank you. |
| 00:53:40.03 | Director Scobel | Yeah. Motion passes unanimously. Similar to the last application, any action of the Planning Commission may be appealed within 10 days of the action to the City Council. You must complete the required appeal form and pay the appeal fees within 10 days of the action in order for the appeal to be filed timely. Questions regarding how to file an appeal may be directed to the project planner or the Community Development Department. |
| 00:54:04.97 | Kristina Feller | Thank you very much. And Susanna, thank you and good luck to the business. Let's go ahead and move on to item 6C. |
| 00:54:14.70 | Director Scobel | This last public hearing item is a request for a design review permit, heightened design review, a variance, and an encroachment agreement at 240 Glenn Drive. Rosalyn Thompson, our principal planner, will also be providing the presentation for this item. |
| 00:54:29.93 | Rozalynne Thompson | Thank you, Director Spobal. So let me pull up the phone. PowerPoint presentation. |
| 00:54:43.59 | Rozalynne Thompson | Can everyone see that? |
| 00:54:45.98 | Kristina Feller | We can see that but it looks like your side is a little bit cut off. |
| 00:54:50.71 | Rozalynne Thompson | Okay, let me just adjust things. |
| 00:55:00.07 | Kristina Feller | There you go. |
| 00:55:01.07 | Rozalynne Thompson | Okay. Oh no. |
| 00:55:07.95 | Rozalynne Thompson | Then move it to the side here. Paul. |
| 00:55:13.00 | Kristina Feller | We can see that, Basil. |
| 00:55:15.28 | Rozalynne Thompson | Okay. |
| 00:55:18.94 | Rozalynne Thompson | Let me pull up my notes. So let's get going here. |
| 00:55:28.76 | Rozalynne Thompson | All right, good evening chair vice chair and commissioners. The item before you is a design review permit with heightened design review variance and encroachment agreement at 240 Glenn Drive. |
| 00:55:42.63 | Rozalynne Thompson | Okay. The project site is a 9,017 square foot parcel located in the east side of Glenn Drive and is currently developed with a three level home. |
| 00:56:09.65 | Rozalynne Thompson | Single family residence totals 2,099 square feet, including a detached storage area with carport above located at the street front. The home is located on a steep sloping site in the downhill slope of the street. So here are the photos of the existing structures with the carport to be replaced at the center. |
| 00:56:37.02 | Rozalynne Thompson | Applicant Roger Hartley on behalf of property owners, Richard daughter and Suzanne Liffey requests the following entitlements. Approval of design review permit and height and design review for construction of a new detached garage and storage room below a 460 square foot structure in place in existing carport and to renovate the master suite by adding 62 square feet to the bathroom at the rear of the building by enclosing a portion of the rear deck. approval of variance for relief from the 15-foot height limitation for accessory structures to allow the proposed garage to be 22.8 feet in height, and recommendation to the City Council for approval of an encroachment agreement to allow a portion of the garage to occupy the right of way and to install an entry gate. |
| 00:57:31.02 | Rozalynne Thompson | As for the project history, it's follows. It is as follows. On March 10th, 2021, the Community Development Department received the application On September 27 2021 the applicants resubmitted plans, adding the proposal to enclose a portion of the rear deck to create 62 square feet of additional bathroom space in the master suite. October 28, 2021. The Historic Preservation Commission or the HPC determined that the property did not qualify as a historical resource. This final advisory historic resource determination is forward to the Planning Commission to inform the Commission's CEQA determination. |
| 00:58:15.45 | Rozalynne Thompson | As for the project description, the project entails construction of a new 460 square foot detached garage and storage area below the garage in place of the existing carport and parking deck. The proposed garage will be four feet, nine inches taller than the existing carport. It also entails enclosure of a portion of the rear deck to create the 62 square feet of additional bathroom space in the master suite. And also the encroachment agreement to construct an entry gate and to allow portions of the garage encroaching the public right of way. |
| 00:58:49.42 | Rozalynne Thompson | So the next few slides will discuss the entitlement requests, including the applicable regulations in the zoning code. So the first entitlement the design review permit is required because the zoning code requires the planning the planning commission to review projects where an existing single family residence or expansion of any accessory structure will increase the height of any building. Given that the height of the accessory structure will increase four feet nine inches the design review permit is required. Heightened design review is also required for the zoning code as a site, as the project will exceed 80% of the permitted building coverage limitations on the site. |
| 00:59:30.24 | Unknown | Thank you. |
| 00:59:33.11 | Rozalynne Thompson | The variance. So the zoning code states that the accessory buildings and structures shall not exceed one story or 15 feet in height. However, the proposed garage height is 22.8 feet and therefore variance is required. The applicant explains the need for the variance is due to the unique condition of the steep downhill slope and the need to maintain the off street parking for the home. |
| 01:00:03.49 | Rozalynne Thompson | for the encroachment permit or encroachment agreement, the applicant requests an encroachment agreement to allow a portion of the new detached garage and entry gate to be located in the city's right of way. The garage corner will encroach four feet into the street right of way or 43 square feet. The encroachment was first established in 1961 when a smaller carport was built and reestablished in 1976 when a larger carport replaced the original. I also wanted to let the Commission know that the project entails removal of a limb of the coast live oak. Coastal oaks are protected under the Tree Preservation Ordinance in section 11.12.030 of the Sausalito Municipal Code. The removal of the limb requires a tree alteration permit. However, the request was not included with the application. The planning commission has the option of either adding a condition of approval to require that the applicant returned to a planning commission, the tree alteration permit, or continue the whole item to allow the request to be noticed for the next planning commission hearing. |
| 01:01:15.71 | Rozalynne Thompson | So the next few slides outline the analysis of the project's consistency with the general plan and applicable zoning code regulations. As for the general plan analysis, staff has identified the relevant general plan objectives and policies and has concluded that the project is consistent with those applicable objectives and policies. The relevant policies are listed in the next two slides. This slide lists the relevant policies and the land use and growth management element. This slide lists the object, the relevant objectives and policies in the community design, historic and cultural preservation element. |
| 01:01:57.14 | Rozalynne Thompson | As for zoning consistency and analysis, this table demonstrates that the project complies with most development regulations, except the height of the accessory structure for which a variance is sought, and the floor area for which the heightened design review applies. |
| 01:02:18.32 | Rozalynne Thompson | The analysis of the project also requires determining whether the project meets the design review permit, height design review variance, and encroachment agreement findings. Staff's analysis is included in the resolution for the project and staff has determined that the project meets the design review permit, height design review, variance, and encroachment agreement and findings. As for the California Environmental Quality Act, at its October 28th, 2021 meeting, the HPC determined that the structure did not qualify as a historic resource, sorry, and therefore is not a historic resource under CEQA. The project is categorically exempt from CEQA pursuant to section 15301E additions to existing structures and section 15303E construction of accessory structures. So the recommendation is that the staff recommends that the planning commission approve, subject to conditions of approval, the design review permit with heightened design review, for the 460 square foot of detached garage entry gate and 62 square foot addition to the master suite. |
| 01:03:22.81 | Unknown | the |
| 01:03:29.82 | Rozalynne Thompson | The variance for the relief from the 15 foot height limit for accessory structures and recommendation to the city council for approval of an encroachment agreement to allow a portion of the garage and entry date into the city's right of way. As to the tree alteration permit, the planning commission may include a condition of approval that requires the tree alteration permit to be considered by the planning commission at a future hearing date. Also staff would like to note that condition of approval number 58 will also be corrected as per suggested by the Planning Commission. Alternatively, the planning commission may continue the hearing for additional information or in or project revisions or direct staff prepare resolution of denial. stating the specific reasons any one or more of the findings cannot be made. That concludes staff's report on this item. I am available to answer any questions. |
| 01:04:27.98 | Kristina Feller | Rosalind, thank you so much for a very detailed and thorough presentation here. There are quite a lot of elements in the presentation, so thank you. for summarizing those so eloquently for us. Let me ask the commissioners if they have questions for staff at this time. Yes, Commissioner Saad, let's start with you. |
| 01:04:49.94 | Nastassya Saad | Thank you, Chair Feller. I had one, I think for staff, Do you understand if the tree removal permit, the limb, if that is required in order to start construction. I'm just curious in terms of the cadence if we were to approve this now and they don't have that, would they be able to get started on their project? |
| 01:05:16.43 | Rozalynne Thompson | Because this is an entitlement, because the whole application package, so it's the variance design review permit and encroachment agreement, so they would have to they would have to secure the true Louisville permit before. starting construction. So it has to happen before construction. |
| 01:05:43.47 | Nastassya Saad | Okay. I just wanted to have that clarified, |
| 01:05:45.19 | Rozalynne Thompson | want to. |
| 01:05:48.07 | Nastassya Saad | Thank you. Yes. |
| 01:05:49.84 | Rozalynne Thompson | Thank you. |
| 01:05:51.09 | Kristina Feller | THE FAMILY. Roslyn, did you have something to add to that? |
| 01:05:54.60 | Rozalynne Thompson | Oh, yeah, because actually, if you think about it, it's a precondition um precondition to construction is that the limb is removed in order to accommodate the structure |
| 01:06:04.37 | Nastassya Saad | Right, that was my understanding. I just wanted to clarify, especially on record. Thank you. Thank you, Rosalyn. Thank you, Chair Feller. |
| 01:06:11.56 | Kristina Feller | Okay. Commissioner Junius. |
| 01:06:15.07 | Andrew Junius | No questions for staff. |
| 01:06:16.47 | Kristina Feller | Okay thank you Commissioner Luxenberg You're on mute. |
| 01:06:21.59 | Jeffery Luxenberg | of Thank you, I keep musing every time you go to the presentation. Thank you, Chair Keller. I'm a little concerned about this tree limb. This project was submitted in March last year. And so it's taken all this time, it gets reviewed fully. I don't understand why it's before us without the tree removal permit. when I mean, because they need it, they can't build this thing without it. And so, and it's taken this long. I don't understand why CBD or somebody didn't suggest that they submit that as part of the application so that we could approve an entirety and not have to have it come back because it can't really get built without it. So I guess I'm a little concerned about that, Ross. And why didn't you just get them to submit this and so we would have a complete application? |
| 01:07:23.89 | Rozalynne Thompson | Commissioner Luxenberg, so this actually was discovered quite late in the process and I agree with you that this is something that should have been identified earlier in the process. Um... I... Again, we've had a lot of staff changes. There's been a lot of turnover and. I and again, It got identified. Unfortunately, it got identified at the end. |
| 01:07:54.28 | Jeffery Luxenberg | When you say at the end, when was the end? After it was advertised or... Thank you. I mean, if it hadn't been advertised, it would have just got the application in. |
| 01:08:04.05 | Rozalynne Thompson | after it was advertised. |
| 01:08:07.64 | Jeffery Luxenberg | I see. |
| 01:08:10.01 | Rozalynne Thompson | Thank you. |
| 01:08:10.03 | Director Scobel | Yeah. |
| 01:08:10.21 | Rozalynne Thompson | Thank you. Thank you. |
| 01:08:10.40 | Jeffery Luxenberg | Uh, |
| 01:08:12.39 | Director Scobel | Yeah, Chair Luxembourg, if I can just reiterate Roslyn's, principal planner Thompson's comments. This project has been in process for many months and the applicant can attest to that. And there have been multiple planners and there have been multiple iterations to the project plans as well. Unfortunately, this was not caught in a timely manner and this is not the best practice that we would follow. And moving forward, we're going to create a new process and system in terms of application intake and identifying which permits are going to be required early on in the process. Unfortunately, because this application has been in process for so long and because we're facing Permit Streamlining Act time limitations, and because the project was noticed, we wanted to bring it forward to the Planning Commission so we can at least start the conversation and the decision-making process. and we did identify a path whereby there could be two options. One would be to continue the entire project in its entirety to allow for this notification before final action is taken or to provide a condition of approval whereby the Planning Commission would review it that permit on the back end. So definitely apologies for this process to date. We know it's not correct, but we are trying to move the project along |
| 01:09:44.41 | Jeffery Luxenberg | Okay. My second question relates to condition, it's actually a number of 48 problems, not 58. 58 was in a prior prior approval. In this particular in the documents you have it's actually number 48 and it relates to the construction requirements and i believe that the language that's in there is not consistent with the statutes that we don't allow contractors to do construction on city holidays i believe homeowners can do that and so this was to fix that language and i know we fixed it back in november and'm just probably due to staffing changes as well, but we got the correct language in I think in November for one of the projects. So this is actually number 48 and it would be showing I had said this in advance and I hope you were going to check with the city ordinances to make sure the language that we had adopted in November was currently what the city council or what the statutes are Did you have an opportunity to do that? |
| 01:11:01.05 | Rozalynne Thompson | Commissioner Luxenberg I have not had an opportunity to do that but Staff will do that and we'll note your correction that it is condition number 48. |
| 01:11:12.44 | Jeffery Luxenberg | Thank you very much. That's all I have, too. |
| 01:11:15.78 | Kristina Feller | Great, thank you very much for raising both issues. A voice chair graph. |
| 01:11:21.67 | Richard Graef | No questions for staff. |
| 01:11:23.95 | Kristina Feller | Okay. Um, Principal Planner Thomas Thompson, I have just a couple. um The first is, is this the same garage that had been red tagged by the city? Like they started construction on something without a permit. |
| 01:11:42.80 | Suzanne Liffey | tonight. |
| 01:11:46.23 | Rozalynne Thompson | Yeah. So Chair Feller, I would have to research that issue. I am not aware of that. |
| 01:11:53.45 | Kristina Feller | Okay. Um, and The second thing I wanted to ask you about is you know, this, This variance to a 22 foot, 8 inch height garage WHAT IS THE JUSTIFICATION OF STAFF SUPPORTING AND MAKING A RECOMMENDATION for for this commission to approve that. And the reason I'm asking that is in other instances with other applicants in front of us, we've also had or required that garages are completely see-through, even if they're fully |
| 01:12:30.68 | Alex Frankel | you |
| 01:12:30.74 | Unknown | Thank you. |
| 01:12:30.86 | Alex Frankel | Thank you. |
| 01:12:32.52 | Kristina Feller | There's a garage door and everything because of the views. And that's not the situation here. And this garage is very close to sort of a new driveway that has gone in. across the street. a little bit catty-corner and there are a lot of drainage issues along the street. And the last thing I'd wanna see is a lot of water or runoff end up in this garage. So have you guys looked at that? |
| 01:13:06.03 | Rozalynne Thompson | you So I'm unaware of that. The applicant is available for any questions as to the design of the garage. As far as staff's analysis, so, Um, The applicant in their response to variance finding B, which is owing to such exceptional or extraordinary circumstances, literal enforcement of the provisions of the title would result in practical difficulty or unnecessary hardship, So, the justification is that if the structure were limited to 15 feet in height that the structure would not be able to exceed seven feet in height at the street level due to the steep slope of the site and it would create a practical difficulty in construction and constructing a functional enclosed parking structure. |
| 01:14:00.52 | Kristina Feller | Yeah, I... I walk by this a lot. I'm not sure I'm totally understanding that. I need further explanation on that. Um, Yeah, I'm not so sure about that. Did you did did the applicant provide you something to come to that conclusion? |
| 01:14:22.88 | Rozalynne Thompson | The applicant did provide a justification The applicant is available to answer that question in more detail if that would be satisfactory to the commission. |
| 01:14:32.46 | Unknown | Okay. |
| 01:14:35.87 | Kristina Feller | Sure, yeah, no, we'll certainly, we definitely want to hear from the applicant. Um, I appreciate the applicant bringing this in front of us. I know that there obviously needs to be an improvement we just need to agree on what that might be. And the only other question I have for you staff is, WHETHER OR NOT THIS the existing carport was actually condemned, like structurally unfit. Is that part of the reason for this? |
| 01:15:11.88 | Rozalynne Thompson | I am, Chair Feller, I am not aware of that. I can definitely research it. I'm actually looking at a permit system right now. |
| 01:15:22.92 | Kristina Feller | I appreciate that for you always being right on top of it. And I'm sure that the applicant can address this as well. Director Scoble, did you have thoughts on that? Oh, you're... It's on mute. |
| 01:15:39.39 | Director Scobel | Apologies. Chair Feller, I was also just looking at our permit tracking system, and I wanted to provide an answer to your code enforcement question. There was a code enforcement complaint that was filed. However, it was deemed to be unfounded because the applicant was just installing story polls. So that's what the record is showing, and there is no other evidence in our records at records regarding the structural integrity of the carport. One could look at it and identify that it does look hazardous, but I was not able to quickly see anything in our tracking system that speaks to that. |
| 01:16:18.99 | Kristina Feller | Okay. I appreciate you guys looking at that and being on it so quickly. Um, Okay, well let's do this. Let's go ahead and ask the applicant, unless the commissioners have any additional questions that I'm just looking for, Yes, Commissioner Junius. |
| 01:16:38.33 | Andrew Junius | Mr. Chair Feller, thank you. Just yeah, to follow up, I hope that the applicant will explain how the height's being measured I'm expecting that answer too. It's a little odd. It must not be a grade where we walk by it because I like you have walked by this a lot and needs to be replaced for sure. But I really need to understand how the height is being measured. |
| 01:16:58.45 | Kristina Feller | Yeah. Thank you for that. Unless the commissioners, any other commissioners have any questions for staff or any other comments, Let's go ahead and ask the applicant to come come before us and provide a presentation or any discussion or you've had the opportunity to listen to some of the questions and get in the mind of some of us in terms of our line of questioning. Um. And Roslyn, do you see the applicant in the audience here? |
| 01:17:35.40 | Susanna | Let me take a look. |
| 01:17:42.17 | Director Scobel | Mr. Feller, if I can just jump in. We do have Roger Hartley in this meeting as well as the property owner, Mr. Dotter. Maria Hernandez, our admin aide, if you could please provide co-hosting functions to Mr. Hartley and Mr. Dotter. |
| 01:18:07.99 | Unknown | Thank you. Thank you. |
| 01:18:10.61 | Kristina Feller | Could we mute Susan Lemke? Um... Okay. Mr. Hartley, welcome this evening. Welcome to the Planning Commission. Thank you for being here. If I could also ask our Zoom team to put our Um, our clock up on screen. So Mr. Hartley can watch that. Um, You'll have 15 minutes to make your presentation that includes you and anybody else. you would like to speak on your behalf or during this time. So welcome this evening. I'll hand this over to you. Thank you. Thank you. And we'd love to hear from you. |
| 01:18:54.04 | Roger Hartley | Thank you and good evening. I'd like to share my screen with you. |
| 01:19:00.10 | Kristina Feller | There we go. |
| 01:19:02.78 | Roger Hartley | Well, I have two screens only. |
| 01:19:06.90 | Kristina Feller | We can see the drawings. |
| 01:19:08.54 | Roger Hartley | Oh, you can. Okay. Thank you. So if I could give you a little bit of an overview, the garage on the site plan is in this area, house behind. And you can see the encroachment section highlighted here as this triangle. And zoom in a little bit. Is that working for you? |
| 01:19:32.77 | Kristina Feller | Yeah. |
| 01:19:32.90 | Unknown | Yeah. |
| 01:19:32.97 | Kristina Feller | you Yes, we can. Thank you. |
| 01:19:33.61 | Roger Hartley | So, So this line along here is the existing parking deck. We're adding only a little less than two feet to it. And that is the minimum we can do and still get an enclosed garage with two-car parking and a garage door. We'd like a little bit bigger, but they're keeping it small, mainly because of the tree. We don't want to impact that tree any more than we have to. The reason a portion of the tree has to be removed is because one of the upper limbs will touch the roof. This graphic here shows a little bit what's going on. The tree is leaning quite a bit. The base of it is actually below the garage a little bit. It leans out away from it, so we don't need to trim very much of the tree. To give you a little more context, this is what it looks like from below. Viewed from the south, existing carport, house beyond. This is zoomed in a little bit more. You can see a little bit more of the house, the architecture of the house. what that looks like. This line along here is the lower storage area and the biggest amount of expansion will be on that lower floor and be moved out closer to the edge of the garage. above. Most of that is for structural reasons. We need a shear wall there in order to support this laterally. This is sort of an extreme camera here that we need to correct. And this other view is the front door. You can see the stairs to the front door which are adjacent to existing and new parking doors. |
| 01:21:31.67 | Unknown | Yeah. |
| 01:21:34.57 | Roger Hartley | And this is the view from the deck looking towards the street. In the background, you can see the bulkhead retaining wall. which is about six feet tall. And it is the reason for the height problem This graphic. shows what would be allowed using a 15-foot limit. That's based on average grade. being the average between the highest and the lowest point. I think Heidi can confirm that this is the way the ordinance reads, so the average grade being here, 15 foot high, would be up here, which gives us seven feet above the street level. to me it doesn't make a lot of sense it seems like it should be measured from street level rather than from dirt down below this really impacts downhill lots making it almost impossible to build a garage without a very But so this distance from the hashed area to the top is the 4.9 that we need in order to get this approved. Mmm. |
| 01:23:01.30 | Roger Hartley | I don't know if you have before you the rest of the, elevations and drawings, but I'll quickly go through there. Again, this is the garage with the line of the existing. This line in here is the roof of the existing carport on the floor below. Existing storeroom is here, and we're moving it out a bit and enclosing it for structural reasons and to provide some extra storage. All of that is within the envelope of the garage above. |
| 01:23:46.91 | Roger Hartley | front elevation. |
| 01:23:52.26 | Roger Hartley | You can see the meaning of the tree and how it avoids inside of the garage. Thank you. Now here's a bit of a crude perspective here. |
| 01:24:28.88 | Roger Hartley | So the gate and trellis above is new, as well as the fence along the street for privacy. So that's about it. Unless you have questions, I can turn it over to Suzanne and Rick, who will give you a bit of perspective of their needs for the garage. |
| 01:24:58.26 | Kristina Feller | Great, thank you Mr. Hartley. Yes, let's go ahead and hear from the property owners and then we'll lump our questions all together Um, after we hear from them. |
| 01:25:09.26 | Suzanne Liffey | it. |
| 01:25:09.97 | Kristina Feller | Good evening. Welcome. |
| 01:25:11.44 | Suzanne Liffey | Thank you. Thank you. We're happy to be here. Um, Can you see my screen? Let me see if I can share this. |
| 01:25:19.64 | Kristina Feller | cannot see that yet, no. |
| 01:25:21.27 | Suzanne Liffey | Okay, love you. Um, Cheers. There we go. |
| 01:25:28.66 | Unknown | . |
| 01:25:28.75 | Suzanne Liffey | Here we are. Thank you. Sure. Okay. Well, a little bit on, I thought it'd be helpful to just talk a little bit about who we are And just A little bit of background on this project. We've lived here 21 years. We plan to stay. We're not developing and moving on. We're planning to stay there and Spending so much time in the house recently, we have found we really need to make some improvements. One of which was the carport, of course. So we really worked hard in anything that we've done so far to maintain that cottage character of the house because we like it. Part of the reason we fell in love with the house and we want to keep it. As you will see, as you probably already saw from Roger's drawings, we really shoehorned that garage into the existing space. And Rosalind, to put your mind at ease, and somewhere in that mountain of paperwork that we've sent you, We actually got a tree arborist to come out and take a look at if we had to cut off that limb, which is probably just the one limb, he's certified that the tree would survive. So hopefully that will take care of tree We have concerns. We care about our trees. We thought about that. tried to make make space. for our garage. So we're retired, we're planning to stay, and I think this next slide will show you why we think on We want to start this project. |
| 01:27:01.39 | Suzanne Liffey | Thank you. |
| 01:27:01.41 | Richard Dotter | THE END OF THE END OF THE |
| 01:27:01.68 | Suzanne Liffey | Thank you. |
| 01:27:01.71 | Richard Dotter | Thank you. |
| 01:27:01.91 | Suzanne Liffey | with the |
| 01:27:01.97 | Richard Dotter | Thank you. So here in the bottom left is a photograph that was taken sometime in the early last year showing the existing structure and It's already starting to kind of lean back, lean for the left here because on the left hand side, You know, the wall holding it up below is starting to collapse. To the right is a photograph taken last week showing that it's just continuing to lean now. And I've heard some of the commissioners have walk by this so they can be okay. actually agree that it's falling down. The comment was, has it ever been condemned by the city and it was never condemned? Maybe it should be condemned, but the right-hand side is still structurally sound. So, Suzanne is using that. It's never been red tagged. We did have an issue there with the story holes that we met with discuss. |
| 01:28:02.56 | Suzanne Liffey | It wasn't for us. |
| 01:28:02.97 | Richard Dotter | construction, it was just the story goals. And, um, Our motivation for wanting an enclosed garage, and there's a few, we'd like to have an enclosed garage just for storage purposes. The other problem we've been having is my car has been broken into twice on the street in the last three years, and Suzanne twice as well. So we feel like having an enclosed garage is just going to help protect our cars and the like and just prevent them from getting broken into and the like. And I think Suzanne mentioned this, but we want to completely remodel the the main bedroom in the house that's really original, hasn't been touched since, I think, 1930 when the house was built. And in the bathroom, we want to completely remodel and extend out a few feet into this existing covered deck. And because one thing is that the bathroom was put on, added in the 50s, and it's just really extremely poor construction. It has foundation problems and the likes we're planning on. We're doing the likes. We're planning on redoing the foundation and completely redoing the bathroom. |
| 01:29:15.77 | Richard Dotter | So one of the big things is how are we going to impact the neighbors' views. So on the bottom left, we have a view from 230 Glen. That's to the south of us looking towards our property. It's just from the rear of the house, and it shows the view from 230 Glen. Richardson's page, Everon, and the like. And so the car deck, or the garage were putting all this completely to the left life and is just not going to impact its future $230 billion life whatsoever. And, you know, our several two car attached and closed garages on Glen Drive and Santa Rosa Street. So on the bottom right is two houses up from us, enclosed two car garage that's attached to one of the house. So we sent out notices last year when we began this process about what we're planning on doing. We've got all favorable comments back. You'll see some of the words here in the light. So, thank you. |
| 01:30:15.25 | Unknown | Thank you. |
| 01:30:24.90 | Richard Dotter | you So that's really Let's show the next slide. So there's a big discussion about oak tree. So here is the oak tree and it's much bigger than what Roger had shown in the drawing. So here you can see the story poles come up to here. Here we have this really big oak tree. The trunk is like six feet or eight feet below the street level. So what we're talking about doing is really trimming off this portion and we've got an arborist report saying that that's just not going to impact the tree at all. So big, big tree. I'd rather not cut the limb off, but it's just not going to have an impact. to the tree. Thank you. |
| 01:31:13.30 | Suzanne Liffey | Thank you. |
| 01:31:13.32 | Kristina Feller | Any questions? |
| 01:31:17.23 | Kristina Feller | Well, thank you so much for your presentation. Are you finished with your time? Yes. |
| 01:31:25.62 | Unknown | OK. |
| 01:31:26.40 | Kristina Feller | Great. I appreciate that. Um, I'm sure we've got some questions here. if we could stop your screen share So we can get everybody tiled up here. There we go. |
| 01:31:36.91 | Nicole Back | Sure. |
| 01:31:41.05 | Kristina Feller | There we go. So again, thank you for that presentation to the Lemke's and as well to Mr. Hartley there. Don't go far with... I'M GOING TO OPEN THIS UP TO THE commissioners to see if they have any questions or any items of clarification to you. Commissioner Junius do you have any questions of the applicants? |
| 01:32:05.90 | Andrew Junius | Not at this time. I think that was a pretty good presentation, and I got most of my questions answered. |
| 01:32:10.48 | Kristina Feller | Okay, wait, thank you. Thank you. |
| 01:32:12.23 | Nastassya Saad | Michelle. |
| 01:32:12.53 | Kristina Feller | SOMEONE. |
| 01:32:12.84 | Nastassya Saad | Thank you. Yeah, just to clarify, I think Mr. Hartley, you had said so from the 15 feet or from the additional need for the variant What what is the height at street level? Did you say that was the seven feet or is there an addition to that? What do people see from the street level in terms of height? |
| 01:32:44.66 | Roger Hartley | The height of the roof is 14 feet 14 and 1⁄4 feet high from the street. From the street, okay. |
| 01:32:55.85 | Nastassya Saad | you Okay, thank you. Chair Feller, that was the only clarification that I needed at this time. |
| 01:33:05.34 | Kristina Feller | Okay, thank you. Commissioner Luxembourg. |
| 01:33:09.10 | Jeffery Luxenberg | Thank you, Chair Feller. Mr. Hartley, can you share your screen again with the graphic that shows the the variance, the one with the seven feet and the 15 feet, if you could, |
| 01:33:22.09 | Roger Hartley | Sir. |
| 01:33:25.53 | Jeffery Luxenberg | Yeah, that one's fine. |
| 01:33:29.20 | Roger Hartley | you This might be easier to see, |
| 01:33:31.04 | Jeffery Luxenberg | Thank you. |
| 01:33:31.15 | Roger Hartley | Thank you. |
| 01:33:31.37 | Jeffery Luxenberg | Yeah, that one's good. So my question is, I understand the need for the variance. It is only, it's less than 15 feet from the street, but you have to measure from the average distance. So I get the idea for the variance. But let me ask you this. I mean, it's a nice design to have these dormers. but do you really need the dormers and all? What's going on in the height well above the car? In other words, could this be shorter than it is? |
| 01:33:31.41 | Roger Hartley | Yeah. |
| 01:34:03.50 | Jeffery Luxenberg | What's happening in this case that, I realize you need more than that 70, but why do you need as much as you're showing? What's the idea of that volume? |
| 01:34:17.29 | Roger Hartley | Well, we could certainly build a garage with a flat roof, but I don't think it would go with the style architecturally. So in order to put a door in a garage, you need a nine-foot plate height. You know, the top of the wall needs to be nine feet in order to get a door with an overhead mechanism. So that's nine right there. And then the rest is due to the pitch of the roof. So to the extent we've lowered the pitch, we could bring that down some. But as you can see, the existing house has quite a steep pitched roof, and I think it would fight with it to not match as well. |
| 01:35:01.65 | Jeffery Luxenberg | Is this matching the picture of the existing world? Is that what you're saying? |
| 01:35:05.42 | Roger Hartley | No, not exactly. I think they've got a 6 and 12 pitch here. And the house has several different pitches. There's one... Let's see if I can find it. |
| 01:35:23.81 | Roger Hartley | The living room looks like it's about 12 and 12. |
| 01:35:28.28 | Unknown | Okay. |
| 01:35:28.84 | Roger Hartley | But there are other elements of the house that are somewhat flattering. |
| 01:35:40.10 | Kristina Feller | COMMISSIONER LUXENBERG, DO YOU HAVE MORE QUESTIONS FOR THE AFRICAN |
| 01:35:42.81 | Jeffery Luxenberg | That was the question I had in the future. |
| 01:35:46.15 | Kristina Feller | Okay. Vice Chair Graham. |
| 01:35:50.07 | Richard Graef | No questions right now. The one I had relative to the roof, I couldn't put it to answer. Okay. |
| 01:36:00.89 | Kristina Feller | Great, thank you. AND AGAIN, THANK YOU FOR THE PRESENTATION. I have to tell you that I'm struggling a little bit with the height and geometry here because I think Lemke's had a wonderful picture up the driveway of the property across the street And if you look at your existing carport, which I can attest is certainly deficient, Um... and doesn't look like it's going to last much longer, what you're proposing is significantly bigger. and, you know, in height and such. And so I think it's... |
| 01:36:37.39 | Alex Frankel | Thank you. Thank you. |
| 01:36:41.94 | Kristina Feller | I'm not, THAT COMFORTABLE WITH WHAT YOU'VE PROPOSED. AND I WANT TO UNDERSTAND if there's some flexibility with what you propose. And perhaps I'm picking up also what Commissioner Luxembourg is on the dormers. Because that seems to be a new vocabulary, architectural vocabulary in your, you know, from your existing home, which is beautiful. So do you have some ideas about that or some flexibility with that? |
| 01:37:19.03 | Roger Hartley | Are you asking me? |
| 01:37:21.16 | Kristina Feller | you, the Lemke's, the applicant team, |
| 01:37:26.39 | Roger Hartley | Well, with regard to the size, This is in no way a large garage. It is the bare minimum that we can fit two cars in and still have a door. Standard these days are 24 foot wide garages. And this is, I think it's 20, 21. So it's on the smaller side. And it is hardly any larger than the structure that's there. The roof structure is much smaller, but that is so inadequate and it's falling down, it should be discounted. But of course, a garage is going to appear to have more mass involved in a flat carport. But I think a garage is appropriate here, and it's certainly the desire of the owners to have a closed, safe garage for parking. So I don't know how I can make it any smaller other than put a flat roof on it. The dormers, I believe they dress up the front and although there's no dormers on the other part of the house, there's some very small areas that sort of look like a dormer. The idea of the dormer is twofold. One is to provide light into the inside of the garage, and the other, is to do something with the mass of a large roof facing the street. It breaks up that large roof area into smaller sections, and I think it goes with the cottage style of the house quite well. |
| 01:39:07.51 | Kristina Feller | And you know, in my questions to staff, which they had deferred really to the applicant team here about the materials. You know, typically we are very keen to preserve views. And the views from this part of Sauslita, from the edge of the property on the street are lovely. Is there flexibility with making this a little bit more of a AN OPEN, visually open not not i i get the security required for your cars But is there some flexibility with the materials in making this more of a type of garage that you can look through so those views are not obstructed? |
| 01:39:59.85 | Suzanne Liffey | We have a couple of thoughts on, we play with that idea. And first of all, something that's clinical doesn't fit with the nature of our house would totally a new element. So that was one reason why we didn't really think And And the other is that If you look at the length of our unit, we have a very horizontal property. We have 40 to 50 feet on either side the, provides a view. that I mean and This cardboard is already, it's a blight. I mean, it's really an eyesore. If you've walked by, you've noticed that, but, Just in closing, it gives us security. It fits with the tenor of the house. But it doesn't change anything about the view on either side. And we're still preserving trees. So we were trying to do a lot with very you know, small projects. Sure. |
| 01:40:58.54 | Unknown | I think. |
| 01:40:59.51 | Suzanne Liffey | I think we did our best. Um, You know, but. I guess you could get rid of the dormers if that's what bothers you. But we wanted light in the garage, too. |
| 01:41:10.34 | Kristina Feller | Sure. Listen, I appreciate it. It's always such a tightrope dance, isn't it, to try to accommodate varying things. |
| 01:41:11.18 | Suzanne Liffey | Let's go. |
| 01:41:16.28 | Unknown | I'm sorry. |
| 01:41:16.36 | Suzanne Liffey | Thank you. |
| 01:41:16.50 | Unknown | you |
| 01:41:16.73 | Suzanne Liffey | to try to |
| 01:41:17.26 | Unknown | Thank you. |
| 01:41:19.87 | Kristina Feller | So it is not, please don't take my comments or questions as not being appreciative of your efforts at all. Quite the contrary. |
| 01:41:28.06 | Unknown | Good. |
| 01:41:28.43 | Suzanne Liffey | Thank you. |
| 01:41:28.45 | Kristina Feller | And again, I will reiterate, there's no question certainly from me that what's there is inadequate. So that is not the issue here. whatsoever. So I certainly don't want that to be construed, but I think that that's There's a little work to do here, but But this isn't really the time to debate that. This is really the time to ask questions of the applicant and give you an opportunity to enter into some dialogue with us so we understand your perspectives, which you have laid out very, very well. and I appreciate that. Um, I don't have any... further comments myself at this time for the applicant. Do any of the other commissioners have any more thoughts or comments at this time? If not, I think we will go ahead and open this up for public comment, and then we'll come back to deliberate after that. Um, uh, uh, to the lemke's and to mr hartley don't go too far we're going to open this up for public comment and then come back to deliberate So I will open up public comment now. I am looking for raised hands. You can do so in this new application or star nine on your cell phone. And I do see one raised hand at this time, which is column user one. Colin user number one, if you could unmute and kindly state your name for us. and you'll have three minutes for any comment. And I see a couple more hands coming up, which is wonderful. Zoom team, if we can put the timer up on the screen as well. each person has three minutes for public comment and caller User 1, please state your name and the floor is yours. |
| 01:43:28.12 | Nicole Back | Hello, good evening. My name is Nicole Back, B-A-C-K. And I represent the Dorothy Duncan Trust, which is the owner of the next door property at 230 Glenn Drive. Can you hear me? |
| 01:43:41.37 | Kristina Feller | We can, thank you. |
| 01:43:42.99 | Nicole Back | Okay, thank you. So I'll jump right into the findings because of the time constraints. How does the proposed structure relate to its surroundings and has the proposed architecture maintained the prevailing design character of the neighborhood? So I have provided some photo documentation to staff. And it's a survey of the neighboring garages and carports. and my survey begins, do you have it? |
| 01:44:15.04 | Kristina Feller | We did receive- |
| 01:44:15.80 | Nicole Back | You have the attachment? |
| 01:44:19.61 | Kristina Feller | Ms. Bach, we did receive a public comment in writing from you that is also published to the public. So we did receive that. |
| 01:44:29.58 | Nicole Back | Okay, so if you could point, if you could go to the survey, what I found by this survey is that when the houses are very diverse in style, what gives, diverse architecture of prevailing design character on our street is one of the common architecture trade. is that the layout of our neighborhood is every two-car parking solution is broken down into a one-car enclosed garage next to a one-car open carport. covered or not. Also, all of the enclosed garages on our stretch from the Bend to Casno are extremely recessed from the curb. So 230, 240 garage is now fully enclosed. and its roof is raised. And it does not allow the street to breathe. So the only exception, by the way, to that is 254 Glen Drive. fully enclosed garage. But it says, 10, 15 feet away from the curb. So the street breathes. So when As such, the prevailing character of the neighborhood would not be maintained by having such a tall, fully enclosed structure. It wouldn't be in keeping with the identity of the street, which found a way to preserve a sense of openness and minimize obstruction of the public views. And by the way, there was a city council decision that actually struck down a two-car garage at 274 Glen Drive, and you may want to look into that before it hits the city council should you approve it. Now, has the proposed project been designed to minimize obstruction of public vintage points? I haven't found any. efforts in design to actually allow the public to continue to have their views. SHIMMERING LIGHTS AT NIGHT, et cetera. So I also am going to jump to parking if I may. |
| 01:46:34.09 | Kristina Feller | I'm going to. |
| 01:46:39.35 | Kristina Feller | Ms. Bach, I know that you had some additional thoughts, but your three minutes unfortunately has lapsed and we wanna be fair and equitable to everybody. And so I'm gonna call on the next caller at this time, I see Wendy Jawor, if I have pronounced your name incorrectly, please correct me. And welcome this evening. Zoom team, let's reset the clock for three minutes. Um... Thank you. |
| 01:47:09.29 | Wendy Jawor | So can you hear me and see me? We can. |
| 01:47:09.42 | Kristina Feller | Hi. Can you? |
| 01:47:13.10 | Wendy Jawor | So I live at 228 Blen Drive, and I am in favor of this project. I think that, well, I actually wrote a letter, and if you don't mind, I'm just going to read my letter that I had written and maybe a week ago. But I'm in favor of this project because I've lived here for a little over seven years, and I've watched the current carport deteriorate. and now it just seems barely usable. One of the cars that used to park in the carport is usually always parked on the street, and we have less parking because of this. Our neighborhood's gonna look much better because the quality of the new structure. The current one is run-down looking, and it's becoming less structurally sound. I feel that the views of our neighborhood will not change because of the structure. And I'm just wholeheartedly in favor of the Sleeve Barrage at 240 Glen Drive. So thank you so much for your consideration. |
| 01:48:12.10 | Kristina Feller | Thank you so much for being here this evening and for your public comment. It's so important to the whole process here. So thank you for being here. The next hand I see raised is Scott Jamphill. If you could unmute and there we go, share your camera. Welcome this evening and Zoom team, let's reset the clock for three minutes. |
| 01:48:33.16 | Scott Jampol | everybody uh thank you for the time my name is scott jampol i'm the uh neighbor on the other side uh at 244 glenn drive we purchased our property in 2007 and have been neighbors uh with rick and suzanne since then i respectfully disagree with miss back i don't believe that this structure would change the character of the neighborhood at all and if you know rick and suzanne well or at all you know that they are not a flashy or showy uh group they they are and you look at their house it's beautiful it's understated it's it's extremely well maintained and so they're not going to build something that is different than what they've done with their house and they're not going to do something that's disruptive to the neighborhood by the way we have a an enclosed garage it's not two garage, but it's a one car garage and it's fully enclosed and it's set back about the same amount that this structure would be set back. It's not 10 to 15 feet as Ms. Beck said. So anyway, they've been incredible neighbors. They've been super flexible and courteous. Our house, our street has suffered from just about everyone redoing their properties over the last few years, especially right above them that the views we're talking about at 230 has been under construction for multiple amount of years and put tremendous parking pressure on us all on this street with all the trucks. And they haven't been able to use their parking structure because it's not safe. And they've had to fight with that, which I think. But they've been courteous about it and flexible. And honestly, now that they're trying to improve their house, |
| 01:48:54.27 | Unknown | Thank you. Thank you. |
| 01:50:06.80 | Unknown | Thank you. |
| 01:50:06.83 | Scott Jampol | I'm a little frustrated hearing about what how long this has taken and what they've had to go through to do this but I'm in support of the project I think the carport that they have is not going to be that much different than the enclosed garage they're proposing I think it's certainly not dissimilar from other structures in the neighborhood and other other recently built garage areas in the neighborhood if you just walk around I don't It doesn't impact anyone's view that lives on this street, that's for certain. When you looked at that photo of how steep 230 is above, it's not going to impact anyone's views. It's not going to impact our views, and nobody's looking in that direction anyways, truthfully. They're looking the other direction, and as Rick and Suzanne said, as you walk along our block, there's ample opportunities to see the hillside, to see the Glen Canyon, to see the water out there. And I really don't think that anyone's gonna notice any difference there. So as I said, I've seen the tent poles. I believe it's gonna be something that goes along with the character of their house and something that I think will improve all of our property value ultimately. And so I encourage you to approve the project. |
| 01:51:19.71 | Kristina Feller | Right. Thank you so much. Thank you for your comments this evening and for being here. and being part of the process. I appreciate that a lot. Um, I'm looking for any additional comment at this time I do not see any additional raised hands. So I'm gonna go ahead and I'm gonna close public comment at this time um, staff is this call-in user one the same caller from before if we can verify that |
| 01:51:51.99 | Susanna | I believe so let me ask to unmute. |
| 01:52:08.60 | Nicole Back | Caller 1, can you hear us? Yes, yes, I'm sorry. I was wondering if there was a possibility of extending the three-minute |
| 01:52:21.24 | Kristina Feller | Is this Ms. Bach from? |
| 01:52:21.27 | Nicole Back | Yes, fellas. Yes. |
| 01:52:24.97 | Kristina Feller | That's pretty good. Yes. No, we keep public comment at three minutes per caller. |
| 01:52:25.36 | Nicole Back | Yes. YES. |
| 01:52:31.38 | Kristina Feller | And that's the same and fair to everybody else. |
| 01:52:31.85 | Nicole Back | All right. |
| 01:52:36.19 | Kristina Feller | um so we're going to go ahead and comment thank you and i thank you calling in |
| 01:52:37.62 | Nicole Back | I need you. Thank you. Thank you. |
| 01:52:41.86 | Kristina Feller | and your interest in this project. Again, that's very, very important. I'm going to go ahead and close public comment at this time. and then pull this back up to our virtual dais here for discussion. before I open that, staff, Principal Planner Thompson, if I can ask you just for avoidance of any doubt, could you just confirm the written public comment that we've also received on this particular |
| 01:53:14.18 | Rozalynne Thompson | Chairfell, we received three written public comments, two from Ms. Beck and one from Ms. |
| 01:53:21.70 | Kristina Feller | Okay. Great, thank you for confirming that. Um, okay. Let's go ahead and, um, and open this up for our discussion and deliberations. Commissioner Luxenberg, do you want to start us out? |
| 01:53:44.26 | Kristina Feller | You're on mute. |
| 01:53:45.61 | Jeffery Luxenberg | I'm gonna unmute. Thank you. Uh... I mean, there is this issue about the tree permit. My questions have been answered about the design of the the height. I mean, it is less than 15 to from the street, the variance is obvious. You wouldn't be able to build the garage with a lot of variance, so I'm okay with the variance. I think we could lower the height of the roof a little bit, but I don't, it's not blocking anybody's views to the roof. This is the issue. Thank you. And the dormers actually will will provide windows, although they don't go, there are windows on the other side. So it actually will make it look more open. I agree with Mr. Hartley's design that those dormers actually will break up with you. So I'm okay with this. Thank you. can go along with the staff recommendation on this at this time. |
| 01:54:45.93 | Kristina Feller | Commissioner Luxenberg, does that include all the criteria related to heightened design review? because this project has been kicked up into height design review, not just a standard design review permit. Can you just confirm that? |
| 01:55:01.10 | Jeffery Luxenberg | Yes, I can confirm that I'm okay with that. It doesn't walk, whether it's a primary or secondary view, which is a good part of Titan designer view, because of the slope, I walk by there a lot as well. Because of the slope, you're not blocking, this isn't blocking anything of a major view. And as others have said, as you walk by, there are still ways to see between the houses. So I can make the findings. |
| 01:55:37.28 | Kristina Feller | Okay, all right. Commissioner Junius. |
| 01:55:42.42 | Andrew Junius | Thank you, Chair Feller, I generally agree with Commissioner Luxenberg's comments. I do appreciate the public comments today. It was very interesting, you know, a lot of walking around Sausalito, this is a very interesting block. and stretch of Glen Drive, a lot of eclectic, a lot of eclectic garages, a lot of carports. Totally agree with Ms. Bach about that. but certainly a lot of garages as well. I don't think anybody is arguing that something's got to go here and replace the carport. The design, I like. time. I think the dormers are frankly attractive from an I'm just a lawyer, not an architect, but I do think that'll add a little bit. a little flip. favor to the new structure. It does sit on the street. I think that's an interesting comment as well. I don't think that's nearly, given the slope issues given the complexities of measuring heights on slopes, I do think the design is pretty appropriate And I, again, I agree with Commissioner Luxembourg, the heightened design findings with respect to views are, I think, pretty straightforward from my perspective. there's a lot of trees in this area as well. And if you're standing directly in front of that carport I'm pretty sure your views through the carport are blocked by existing trees. You move over and you look over their house and you've got a great view of the water. So this is not going to affect that at all. I also, well, I appreciate your comment about transparency |
| 01:57:16.18 | Andrew Junius | to harmonize the architecture here. So I'm very supportive. |
| 01:57:21.58 | Kristina Feller | Great, thank you, Commissioner Junius. |
| 01:57:24.16 | Nastassya Saad | Thank you. |
| 01:57:24.38 | Kristina Feller | I'm not. |
| 01:57:24.50 | Nastassya Saad | Thank you. |
| 01:57:24.60 | Kristina Feller | Thank you. |
| 01:57:27.08 | Nastassya Saad | Um, Thank you, Chair Feller. I'M NOT SURE I AM 100% COMFORTABLE WITH THE HIGH. I DO UNDERSTAND, SO I APPRECIATE THE APPLICANTS making clear as to the issue with the slope to get to the need for the variant. um, I understand the need for the variants. I also understand the need for safety essentially. I guess this would probably have to go back to the applicant. I was curious if they ever, now that I think about it, looked at a design that would be a single car enclosed garage with a carport like some of the other properties. just in keeping with some of the not to discredit what Commissioner Junius just said there are garages on that stretch, but given the nature of a lot of those properties of a single car and a carport or a carport. I don't know if that was ever thought about or reviewed by the applicant. So You want an answer? No, sorry. |
| 01:58:40.89 | Kristina Feller | MAY I? no sorry discussion right now um mr and mrs lemke this is our deliberations um okay on a virtual dais so let's if you don't mind muting thank you |
| 01:58:49.08 | Nastassya Saad | Okay. |
| 01:58:49.55 | Unknown | Yeah. |
| 01:58:51.41 | Nastassya Saad | with the |
| 01:58:55.20 | Nastassya Saad | . So outside of that, I think the, you know, can't make a determination, you know, trusting the word of the applicant sounds like the tree permit. probably won't be too tedious, but of course, can't make a determination there until we read that report. So just a little curious about that as well. So I think I'd just be open to hearing the rest of the discussion before making a MYSELF HERE. |
| 01:59:21.92 | Kristina Feller | Great, thank you, Commissioner Saad. A voice chair grouse. |
| 01:59:25.85 | Nastassya Saad | Bye. |
| 01:59:25.97 | Richard Graef | Thank you. Thank you. Um, Well, generally, you know, clearly obvious that they need something. there, that poor carport was a disaster. And I think a garage is a good idea. I'm supportive of the concept. I really feel that that garage needs to be It feels to me that it's a good thing. So right on the on the street and it is encroaching in the right of way. A fair amount. And I think that's, to me, that's a problem. both visually and for kind of safety. Um, if the garage were the same width as the existing had. For example, they probably would not have to trim much of that tree at all to miss it. That's just a couple of feet. So that's what it looked like to me from there. And I am a little also disturbed by the high I think basically my view is that the whole thing is the mass and the bulk of it Yes. it's going to have quite a presence on the street. And so I feel like if it could be reduced in any way, that would be great. the pitch of the roof could come down the dormers, I'm not fond of what Dormers unless they're like real, but I guess if they're skylights or something, You could justify them and they will break up the roof line. So we're Yeah, so I'm not 100% with the project yet. I, um... Most of the findings I think can be made. I don't see any real problems with the views. I'm just disturbed by the the size and the bulk of it, and the fact that it's right on the edge of the sleeve. I think those are my main concerns, and I would like to see some attempt to address those issues. |
| 02:01:46.21 | Unknown | Okay. |
| 02:01:47.36 | Richard Graef | Otherwise, I think it's a good project and it should happen. It's just I think personally, I don't think it's quite there yet. |
| 02:01:56.17 | Kristina Feller | Okay. Thank you, Vice Chair Graff. So for my part, again first of all there's no question at all that the existing carport is deficient and absolutely Um, justly needs to be replaced. I don't have an issue |
| 02:02:17.28 | Alex Frankel | Thank you. |
| 02:02:17.30 | Unknown | I don't have an issue. |
| 02:02:18.98 | Kristina Feller | with that. the two-car garage and it being enclosed. I mean, security safety is very important. particularly if the Lempke's have no No, um, no interest in leaving Sausalito and want to remain or age in place for as long as they want to be there. And as long as they can, I think that's that's what we all aspire to and I think that that's very important to consider here. Um, I think, again, based on the fact that this is heightened design review, part of what this gets kicked into. does have to do with abuse. And if we really look at what the findings are, we can't meet them all. Um, if we're just being, you know, very letter of the law in specific about what we're doing here. My concern about this particular project is that we have so many recent precedents where we have not approved something like this on other sites for the same height and design review criteria. And so it's really, really important that this commission |
| 02:03:24.56 | Unknown | really nipples. |
| 02:03:27.67 | Kristina Feller | you know, apply our ordinances in municipal codes equally and fairly to everybody. There's always unique and extreme circumstances on different sites because let's face it, Sausalito doesn't have... to the same type of sites anywhere in our in our town limits. But in this particular case, I don't think I could make the finding. Again, I'm very supportive of this project. In principle, I know this needs to be done. I don't think that the solution we have is something that I could endorse at this time. and happy to be very specific about that. I don't have a problem that it's not ideal that we don't have the tree permit But it is not a deal breaker. We can get around that. I don't like to hold things up just because of that. We can get around that. |
| 02:04:15.91 | Alex Frankel | THE FAMILY. |
| 02:04:21.14 | Kristina Feller | Um, But I really feel as though there needs to be some further consideration and sensitivity put to that roof line more than anything. of the garage. and some consideration of the material. We've also not had one discussion or presentation or representation of what some of that lighting is those are part of the requirements of what this commission looks for Like it or not, that's part of what this package and application should have included. and We need to just be fair and equal to everybody that way. So I think that we're not quite there yet. And I think it's important Um, you know, for the success of this project, even though I would probably not support approving it tonight, but I would certainly approve moving it forward with the principles in mind here, |
| 02:05:19.11 | Alex Frankel | Moving in. |
| 02:05:23.24 | Kristina Feller | for maybe a date certain to come back with, you know, tying up all these loose ends and some of our feedback to the design of this garage in particular. |
| 02:05:34.63 | Mary Wagner | the |
| 02:05:34.80 | Kristina Feller | Yeah. |
| 02:05:34.82 | Mary Wagner | . |
| 02:05:34.85 | Kristina Feller | Thank you. |
| 02:05:34.97 | Mary Wagner | Thank you. |
| 02:05:34.99 | Kristina Feller | sort of where I'm falling on this and I do not mean to frustrate the applicant but we |
| 02:05:35.06 | Mary Wagner | of what it was. |
| 02:05:40.69 | Kristina Feller | We do have ordinances and municipal codes for a reason and heightened design review findings combined. for a reason and i think that we need to Um, be the stewards of those. |
| 02:05:57.11 | Kristina Feller | So I would make a motion to continue this. project. |
| 02:06:05.35 | Nastassya Saad | I'd second that motion. |
| 02:06:10.71 | Kristina Feller | All right, so that's one open active. motion that we need to take a vote on. Are there any other motions at this time? |
| 02:06:22.54 | Richard Graef | I would just like to add for the sake of discussion that We didn't touch on it, but the other parts of the project Um, the addition down below the deck to the bathroom, in that area. um, with that all. fine to me. really sensible. Um, the Curiously, the sound. of the proposed bounce. is gonna, from the street, pretty much hide that house because it's down below grade for the most part. And really there's not much opportunity to see the house and the garage even in contact with each other. |
| 02:07:02.87 | Alex Frankel | Thank you. |
| 02:07:07.02 | Richard Graef | So, I just point that out as a fact. But I think I agree with Chair Feller that This garage needs a little massaging. I do see lighting here in the drawings. indicated. All right. Bye. far as I know all that. not absent. but, um, Anyway, yeah, the materials and everything are all, and the colors, all of that all looks good. I just think that garage needs |
| 02:07:36.69 | Alex Frankel | Anyway. |
| 02:07:44.99 | Unknown | Mmm. |
| 02:07:45.74 | Richard Graef | He needs to be kicked around a little bit. I would support Amash and through. the Martian too well. continue. |
| 02:07:54.73 | Kristina Feller | Okay. thank you for that before we call role on this for the benefit of the applicant I want to also be very clear, we're going to ask the applicant to come back up here to confirm what we're saying and to ensure that they fully understand what we are saying and what our comments are. WE CAN HELP THEM MOVE THIS ALONG SO THEY CAN START THE WORK THAT WE KNOW NEEDS BE DONE HERE. I'm not sure. but the issue the issue with materials, not so much the materials that they have ISSUED, BUT IT'S THE TRANSPARENCY AND you know, an effort to maintain existing views from the street. That's part of what heightened design review, whether someone likes it or not, that is part of what We are here to uphold and enforce, we do need to think about that. And we can give examples of where we have acquired this. Most recently, probably up on Marion, We required it there. Similar situation. That's a reference point, Principal Planner Thompson, that we can use. So we're looking for that. WE'LL LEAVE THE ROOF LINE There's some consistent comment on that, maybe not by everybody, but some consistency with the issue of the roofline. and like height and bulk of that if there's a way to to lower it, minimize it, slope it differently. |
| 02:09:36.67 | Alex Frankel | MINIMUM. |
| 02:09:40.16 | Kristina Feller | The dormers have come into question. We're not here to design this from the dais or design it for you, but you're hearing our input and slight discomfort with that. I think we want to make sure THE FAMILY, THE FAMILY, THE that if we're going to continue this, it'd be great if we could just get the permit in there for the tree. Again, I don't think that that's a deal breaker, but it would be nice to wrap this up in a bow and make it nice and neat and make sure the Lemkes can get on their way with doing the work, because we know what's there is deficient. So, Um, Did I miss anything? Um, from the comments in order for us to give some direction and input more concisely to the applicant. |
| 02:10:35.47 | Jeffery Luxenberg | Can I just ask a question, principal, planner, and company? |
| 02:10:37.91 | Unknown | Thank you. |
| 02:10:41.03 | Jeffery Luxenberg | Yeah. If they were to submit to this tree permit, does that have to be re-noticed? If we continue this, can that just be added in, or does that have to be of a separate truck? |
| 02:10:54.26 | Rozalynne Thompson | Commissioner Luxenberg that's a great question because typically when an item is continued date certain it doesn't have to be renoticed but because we have a trio mobile permit in consideration the question I have for the city attorney is do we have to renotice Do we have to notice just the tree mobile permit? or do we have to re-notice the whole project, including the tree removal permit? |
| 02:11:20.45 | Director Scobel | If I may jump in and our city attorney can jump in if I answer this incorrectly, but we would need to re notice for the tree permit. But since we are re noticing for the tree permit, it would make sense to actually notice the entire scope of the project. but I will defer this to our city attorney. |
| 02:11:37.90 | Mary Wagner | I think that the practical advice is the right advice. I mean, even if technically we don't have to, because you continue this to a date certain tonight, I think it might be confusing to neighbors to just get a tree permit notice and not have all the other items included. It doesn't cost more, I don't believe, for the city to include the entirety of the, the public hearing items. But if you want, we can talk about that a little further. But I concur with the community development director that just doing it all in one fell swoop makes the most sense. |
| 02:12:07.92 | Kristina Feller | Yeah, I don't think we want this kicked back just for some technicality that would not be fair to the applicant. Let's make sure that we're thorough and get this right this time. so we're not inadvertently putting a strain on them. I'm not sure. by our misactions. Okay. Good question, Commissioner Luxembourg, and thank you. Director Scoble and our city attorney, Mary Wagner. any other Um... additions to to what I've laid out here. I think it's a summary of what everyone said, but correct me if I'm wrong. Okay. So, um... and would we have a date certain available on our calendar or a couple available so when we ask the applicant to come back here to confirm Um, their understanding of what we're doing, that we have a couple dates that we can go over for them to make sure that they could get the work done in those times and we're not holding them up. |
| 02:13:20.44 | Director Scobel | Chair Feller, you ask a very good question. As you will see on our agenda, our next business item is to actually discuss the proposed 2022 calendar. If you would like, I can pull up the draft calendar dates and you can preliminarily look at them. But typically, we do follow the first and third Wednesday of the month in terms of our thinking day. |
| 02:13:46.32 | Kristina Feller | Right, exactly. And so we would want to... THE END OF GO OVER THAT WITH THE APPLICANT WHEN WE PULL THEM UP HERE. SO THAT WOULD BE... What's our next one? It's the 20. |
| 02:13:58.91 | Director Scobel | The 26th of January would be our next regularly scheduled meeting. That would be the fourth Wednesday, but this is just an anomaly due to the way the holidays fell. But then the next meeting after that, would be the February 2nd and then February 16th. |
| 02:14:19.33 | Kristina Feller | Okay, I'm just writing those down. Okay, thank you so much, Director Slobel. So could I ask, Mr. Hartley and Mr. and Mrs. Lembke to maybe unmute and come back and join us just so BEFORE WE TAKE A ROLL CALL HERE, WE WANT TO MAKE SURE THAT YOU'RE AMENABLE TO WHAT we've sort of laid out as the next course of action here. and that you're agreeable to a continuance. The other options obviously is a denial, but we're hoping that we don't wanna do that |
| 02:15:02.16 | Kristina Feller | So, You've listened to some of our comments and some of the input. And I want to, first of all, make sure that um, that they're clear to you that that there's no misunderstanding with with what our comments are to you and are important. |
| 02:15:23.82 | Roger Hartley | I'd like to get some clarity on that. |
| 02:15:25.92 | Kristina Feller | Okay. |
| 02:15:27.74 | Roger Hartley | Well, I'm not sure what you mean by transparency. I've got a neighborhood graphic here that I've prepared, and if I could just share that. If you're talking about |
| 02:15:45.07 | Roger Hartley | because it's disabled. Mm-hmm. Can I share a screen? |
| 02:15:50.15 | Kristina Feller | You can. You're co-hosted. |
| 02:15:55.58 | Roger Hartley | OK, can you see that? |
| 02:15:58.94 | Kristina Feller | We see that. |
| 02:16:00.17 | Roger Hartley | Okay, so in terms of transparency, if you're talking about the... space between structures, not the structure itself. First of all, Ms. Back is factually wrong. These are |
| 02:16:15.60 | Kristina Feller | Mr. Hartley, we're not here to debate that. We've already have an active motion now. We just want to make sure THAT SORT OF THE COMMENTS THAT WE ARE GIVING BACK AND ARE our active motion here to continue the project that some of the input that we collectively provided that that input's clear and that there's no misinterpretation of what we're thinking or what we're looking for, so it enables you to sort of make some tweaks and |
| 02:16:48.59 | Roger Hartley | Can you tell me what you mean by transparency? |
| 02:16:51.12 | Kristina Feller | Yes, and there is precedent in this that we can also share with you, because that's also public record and they're good examples. is when we're in a heightened design review, situation, which is heightened because it's beyond just a normal design review process. which tend to go very smoothly. There are additional criteria that are required. And part of that are the preservation of views. And in this particular case, the view from the street over or through the property is a preserved view. And so this garage which is proposed to be what I'll just call, let's say, solid, you know, a solid structure. does block some of that view. So what we're looking for in terms of transparent is the ability to look through it, even if it's an enclosed structure, there would be more glass or more ability to see through it and preserve that view. That is what is meant by that. |
| 02:18:04.42 | Roger Hartley | Are you suggesting a glass door? |
| 02:18:06.85 | Kristina Feller | I'm not designing this for you. No, I'm not suggesting that. I'm suggesting that the materials, that you choose materials, that would preserve the view. If that's glass, then that's glass. |
| 02:18:19.00 | Roger Hartley | I'm at a loss to know what to do with that. We could make it smaller, of course, but we can't get two cars in it. This is a 14-foot wide garage door, and you can't get two cars in if you have a smaller door than that. |
| 02:18:31.96 | Kristina Feller | Again, we're not here to sort of debate that or design it for you. |
| 02:18:32.00 | Roger Hartley | Again, |
| 02:18:37.92 | Kristina Feller | Certainly, I think I could speak for everyone, as everyone has said, we all support the need for this project. We're not against or opposed to the project in principle. But there are certain requirements that need to be met with this design because it's a heightened design review that actually have not been met. And so we cannot make the findings that are required to be made. So one of those is that the issue of view preservation, transparency, through a structure. |
| 02:19:12.45 | Roger Hartley | If we took the roof down and made it flat, does that meet your qualification? |
| 02:19:19.81 | Kristina Feller | Thank you. |
| 02:19:19.84 | Roger Hartley | You wouldn't be able to see through it, but it would be lower. |
| 02:19:23.80 | Kristina Feller | Well, if you're an average person on the street, enjoying the view, If you have a flat roof on top of it, I would question that the roof would be taller than me or you or somebody else. But again, we're not here to sort of design you know, from the dais. Well, that is not what we're here to do. We're trying to provide you the input on the criteria |
| 02:19:46.60 | Nicole Back | THE END OF |
| 02:19:51.48 | Kristina Feller | that's required to make the findings, and the findings cannot be made. |
| 02:19:55.92 | Roger Hartley | I think you've given us impossible criteria. We can't make it less wide, we can't make it less high. The other alternative is a carport, I guess, not a garage. Well, again, as I've |
| 02:20:07.04 | Kristina Feller | Well, again, as I... As I stated before, there is precedent here in Sausalito. And the one that I recall most recently and forgive me, I cannot remember the address, but is up on Marion. we're happy to follow up and get you that address. Yes, I like this. |
| 02:20:25.18 | Roger Hartley | The President. |
| 02:20:26.78 | Kristina Feller | I believe it's the Reynolds property, Director Scoble and Principal Planner Thompson. is a great example of that. of how they, um, address that. and there are others. Again, I'm not here to debate |
| 02:20:39.56 | Wendy Jawor | and there are, |
| 02:20:45.38 | Kristina Feller | some of this. And we don't make up the municipal codes. We're here to administer them. So those, these are some of our comments. We do think some of the bulk of the roofline is not necessarily in keeping with I'm not sure. sort of the scale of what the actual property represents as it is viewed. from the street and I think Vice Chair Graff made a good comment that Most of that beautiful property is not going to be Um, viewable from the street anyway because of the fence, which of course we completely understand why we want that. So we are making a motion to continue we can do that to a date certain or to a date uncertain. I just wanna make sure that our input to you is clear SO THAT you know, the next time we SEE THIS, THAT, UM, you know, these criteria are satisfied. and that this can be approved. We understand why this needs to be approved. but it can't be approved in its current form. |
| 02:22:02.89 | Richard Dotter | Are these comments going to be written down anywhere? Are we supposed to remember them and hope that we address them all? |
| 02:22:09.08 | Suzanne Liffey | But you're sending anything to us as a follow-up. |
| 02:22:09.30 | Richard Dotter | Thank you. |
| 02:22:09.31 | Kristina Feller | Oh, yeah. |
| 02:22:09.53 | Richard Dotter | THE END OF THE END OF THE |
| 02:22:12.18 | Kristina Feller | Thank you. |
| 02:22:12.30 | Suzanne Liffey | I'll be right back. |
| 02:22:12.35 | Kristina Feller | I'll defer to staff on that. This is a public hearing, so everything is recorded right now and you would be able to review it, but I'll defer to staff We're not always privy to some of the communications they have directly with applicants. So I apologize for that. But perhaps Director Scoble or Principal Planner Thompson |
| 02:22:21.41 | Alex Frankel | Thank you. |
| 02:22:21.50 | Unknown | AND I'M GOING TO BE |
| 02:22:21.70 | Alex Frankel | Thank you. |
| 02:22:32.11 | Kristina Feller | address that. |
| 02:22:36.06 | Director Scobel | Principal Planner Thompson, would you like to jump in or would you like me to jump in? |
| 02:22:39.60 | Rozalynne Thompson | Um... I'll have some initial comments. So yeah, we can definitely work with the applicants on the feedback that has been given tonight by the Planning Commission. Thank you. |
| 02:22:57.24 | Director Scobel | And if I can weigh in as well, it's common practice for the planners to be paying close attention to this item and we'll relook at this meeting and come up with a list of all the comments and notes to help facilitate any type of redesign. |
| 02:23:14.75 | Kristina Feller | Thank you. And so what we can do is when we finalize our motion here, we can amend our motion to what we call a date certain |
| 02:23:25.25 | Unknown | Thank you. |
| 02:23:25.45 | Kristina Feller | or date uncertain. And what that means is, if you think, perhaps I would be probably Mr. Hartley, this will take you two weeks or what have you to get some revisions back to the planners and this can be re-noticed then we can walk into a date cert which is one of our dates If you can't, then we can make it a date uncertain and then You'll just work with planning staff and it'll get agendized when there's availability on the calendar. We don't want to put undue pressure or dictate to you when you have to come back to us. That should be you. |
| 02:24:00.28 | Alex Frankel | We don't want to. |
| 02:24:07.12 | Kristina Feller | telling us or indicating to us what is preferable to you. |
| 02:24:12.23 | Roger Hartley | Can you tell me what the deadline for submittal would be for the February 3rd meeting? |
| 02:24:17.92 | Kristina Feller | So we tentatively have February 2nd. And Director Scoble, could you advise what the cutoff date is for resubmission. |
| 02:24:29.24 | Director Scobel | Yes, in looking at the calendar, we would, so the packet gets published on the 27th, and we would need time for staff to work on this, So we would need information by next Tuesday, which wouldn't really give you a lot of time. So my recommendation is that we would target the February 16th seating. and that would give you time to submit information to staff on January 24th to review. |
| 02:25:02.33 | Roger Hartley | Okay, we can do that. |
| 02:25:04.97 | Andrew Junius | And does that give us enough time to notice the tree issue as well? |
| 02:25:08.73 | Roger Hartley | Thank you. |
| 02:25:08.80 | Andrew Junius | Yes. |
| 02:25:10.52 | Kristina Feller | Perfect. Okay, so it sounds like a date certain of February 16th. Okay, great. Um, Thank you very much for confirming your understanding of this in a date, And, um, Obviously we all recognize this might not be exactly what you want to hear, but I think we're all supportive of you getting a project done. Let's get it done right. I'm sure it will with the care and sensitivity given it so far. so um thank you for that so if i can bring this back up to the virtual dais we have a a motion and a second And I would only ask to amend the motion to a date certain of February 16th. you And if I could ask Director Scoble to please take a roll call. |
| 02:26:06.53 | Jeffery Luxenberg | Commissioner Saad? Yes. Commissioner Luxenberg. |
| 02:26:13.97 | Jeffery Luxenberg | Yes. |
| 02:26:15.74 | Director Scobel | Commissioner Junius. |
| 02:26:17.39 | Jeffery Luxenberg | Yeah. |
| 02:26:18.71 | Director Scobel | Vice Chair Graff. I'm not sure. Chair Feller. Thank you. |
| 02:26:22.41 | Kristina Feller | Yes. |
| 02:26:22.96 | Director Scobel | Thank you. Motion carries unanimously. |
| 02:26:26.05 | Kristina Feller | Great. Thank you very much, and thank you to the Lemkes and Mr. Hart. Bye. for working with us on this. Okay, let's go ahead and move on to item seven of our agenda, which is new business. |
| 02:26:40.63 | Director Scobel | So the first and only business item that we have on our agenda this evening is to discuss the Planning Commission's 2022 calendar. Before I start, would you like me to pull up the proposed draft calendar as I discuss the dates, or do you want me to just identify um, what we've identified as potential conflicts for consideration. |
| 02:27:01.99 | Kristina Feller | Well, let's go ahead and pull it up. We'll go through where the conflicts are. |
| 02:27:05.47 | Director Scobel | Okay, perfect. |
| 02:27:09.67 | Director Scobel | Can you see my screen? |
| 02:27:10.48 | Jeffery Luxenberg | I'm sorry. Yes. |
| 02:27:12.03 | Director Scobel | Okay, great. So as you can see, because of the holiday season, we are meeting on the second and fourth Wednesday of the month. However, historically, the Planning Commission meetings are on the first and third Wednesdays of the month. So this proposed calendar follows that. This calendar has also been updated to show what the city council meeting dates are as well. So there are no conflicts in January, and this next February month, shows the proposed dates as well. I wanna point out that the week of the 21st is typically a winter ski break for the schools. But it doesn't appear as though there would be a conflict with the Planning Commission here. there would not be any conflicts with regards to the March dates. And the conflicts that I'm also raising have to do with potential national holidays or religious holidays. The first item or potential conflict that staff has identified would be the first meeting in April, April 6th. This is during the spring break where most schools are closed. So I don't know, staff is wondering if you want to move the meeting to the 13th so that there would be no school conflicts or keep the meeting date as is. Okay. |
| 02:28:38.45 | Kristina Feller | April 6, I'll write that down. |
| 02:28:41.42 | Director Scobel | Thanks. |
| 02:28:41.86 | Jeffery Luxenberg | Chair Faller, can we just do these as they raise them? It'd just be easier than going back. |
| 02:28:47.97 | Unknown | Sure. Thank you. |
| 02:28:49.45 | Jeffery Luxenberg | Absolutely. |
| 02:28:49.47 | Unknown | Absolutely. |
| 02:28:50.87 | Jeffery Luxenberg | Can you scroll back a little bit? The 6th is one, two, three weeks after the one in March. So my thought on this one was just to leave it and see what the agenda is happening unless somebody has a reason that they want to move this. And then maybe we don't need it, maybe we do need it, but having one on the 13th and then one on the 20th. a little bit tight. Um... Um, Plus you're gonna have to, the planning staff's gonna have to do with that some people might be gone. Anyways, I thought maybe we'd leave this one. It was just my thought. I don't have a strong opinion. |
| 02:29:38.07 | Kristina Feller | So you're in favor of leaving April 6th as is? |
| 02:29:41.53 | Jeffery Luxenberg | Yeah. |
| 02:29:42.37 | Kristina Feller | Okay. you Um... COMMISSIONER SAID, ARE YOU ABLE TO |
| 02:29:47.96 | Nastassya Saad | I'm totally fine. Yeah, I really don't have an opinion either way. It doesn't affect me. So we can leave it on the 6th. |
| 02:29:54.88 | Kristina Feller | Okay. Commissioner Junius. That's fine. Okay. and vice chair graph. I'm fine. Okay, fine with me as well. Let's keep going. Thank you. |
| 02:30:05.14 | Director Scobel | So then the next potential conflict staff has identified would be July 6th. So this is two days after the 4th of July holiday. This seems to be a week where a lot of people are out of town. And so staff is interested in knowing if the commission would like to keep this date or to move it possibly to June 29th. or the 13th of July. |
| 02:30:35.87 | Kristina Feller | So just real quick, Heidi, we're on recess in August. Correct. |
| 02:30:41.71 | Director Scobel | That is correct. |
| 02:30:42.74 | Kristina Feller | Yeah. |
| 02:30:45.17 | Director Scobel | Well, that's actually a question that I was going to bring up tonight too, to see if you would like to stay on recess since there's... |
| 02:30:51.16 | Kristina Feller | We're going to stay on recess in August for sure. There's no meetings in August. |
| 02:30:57.33 | Andrew Junius | I would find with moving it to that last month's end. |
| 02:30:57.42 | Director Scobel | Bye. |
| 02:30:57.43 | Kristina Feller | Bye. |
| 02:30:57.62 | Director Scobel | Bye. |
| 02:30:57.65 | Kristina Feller | Thank you. |
| 02:30:57.79 | Director Scobel | Bye. |
| 02:30:57.87 | Kristina Feller | Thank you. |
| 02:30:58.06 | Unknown | Yeah. |
| 02:30:58.08 | Kristina Feller | Yeah. |
| 02:30:58.34 | Director Scobel | Thank you. |
| 02:31:00.34 | Kristina Feller | What Commissioner Junius? |
| 02:31:01.94 | Andrew Junius | I'd be fine with moving it to that. If you want to keep the meeting the 29th of June seems fine with me. |
| 02:31:06.90 | Kristina Feller | Okay, so 29th of June and then July 20th or July 13th? |
| 02:31:13.33 | Andrew Junius | It doesn't matter. I totally agree though that week after the fourth is kind of a dead week, I think we have trouble. |
| 02:31:14.31 | Kristina Feller | Thank you. |
| 02:31:18.46 | Kristina Feller | Okay. |
| 02:31:18.59 | Andrew Junius | Thank you. Thank you. Thank you. |
| 02:31:20.11 | Kristina Feller | Okay. Commissioner Luxembourg? |
| 02:31:22.86 | Jeffery Luxenberg | Yeah, let me throw this out. I would suggest given that we're not going to meet in August, why don't we move it to the 13th and the 27th? in that way You know, and then if there's all of a sudden we have lots and lots of applications, we can always add a meeting on June 2nd. Right. I'm thinking this will space them out a little bit better, make it easier to spend. |
| 02:31:49.41 | Andrew Junius | I'm fine with that. |
| 02:31:50.84 | Kristina Feller | Commissioner Saad? |
| 02:31:51.67 | Nastassya Saad | Me too. That works. |
| 02:31:53.97 | Kristina Feller | Okay, so we're talking JUNE 1ST, JUNE 15TH. JUNE 29TH. Correct. |
| 02:32:01.20 | Andrew Junius | No. No, I don't. |
| 02:32:01.75 | Jeffery Luxenberg | Thank you. Thank you. |
| 02:32:02.18 | Kristina Feller | Thank you. |
| 02:32:02.67 | Andrew Junius | Thank you. |
| 02:32:02.71 | Jeffery Luxenberg | Thank you. |
| 02:32:02.91 | Andrew Junius | Thank you. |
| 02:32:02.98 | Jeffery Luxenberg | Thank you. |
| 02:32:03.58 | Andrew Junius | July 13th and July 27th. Thank you. |
| 02:32:05.56 | Kristina Feller | Okay. |
| 02:32:06.00 | Andrew Junius | Thank you. |
| 02:32:06.45 | Jeffery Luxenberg | June 1st, June 15th, July 13th, and July 27th, and no meetings in our office. |
| 02:32:13.34 | Kristina Feller | I'm fine with that. |
| 02:32:18.33 | Director Scobel | I agree. So one thing that the council sometimes considers is that because there's going to be one, two, three, four, five, six weeks between the last planning commission. Well, actually it would be five weeks between the planning commission last meeting in July and September. Are you okay with that five week period? Sometimes the council likes to meet the last. week of the month. |
| 02:32:48.52 | Kristina Feller | I mean, I would say you you know I wouldn't meet before Labor Day is my is my gut that's pretty much tradition Okay. You know, the one thing that we have not spoken about yet on this calendar, which we'll need to after we finish going through each of the months, is some of the joint meetings that we should be having that were |
| 02:32:58.28 | Unknown | Okay. |
| 02:33:10.90 | Kristina Feller | completely, you know, ignored last year. So I think we have to, it appears that we have some wiggle room should we need to add those. but I would keep August in recess. |
| 02:33:20.77 | Director Scobel | Bye. OK, great. I just wanted to double, double check. |
| 02:33:26.00 | Kristina Feller | Is everyone on board with that? |
| 02:33:28.87 | Director Scobel | Totally. |
| 02:33:29.70 | Kristina Feller | Okay. |
| 02:33:31.15 | Director Scobel | Great, thank you. I'm not trying to add extra work, I promise. you |
| 02:33:34.98 | Kristina Feller | I know. |
| 02:33:35.32 | Andrew Junius | I think we get to December, I've got ideas. that's it. |
| 02:33:37.46 | Kristina Feller | One more time. Oh yeah, you'll beat me to it. Okay. September. |
| 02:33:43.26 | Director Scobel | Okay, so the staff hasn't identified any potential conflicts. Does the planning commission have any conflicts? |
| 02:33:46.30 | Jeffery Luxenberg | . |
| 02:33:52.43 | Kristina Feller | I don't believe so, but I'd like to hear from my colleagues. Commissioner Junius? |
| 02:33:58.69 | Andrew Junius | Yeah, I think it's really funny. Thank you. |
| 02:34:08.92 | Andrew Junius | THE END OF THE END OF THE at the media. you straightforward to me. I'm okay with that. |
| 02:34:14.36 | Director Scobel | Okay. Right. So October is, October 5th would be your next meeting date or first meeting in October. So that's on the calendar, the end of Yom Kippur. And I'm not quite sure if this is a holiday that the Planning Commission would like to observe there. It may affect residents participating in any type of public meeting. |
| 02:34:38.56 | Kristina Feller | Oh, absolutely. We should always be sensitive to those things, regardless of denomination. We have not traditionally done that in the past. Um, but I certainly, that doesn't mean that it should be precedent going forward. Does anyone have a strong thought about that? |
| 02:34:59.78 | Jeffery Luxenberg | I don't particularly celebrate that holiday, but I would suggest remove it for 12 and twice a year. It's just because if the public is concerned about it and somebody's upset about it, you just create a conflict that doesn't need to happen. You can simply just move, you know, shift immediately. |
| 02:35:18.64 | Kristina Feller | I'm fine with that. |
| 02:35:20.67 | Jeffery Luxenberg | Bye. |
| 02:35:21.02 | Jeffery Luxenberg | Thank you. |
| 02:35:22.54 | Director Scobel | Thank you. |
| 02:35:22.59 | Kristina Feller | I'm sure. |
| 02:35:22.62 | Director Scobel | THE END OF THE END OF THE you Thank you. |
| 02:35:23.40 | Unknown | Okay. |
| 02:35:23.87 | Director Scobel | 12 and 26. And I'd like you all to know that staff looked at all religious holidays and national holidays when we were reviewing this. And so these were just the ones that had the potential conflict. And then November is pretty straightforward. the second and the sixteenth. And there does not appear to be any conflicts with the Thanksgiving holiday. |
| 02:35:45.29 | Unknown | Thank you. |
| 02:35:45.39 | Nicole Back | Thank you. |
| 02:35:49.41 | Director Scobel | And then the other potential conflict would be December 21st. That's just a few days before our Christmas holiday and just wanting to check in to see if you wanted to either and remove that meeting in its entirety and just have one meeting similar to what the city council does, or if you wanna move it up to the 14th. |
| 02:36:11.60 | Kristina Feller | Commissioner Junius, so I'm gonna let you |
| 02:36:13.79 | Andrew Junius | very much be in favor of following the city council's lead and having one meeting in December and taking a break at the end of the year. |
| 02:36:21.94 | Kristina Feller | I would move, yeah, I would not, I'm not in favor of the 21st at all. If we are really pressed and we need more meetings, I would rather schedule November 30th and have to cancel it, which we did do in the fall. this past fall. and then maybe do the 30th and then the 14th instead of maybe the 7th or something. but definitely get rid of the 21st. What do you think, Commissioner Saad? |
| 02:36:53.89 | Nastassya Saad | I... I think that that makes sense. It would probably be nice to schedule one more in November at the off channel. pre-end of year. let people have a hearing if they need it and cancel if needed. be on board with that. So that would be the 2nd, 16th, 30th, and then you said the 7th? |
| 02:37:14.98 | Kristina Feller | So that would |
| 02:37:19.03 | Kristina Feller | the seventh or even move it to the 14th. |
| 02:37:20.63 | Nastassya Saad | Or the 14th? |
| 02:37:21.49 | Kristina Feller | Thank you. Yeah. |
| 02:37:22.03 | Nastassya Saad | Yeah. Thank you. Thank you. Yeah, I think a break probably to the 14th would make sense if we do add it the 30th. |
| 02:37:27.79 | Kristina Feller | Yeah. Commissioner Luxenberg, what do you think? |
| 02:37:31.36 | Nastassya Saad | Thank you. |
| 02:37:31.38 | Jeffery Luxenberg | Uh... |
| 02:37:32.23 | Nastassya Saad | Thank you. |
| 02:37:32.24 | Jeffery Luxenberg | Well, I have a question. I would have left it on the 7th, canceled the 20th, take out the 21st, left it on the 7th. But then what is it, if we don't have one scheduled, and we have a huge back wall. We can just schedule special meetings, right? At any point, we just have to do it with enough notes, right? We don't have to do this a year or a half in advance, do we? |
| 02:37:58.80 | Kristina Feller | Well, it's nice to publish publish, I mean, We do as a commission publish our annual calendar of regular scheduled meetings. We have in the past canceled regular schedule meeting. If there is not enough on our agenda, to warrant a meeting. Um... I do want to point out and just raise it to the attention of you guys. Like we've got a lot going on this year, particularly towards the end of the year. regarding the housing element. and things of that kind that will require Um, you know, noticed meetings to the Planning Commission to weigh in as a body instead of just two representatives to the committee, as well as many other initiatives that we either have ongoing or haven't even you know. happened yet. or come to fruition yet. Again, I would really rather have it on the calendar and have to cancel it than not have it there at all. |
| 02:39:07.82 | Jeffery Luxenberg | Yeah, I don't have an issue with that. The issue I have with November 30th is the practical reality. We're going to get a packet either on November 23rd maybe or November 26th, but maybe not, for that meeting. And so we have to review that packet for that meeting over Thanksgiving, which is not logical or rational. So that's the only issue I have with that. If we're having a meeting on the 30th to where we don't have any hearings and we're getting an update on the housing element or getting a presentation, then that's fine. But if we're going to get a big packet the day before Thanksgiving, I can catch a prayer. So that's my only problem. |
| 02:39:53.37 | Kristina Feller | Vice Chair Graff, what are your thoughts about that? |
| 02:39:57.81 | Richard Graef | Well, that makes sense to me. I don't think I'd want to be having to review over the Thanksgiving. We can. of Thank you. But, um, |
| 02:40:17.78 | Richard Graef | Well, let's see, we're leaving it right now. We've got December 7. And at 30th. November. |
| 02:40:29.12 | Kristina Feller | I MEAN, |
| 02:40:29.75 | Richard Graef | Well, I think if November 30 could be a little bit more of an administrative type of meeting, I think that'd be great. after it's loaded with |
| 02:40:41.58 | Unknown | Thank you. |
| 02:40:41.60 | Richard Graef | Thank you. |
| 02:40:41.61 | Unknown | I'm sorry. |
| 02:40:41.66 | Richard Graef | projects would not be such a great day. |
| 02:40:41.87 | Unknown | Thank you. |
| 02:40:45.14 | Kristina Feller | Okay. COMMISSIONER GINIUS, ANY THINKS? |
| 02:40:48.50 | Andrew Junius | I'm fine either way. I understand the issues. I mean, I do support your general idea that it's much easier to cancel me Thank you. Thank you. |
| 02:41:03.97 | Andrew Junius | Yeah. I don't need a hole. |
| 02:41:05.29 | Richard Graef | Thank you. |
| 02:41:05.34 | Andrew Junius | Thank you. |
| 02:41:06.10 | Richard Graef | for the most part. No, I'm okay with it. |
| 02:41:09.68 | Kristina Feller | So let's go ahead and leave it like what you have here, Director Scoble. And again, We can always cancel or amend as we go. Sorry. |
| 02:41:20.24 | Jeffery Luxenberg | I'm going to go. Thank you. Let me ask this question. |
| 02:41:22.94 | Kristina Feller | I thought it was going to be the 30th |
| 02:41:25.08 | Jeffery Luxenberg | 30. |
| 02:41:26.21 | Kristina Feller | special hearings either. |
| 02:41:26.60 | Jeffery Luxenberg | I'm hearing. Can I ask this question? I thought that if we had the 30th, we'd move to the summit of the 40th. |
| 02:41:36.49 | Kristina Feller | Yes, that's what we discussed. |
| 02:41:38.31 | Richard Graef | Yeah, we were there. |
| 02:41:38.53 | Kristina Feller | Okay. |
| 02:41:40.78 | Richard Graef | That's fine. |
| 02:41:42.04 | Kristina Feller | So... So again, back to what I was saying, director of Skobal is... We don't have any special meetings yet on this calendar. And if you could provide some insight, because this is something we've been talking about for now a full year. We haven't gotten any traction on that. So I would say we should be concerned. |
| 02:42:08.30 | Director Scobel | So before I answer that question, I'll just jump back to the meeting on the 30th. What staff can do, to mitigate any potential concern the commissioners may have if we do need to have that November 30th meeting is we could commit to publishing the packet the week of November 14th, so basically November 17th So, um, It means we'll have back-to-back packets, but we have enough time to plan in advance so we can get that information out in advance of that, well in advance of that meeting and before Thanksgiving, so you don't have to worry about that. Regarding the special meetings, we have a new mayor, and with that new mayor comes new agenda-setting opportunities. And at the... upcoming agenda setting meetings as I and winding down my interim positions, I'll be resuming my city clerk position, and I can bring this up at agenda setting and try to get something on the calendar, or just identify some potential meeting dates where there could be joint meetings between the planning commission and the city council, and then I can bring that back to principal planner Thompson for your agenda setting, And then we can work with the commission in terms of adding those special meeting dates to the calendar. |
| 02:43:27.00 | Unknown | Thank you. |
| 02:43:27.04 | Director Scobel | Okay. Would that work for you? Sure. And then I'll also work with principal planner Thompson to integrate at this. housing element committee meeting dates on this as well, and any other potential meeting, boards, committees, or commissions that may be impact, or may impact the planning commission meetings, or may result in special meetings. So at least you'll have a good understanding, one visual diagram of what that, what the calendar looks like. |
| 02:43:59.89 | Kristina Feller | Terrific. |
| 02:44:00.40 | Jeffery Luxenberg | Thank you. |
| 02:44:00.74 | Kristina Feller | That would be really helpful. |
| 02:44:04.28 | Director Scobel | that we can do that for you. Well, great, this was super successful. I really appreciate you taking the time to go through this. Let me, actually, for whatever reason, my share screen, my Zoom screen is really super wonky. Are you still seeing the calendar? |
| 02:44:26.07 | Kristina Feller | Thank you. |
| 02:44:26.59 | Director Scobel | Okay, I'm going to stop my share screen. |
| 02:44:26.69 | Kristina Feller | OK. |
| 02:44:29.71 | Director Scobel | We got that taken care of. I think it started moving on my white screen. I'm like, where is everything? So thank you for your patience with that. |
| 02:44:37.88 | Nastassya Saad | May I ask a question? |
| 02:44:37.91 | Director Scobel | Yeah. |
| 02:44:40.33 | Nastassya Saad | Sure. You're winding down what is happening. |
| 02:44:40.36 | Director Scobel | Sure. |
| 02:44:44.31 | Nastassya Saad | in terms of a director. |
| 02:44:46.45 | Director Scobel | Thank you. |
| 02:44:47.09 | Jeffery Luxenberg | I'm sorry. |
| 02:44:47.14 | Director Scobel | Bye. |
| 02:44:47.16 | Jeffery Luxenberg | No. |
| 02:44:47.18 | Director Scobel | Bye. I'm going to go. Bye. |
| 02:44:48.63 | Jeffery Luxenberg | Bye. |
| 02:44:48.65 | Director Scobel | THE END OF THE END OF THE |
| 02:44:48.71 | Jeffery Luxenberg | now since I'm |
| 02:44:49.41 | Director Scobel | been made yet, so I'm just keeping on. I anticipate that my duties and responsibilities will end at the end of January. And that's kind of been the plan ever since I assumed this interim position as well. I haven't heard anything other than terminating at the end of January. Happy to stay on and help in any capacity. and But if not, it's been such a pleasure to work with the Planning Commission, and thank you so much for that opportunity. And I'll still be working for the city, so. |
| 02:45:21.96 | Nastassya Saad | Bye. Wonderful. Yeah, it's just so much. It's been great having you. I mean, not to say goodbye yet, but it's been awesome having you. Yeah, thank you so much. |
| 02:45:29.52 | Director Scobel | Thank you. |
| 02:45:29.65 | Kristina Feller | Thank you so much. You brought on Roslyn as well, because that's another brush of breath and fresh breath. |
| 02:45:38.53 | Director Scobel | You're in good hands, says Roslyn, or Rachel Planner Compton. |
| 02:45:44.60 | Jeffery Luxenberg | Great, so that concludes our discussion on the calendar. So the next item is adjournment. Okay. |
| 02:45:51.81 | Kristina Feller | Do I have a motion? |
| 02:45:53.56 | Unknown | I'm adjourned. |
| 02:45:54.59 | Kristina Feller | All in favor? I've |
| 02:45:56.23 | Unknown | Aye. |
| 02:45:56.97 | Nastassya Saad | All right. |
| 02:45:58.63 | Kristina Feller | Nice to see you guys. |
| 02:45:58.68 | Nastassya Saad | Nice to see you guys. Thank you so much. Have a good night. |
| 02:46:02.36 | Jeffery Luxenberg | Thank you. |
| 02:46:02.39 | Kristina Feller | Thank you. back here. |
| 02:46:03.44 | Jeffery Luxenberg | here. Bye-bye. |
Wendy Jawor — In Favor: Resident of 228 Glenn Drive, Ms. Jawor supported the project, citing the deteriorating carport's unsightly and unsafe condition. She believed the new structure would improve neighborhood aesthetics and not change views. She noted that one car must park on the street due to the carport's poor state, reducing parking availability. ▶ 📄
Scott Jampol — In Favor: Neighbor at 244 Glenn Drive, Mr. Jampol strongly supported the applicants, describing them as considerate neighbors. He disputed Ms. Back's characterization, noting his own enclosed garage is similarly setback. He argued the project would not impact views, would improve the street's appearance, and that the current carport is unsafe. He urged approval. ▶ 📄
