PUBLIC HEARING REGARDING SENATE BILL 9, THE CALIFORNIA HOME ACT IMPLEMENTING ORDINANCE 📄
The item was called after ex parte communication declarations. Staff recommended continuing the hearing to April 20th. Chair Feller moved to continue to May 4th to allow more time for commission input 📄. She also appointed Commissioner Luxenberg and Vice Chair Junius as a planning commission working group to collaborate with staff on the SB 9 ordinance, which they accepted 📄. City Attorney Wagner confirmed the working group formation did not require a vote and noted no council legislative committee meeting was scheduled. The commission then voted to continue the item to May 4th 📄.

38 Alexander (Tree Removal Permit) 📄
The item was a continued hearing from March 2 for a tree removal permit at 38 Alexander for one 16-inch diameter cook pine tree located on a steep rear slope. Staff planner Adam East presented updated arborist report (March 9) by Dr. Kent, which concluded the tree's root system is failing due to vigorous growth, shallow soil over bedrock, and slope instability, making it a high-risk failure threatening the walkway and retaining wall 📄. The arborist recommended removal without on-site replacement due to soil conditions. Commissioner Luxenberg, who had visited the site, confirmed cracking walkway and tree leaning out of the slope 📄, 📄. The applicant's godmother and arborist Dr. Kent explained the tree's unnatural lean and landslide risk 📄. All commissioners agreed the removal was necessary and that no replacement could be planted on the steep site, instead requiring contribution to the city's tree fund. I am not seeing any, so at this time, I will close public comment and move on to our next item, which is communications. So Heidi, I'll go ahead and hand that over to you.
00:03:18.58 Heidi Thank you. At the last planning commission meeting, the planning commission asked staff to return with three announcements. One was regarding the Valhalla project. So as you know, this is a project that has been under construction and going through the entitlement process since around 2012. And the project is almost ready to be completed. There's just two outstanding items that are remaining one would be the final map the tentative map parcel map was approved as part of this project and they're just going through the last little motions to get that map to the city council for approval and one of the other items that the applicant is still working through relates to a condition of approval that required a ADA access ramp to go down to Swedes Beach and the property owner has been working diligently with the CDC or the San Francisco Bay Conservation and Development Commission to get that ramp entitled and during this process the San Francisco Bay Conservation and Development Commission is slightly rethinking what it previously required and in the meantime the Saucyau de Marin City Sanitary District also has concerns regarding the ramp because it would be constructed over some primary infrastructure related to their pumping station and so so the applicant slash owner is working with DCDC and the Saucy city sanitary district to come up with an alternative. And that alternative will be placed on the May 4th planning commission agenda for consideration as to an amendment to the originally approved condition of approval. So the project cannot be finaled until that condition of approval is addressed and remedied. So, um, so the project cannot be finaled until, um, that condition of approval is addressed and remedied. Um, so that's, um, that does any of the, as a planning commissioners have a followup questions regarding that update

I think we're just eager to get some resolution on on the matter so appreciate the update and um your work with the applicants. So thank you.
00:05:33.56 Heidi Yeah, and one of the other outstanding items which has finally been resolved was the bus turnout. And the owner was going back and forth for a while and that turnout has actually been installed.

which is great.

So the Planning Commission also asked for an update regarding the project at 654 Saucelito Boulevard. That was a project that went through an entitlement process and no building permit applications have been submitted as of late. So there's nothing to report on that.

And the last item was regarding a code enforcement update. And as you know, the city has been contracting out or outsourcing its code enforcement duties and responsibilities to CSG. The city has had a handful of different code enforcement officers. And the city is fortunate to have a new code enforcement officer. His name is Quentin. And he comes in with a lot of experience in code enforcement and that's actually has been able to jump in quickly he's working with our permit tracking system to actually update it on the back end so that we can actually have good reporting associated with it he's gone in identified that we have 106 outstanding code enforcement cases the lion's share of the code enforcement cases have to do with unpermitted work and short-term rentals and since he's been here starting the middle of march he's been able to close out eight project or eight code enforcement cases and resolve them and he's close to resolving five other cases and And he did identify that he's available to return to a future planning commission meeting and provide a more formal update on code enforcement.

I think that would be great to actually elevate the issue of enforcement by having the enforcement officer certainly come and provide greater detail to some of the issues. It certainly helps inform this commission and I'm sure others as well. So let's get that on a spring agenda and focus on that.

So as soon as we are informed as to how OptiCoast is moving ahead, Um, We will move ahead.

And I had one other item. I thought it was interesting, just so the commission knows that SB9 is on the calendar tonight and we'll be working through that the next month or so.

Um, But it's interesting, a couple of cities have actually taken the state to court over SB9.

and the state of the state. The state of the state of the state, the state of the state, So we'll be tracking those pretty carefully. That's an interesting development.

Um, And then the HEAC, the Housing Element Advisory Committee, which I sit on with Commissioner Saad, who was not with us this evening, we did have our last hearing on March 28th, Monday, March 28th.

At that time, we did discuss the site selection. It is not complete yet.

We've also issued two surveys and a mailer to all residents and interested parties and businesses here in Sausalito I do hope that everybody has taken that survey. If you have not, we would ask you to do so. If you did not receive a mailer, the information is also in Sausalito Currents.

and the community development department can be contacted for that information it is on The links to the surveys are on the website.

So all of that information is out there. And we ask that everybody take those surveys by April 15th.

and the importance of those surveys is pretty paramount to what the housing element is doing.

And this is the time to get critical public community input. It really does matter. It really does shape the discussion.

And it does determine exactly what the proposal is to the state. So please take those seriously. Please help us put together the housing element submission that is required by the state. It's a huge number.

We appealed this decision. We still have the number 724 units.

So it's pretty significant and it's going to really impact Sausalito. And we want to make sure that that's as soft an impact as possible. So your voice and your input is really needed.

The next hearing is on April 19th.

And that information also is on the website and we will continue to promote that meeting to make sure that everybody in our community is present or participates in some way, please do send us written comment.

Don't wait for a meeting. There's no need to wait for a meeting. You can send us written comments anytime you would like.

And if you have any trouble at all, please contact the Community Development Department, and they will be very happy to help you and delighted that we're getting engagement from the public.

um, We have about two more months to finalize the site assessment, so your input's critical. The environmental impact report and CEQA will start based on the site assessment and site selection. We are selecting a larger amount of sites than we might need knowing that the probability of some of those falling off through the environmental impact report.

I also did view 110 4th Street from multiple vantage points, including a backyard, which I had to go through part of the house at 411 Main Street with the owner of that property, but I did not have any expert communications in any of those cases as well.

And this request is a tree removal permit application at 38 Alexander. It is for the removal of one cook pine tree, which is located towards the rear of the property out facing towards the bay. You can see it circled here on the graphic. And again, this project background, the request was first heard at the March 2nd meeting where the planning commission moved to continue the agenda item date certain to the April 6th meeting.

This allowed the applicant to provide a supplemental arborist report with additional information about the condition of the tree.

So certified arborist Dr. Julen provided that updated report March 9th.

00:22:43.82 Adam East And that report was included in your staff report as attachment two. In addition, the original arborist report was included as attachment five as well.

So this is a little bit of information about the tree as a refresher. It is a 16-inch diameter of breast height tree that qualifies it as a heritage tree per the ordinance. It is located on the downhill slope at the rear of the home, which is facing towards the bay. And at the last meeting, it was pointed out that it is starting to affect the structural integrity of the walkway. So these are a bit of the findings from the updated arborist report dated March 9th. So the arborist goes on to identify that the cook pine exhibit signs of root system failure and the tree is likely to fail.

And he knows there is a shifting of the trees position on the steep slope. And it's actually due to the increased mass due to vigorous growth. So ironically, it's the health of the tree that's causing the root system failure.

He goes on to further describe the conditions of the soil, noting that it's actually quite a shallow soil on bedrock.

And he goes on to explain, all of these factors that can affect the condition of the soil and the root stability. So it's the combination of these factors that make this tree a high-risk failure, including high winds and storms, the shallow soil, the increased mass of the tree due to the vigorous growth.

Um, and decreased friction due to soil saturation.

So he concludes his report by stating again that this tree is a high risk failure and should be removed as soon as possible.

to prevent property damage. He also states that the tree is actually causing soil instability rather than soil stability. And that removal of the tree will improve the soil conditions on site and will also allow a condition or an environment where the other plants on site will benefit from the reduced competition for water, nutrients, and sunlight.

So the arborist does recommend removal of this tree.

These are some additional photos that I took on site. Commissioner Luxenberg mentioned that we did meet on site with the owners. So I just took these for additional context as to the conditions on site. So you can see the photo in the middle. The tree is located on a very steep slope right here towards the base of the retaining wall.

and does point out towards the bay.

So although the tree, if it were to fall, would fall out towards the bay, it's that soil erosion that would contribute to or cause structural issues to the walkway and the retaining wall. And that would result in property damage.

So again, we included staff analysis on the findings in that staff report.

we conclude that we do recommend approval for this tree removal in accordance with that staff report and in accordance with the findings of the updated arborist report dated March 9th.

And the additional arborist report provided clarification that although the tree is healthy, it's causing some issues with the root system of the tree and that's a combination of factors with the soil conditions on site the steepness of the slope the vigorous growth of the tree which is adding mass at the top of the tree which is again putting strain on those roots so i think those were the additional clarifying points that were provided in this updated report that might not have been specifically addressed in that original report.

And the arborist is in attendance on the meeting tonight as well. I should clarify.

I appreciate the opportunity to talk about this tree some more. And I'm glad it's more clear this time that this tree is actually is failing as a result of I uh, being in these shallow soils on a steep hill.

Um, cook pines naturally lean.

I think that was brought up at the last meeting that I did not attend, but I heard that, um, There is a point that they normally lean. Yes, they do normally lean towards the equator.

in the northern hemisphere they lean to the south so the lower part of this tree actually leans to the north and that's as a result of the tree moving down the hill.

And then it does naturally curve back to the south.

in the Northern Hemisphere do.

So I think there was some confusion about that.

Um, The cracks in the walkway are pretty evident and they get wider as you walk toward the And I worry that the tree will tumble and, you know, take more soil with it than is necessary.

I also did not recommend replacing the tree with another tree, you know, out of fear that we'll repeat this mistake.
00:31:58.48 Dr. Kent Um, that's, that's a, if there are any questions about the report or, you know, I realize it's counterintuitive that a tree can actually make, slopes less stable, but that's It's been well documented and it's with lots of research on avalanche paths up in Pacific Northwest. So we have a shallow soil, you have a heavy object on that soil, whether it's a tree or it can actually create a landslide by additional loading.

So whenever I see something like this, I get a little bit concerned, especially because there are houses directly above this tree.

So we don't want to create an unstable slope.

The walkway is clearly shifting and cracked from appears to be from the tree and also whatever is under the walkway. The tree appears to be in a very steep slope it appears to be coming out of the slope. It doesn't even appear to be coming out of the ground. And so it does seem like it could eventually fail. And it's not, it doesn't seem like an appropriate place for a tree. And as I did on the last one over on Second Street, I like to save trees where we possibly can. but this one seems like the arbor, you know, I'm not an arborist, so I have to trust the arborist's report that says that, you know, it is not the best place for a tree and it could fail and therefore it could cause damage. If it were to fail, as Adam says, it would fall into the water. So it's probably not gonna hit a building, but I can see where, given how the tree is coming out of the slope I could see where it could pull with it and cause a slide so again I concurring with the arborist report for what I saw in person.

So I just wanted to identify that procedurally there was a noticing error associated with this agenda item this evening. It actually started at the January 26th meeting and staff did not catch it until today. So essentially what was happening is that although the notice and the agenda is accurate, there's information in the notice that identifies this item as a study session. And despite the item being continued to a date certain from the January 26th meeting, it stated in the body of that original January notice that staff would re-notice it. And since we have not done this, staff is recommending that the planning commission conducts a public hearing this evening, take public comment, direct staff to prepare the necessary noticing, but continue this item to a date certain April 20th, staff would re-notice the item. The project is for the renovation and expansion of the existing 1,431 square foot single family residence, the renovation of the existing carport.

and the construction of a new 1,795 square foot single family dwelling and was reviewed at a study session on March 3rd, 2021.

And on January 26, 2022, The commission reviewed the project and considered comments from residents regarding concerns over loss of views.

of the Bay and the commission determined that additional information was required to more thoroughly review the project.

Pursuant to commission comments, working with the chief engineer, city of Sausalito, The applicant submitted a culvert plan showing the location of the existing culvert demonstrating the culvert runs east-west along the subject North property line.

TO CLEAN OUT on 4th street is approximately 100 feet from Main Street.

The clean out on Third Street is approximately 30 feet from Main Street.

Included in the ordinance, it is important to mention the term view does not mean an unobstructed panorama of all or any of the above.

The project as proposed meets the required general plan CD 3.1 policy in that some minor views Some minor loss of view may be consistent with the policy if necessary to protect property rights And the applicant has modified the project by reducing the height of the structure twice to address new concerns.

The project also meets design review findings in that the project is consistent with the general scale of structures in the area.

The project has been designed to minimize obstruction of views and primary views from private property by reducing the height of the structure.

and will not result in a prominent building profile.

Further, the proposed structure is substantially lower than the adjacent multi-unit building to the south.

lower than the adjacent building to the north.

And although the front roof line has been reduced to 14 feet above finished grade, residents across the street may experience minor loss of views of the bay.

I've seen in the submitted photos.

The larger view obstruction, the fig tree at the front of the property would be removed, which may effectively increase the view area to residents across the street and a condition of approval has been added to ensure the fig tree is removed and no trees would be planted within the front yard.

I am concerned, and since this is being continued, you can rectify this. It was very difficult. The first sheet of the project plan show a 3D elevation that is not consistent. have a view that is not the bare old roof that we see. And that was the only drawing that we have. So you appear to have a bunch of 3D renderings that we don't have.

And so if you could rectify that for the next meeting and in the future meetings, if you get 3D renderings, we would like to see those renderings because those are very, very helpful in understanding the project.

Um, If you could go back to that 4.0, I was gonna save this for the applicants, but if you could go back to that drawing, I'm just gonna mention it here, and you don't need to respond because we'll have the applicant, but the numbers on the right side in the bubble for the elevation of the floor of the study, which you can't really read because it's so tiny, but the floor of the study and the roof are are higher than the ones from the previous plan so contrary to what you're saying which is they've reduced the height they've actually increased the height so uh i and they they've increased the interior height of the study and given that the view issue is such a major factor the question for the applicant's going to be why don't you just reduce the height of that study and lower the roof rather than increase the roof. So, but so I just put that on the table at the moment.

And then for you, Cecilia, if you could tell us, what is the status? I mean, we could put all the conditions in the world to remove this fig tree.

AND THE APPLICANT HAD TOLD the neighbors, they would remove it, and now they're holding off removing it.

If you could tell us doesn't it need a permit from Public Works and have they processed that permit is my question.
00:59:35.08 Cecilia Jaroslavsky It's my understanding that it does need a permit. It's not been processed. And it's also my understanding that the applicants are willing to remove the tree and are going to remove the tree and the condition of approval.

Is it the 3D rendering?

What exactly is the project that's being proposed?
01:02:30.75 Cecilia Jaroslavsky The project before you is what's being proposed. It may look a little bit inconsistent in that some of the pages had to be swapped out because several of the pages really did not change. For example, the floor plan for the front structure did not change.

So there were the areas that needed modification were updated. And so we had to modify the PDF to submit to you.

but there is a condition of approval that the applicant will have to submit a full set of plans date stamped.

you know, all date stamp the same date and it all has to comply.
01:03:09.89 Kristina Feller I understand that and that's all well and good. But typically when the commission takes an action, we actually have to have consistent drawings. So you can't wait till you pull a building permit to do that.

obviously there are modifications, but We just want to understand what it is exactly in front of us tonight, which, which version it is.

to have done that because it actually helps clarify exactly what the view impact would be.

Was that something that you discussed with the applicant before this evening?
01:04:30.87 Cecilia Jaroslavsky It was my understanding, we did talk about the tree and it's my understanding that the applicant doesn't have any issue with removing the tree.

Um, And then I'm curious about Um, I know that DPW has also looked at this. Is there any, anything in our conditions of approval that have to be considered for any potential protections of that culvert. So it does not actually collapse on itself through vibration of demolition, new construction or anything like that. I just want to make sure that We're getting this as far along as we possibly can this evening.
01:05:26.02 Cecilia Jaroslavsky I believe that the applicant did meet with the chief engineer and they talked about the condition and protection of the culverts, so I will let him address that.

And then there is a, um, Beautiful.

And we had asked previously about protection of that tree since it is a heritage tree defined by Sausalito, and it looks to be getting worse. Can you maybe just touch on that real quick?

01:06:00.20 Cecilia Jaroslavsky Is this the tree that is right alongside 411 Main Street, the rear of that property?

It's a very large tree down there.
01:06:09.42 Kristina Feller Yeah, I believe it's on the applicant's property, but correct me, certainly correct me here if I'm wrong. I don't want to misstate that.
01:06:16.74 Cecilia Jaroslavsky Yeah, it looks like it's right on the edge and it's quite large. And I think everybody is very interested in keeping that tree.
01:06:26.33 Kristina Feller Well, so I guess I'll go back to my question about this particular applicant. I can't discuss other members of the community that aren't in front of us this evening, but how much of the health of that tree CAN BE assisted by any protections with any work that is being done on this site that we need to think about?
01:06:53.55 Cecilia Jaroslavsky I guess he could talk to an arborist to see about protecting that tree during construction.

And I do believe that there are protections involved So.

The applicant to the best of my knowledge wants to retain that tree and it's looking to protect the tree. But that's something that he probably should answer.

And we were interested in any projections through any of the roofs for chimneys, for vents, for anything like that.

We haven't seen any of that, even though we've asked for it and, and I would find it unusual that a home would not have one or two, even if they've got less traditional design to it.

And this here so they don't have much that's actually located on the route.

The parcel slopes uphill to the west at an average slope of about 25 degrees.

The primary structure is situated at the rear of the lot.

The previously approved project is currently under construction.

No additional changes to the previously approved project are proposed.

The total length of the detached garage would be increased from 22 feet, five inches to 39 feet, five inches.

The roof design and height would be modified by eliminating the turret-like feature centrally located on the roof and installing a flat roof with the deck above.

reducing the height from 14 feet 5 inches to 12 foot 10 inches, including the roof railing.

The roof deck above would be 21 feet 10 inches by 23 feet 8 inches.

First of all, I want to thank a bunch of people.

This has been a really hard process because we've been lacking planners in Sausalito. So it's been through three planners. Thank Heidi and thank you, Cecilia for picking this up. So appreciative of the work you've done to pick this up after it's been lagging. A couple of questions that came up. Yes, part of it, Commissioner Graff is underground. ground. And I looked into it. A couple of questions that came up. Yes, part of it, Commissioner Graff, is underground. And I looked into, I went to Berkeley. They have a place that has native grasses. And there is some native grasses that we can put on the roof. And there is a species of lavender that is very shallow growing, that is drought resistant. I don't know if it's deer resistant, but.

and that back portion will be underground and have that surface to get to that area.

because it becomes level to the yard, you just walk out into the yard, then you're on top of the garage, the underground garage, then you're on the deck. So it's all sort of flat and flowing. And there's two other houses on the block that have a similar and we learned from them and I think they're supportive of this so I think that that will work out well. We did not go further than a hundred foot radius, Jeff Commissioner Luxembourg. So we went a hundred foot radius, the people who usually will have more visibility to this location.

This is my husband, John. He's the builder and he's there every day.

So any questions, any other questions and Alejandra? Did I miss anything? We are going lower.

There was a concern about light for the neighbor. So instead of a redwood fence on the portion that is underground, it'll be a cable, the cable type of system. So he has plenty of light in the, in the corridor between our two buildings, which we've never had before. The retaining wall was about two inches away from his back window.

so we could make a better use of the space and incorporate that into the yard as well.

I think having the planters above can help soften that progression from the street of what you see from the the face of a garage structure which is you know now a little bit closer but doesn't have that sort of dead driveway space in front of it to then the residents beyond So I think, yeah, I think that that was sort of the final point I kind of wanted to touch on. And then, of course, working with the neighbors to, you know, make this a solution that could work for everybody and make sure that all the previous concerns were still addressed in this new design.

Commissioner Graff had questions about the sight lines and the other things these were basically as we get to them these are guides for me to understand the views from the neighbors and to see how I needed to adjust the geometry of the building to accommodate and minimize and mitigate any impact of the views the uh let's see central or height limit so those are all going into this and I have to apologize for the discrepancies that have been apparent and the data points for elevations in the elevations. I can explain this very simply. I have a surveyor who did these presented these drawings to us originally.

because of his age, he's in the East Coast, he's not able to do this. He sent his assistant out to verify the lines and they use different benchmarks. Because they use different benchmarks, my intermediate dimensioning and SOIFL certification was based on another number. They're still all relatively the same number.

These have all been corrected now. They've all been reviewed on the current set of documentation. And I think the most true thing you could look at instead of looking at these elevation points here would be to see the building on the street see where it was previously with the story poles and realize the story poles have a move So the dimension points had moved on the drawings to come closer or exactly to the benchmark, which was there established originally by the original severity. He put all this data back into his survey and he gave that to me and then reviewed with me my data. So these drawings have been dialed in with all the data points on heights and elevations. And again, if you look from the street, we have popped the building up three or four feet. It's still the 18 inches at the red line which has now receded um to where things are now let me start in on the presentation so basically following the last meeting we have revised the design We have changed the height of the building at the front line of the roof.

In fact, when I show you the slides, I wanted to thank you all for putting pressure on our neighbors to allow us in because finally after two plus years I've been able to go in and document

01:59:41.14 Tim Rempel the amount of the view obstruction, which we will get to in the presentation to demonstrate, which would all be apparent to each of you, if you would go into our neighbors' homes, that we really are not obstructing their views with this design. What we started out with originally with a 30 inch raised to the building was lowered to an 18 inch. And then we changed the geometry here at the front of the roof. Again, all of these things were done to accommodate our neighbors. And yet when we've done all of this, this point, we still don't have their full agreement in this. So I just have to acknowledge that we're not gonna be able to agree fully. So I will go through quickly. Now in the presentation, I'm gonna zoom back up here So this drawing shows the most relevant building because there's no issue with the back building. The back building is out of everybody's view plane. So it's really the front building.

The building here on the left, East House, shows the drawing two on this sheet It shows the existing building.

with the new proposed roof line in red superimposed over that. Can you see that?

Yes, yes.

I don't know if that's how visible that is, but this is literally where the view has any impact is right here at the front of the building. Back here, we could probably go another four feet taller. You could go four feet high with this building. It wouldn't impact their views. What is impacting is here, and that's clear to see if you visit their sites and take the viewing angles. So we are literally here at this point. We've lowered this another six inches. So we are literally at two by six higher than our existing roof. That's the amount we have. We've lowered our building here in the front to. We did that by pushing our bridge line back.

The front of the building, we have gone into a curved design and we've lowered this by about six inches.

So we're now actually not even 14, we're about 13 feet, nine inches above the existing grade.

And this is the design of that that's fully visible. So we're at 83.6. At the view, this is 13 feet eight inch, eight and a half inches to the top of this. This allows us to do an eight foot ceiling inside the building, seven feet below. We're doing this also by lowering this grade by about six inches.

And these are the things we've done to accommodate the viewing angles after we have verified their views through photos. So I'm going to go through these quickly here.

Here's his street view.

The other side view, basically the same diagram, exists the presentation of the proposed elevation on the left drawing one and drawing two, the superposition of the roof line on the left over the existing building.

Drawing three is the back building. And on the back building, we dramatically change elevation three to remove windows and balcony on this facade facing our neighbor, Karen Shelton. And we've now have a high window above, actually above head height here. This is, this window up here is up in the trees. You can't even see it. And this small window here on the side is a minimal thing. And we've re-arranted the room. So it really looks towards the east.

And I will scroll ahead.

In the floor plan, it shows the changes. There's a very high window here on the left, low window there. And the living room we've oriented around the corner, again, towards the east and this northeast.

Here's a cross section. All of these numbers, all the section numbers here dial in to are consistent with the survey and the data we have now.

materials we got rid of the industrial metal that uh was criticized by the designer new board and so we're keeping the existing shingle and instead we're going to a cement plaster wall this is a warm brown grayish brown a grayish brown that's here this is a picture of similar material important place concrete for the base of the building

02:03:43.55 Tim Rempel And the idea of going to a sod roof here from a sod roof to a AstroTurf was one dealing with a water shortage. The idea that it's gonna be hard to maintain on a roof. My wife will talk about this a little later, but this was the highest quality artificial turf we could find. It's class A rated. We can use it on a roof. It is used on roofs and, I will leave that.

go through our renderings and we're very happy to share these with the planning commissioner we didn't know that these were not you can see on the left the car lift for the trellis this is a spruce tree it's not a pine that's here on the left side it actually sits 90 on our neighbor's property branches come onto ours we have every intention of protecting this tree it provides a wonderful privacy screen to our neighbors and we want to protect it and that our addition stays clear of the branches and that sort of thing. So we will do make every effort to keep this as healthy as possible because it's a tree we love.

you can see from here that the car lift allows some through views, but in reality from the street here, you really can't see anything but this street. You can't really see past it.

shows the carport, one car in the carport, one car here, and then the car lift, which drops down in second car below. I'll demonstrate how that works a little later.

Here's a closeup of the car lift. It has a raised bin on each side, the wheel well. And again, when it rises up, it allows you access the car below.

This is a picture of the rear house. The rear house from the street is a drop of about eight and a half feet.

You walk around the carport in the front, you walk along the straight path, to the rear door.

Commissioner Graff had a question about how the steps are accessed. The door down below on the lower yard takes you out to the small patio. And from there, there are steps down this side of the house to the exterior yard. Another rendering, another view showing the back house.

02:06:19.98 Tim Rempel We did quite a bit of neighborhood outreach. Our neighbors were very gracious and longed to come in. We photo documented before we took down the polls and after we put up the news story polls. We met with our neighbors on the street and we had good conversations with them. We didn't agree on everything, but we were very civil with one another. So we were very grateful that our neighbors have reciprocated and that was all good. But I want to go through the neighbors' views because the view issues seem to be a contention. There are four neighbors across the street. The first one directly across the street are the parks.

who have been opposed to our raising the roof level. But I wanna show you again, these are photos they gave us. We took them, we gave them back. So they have seen all of these photos. And these are done, I did these at 50 millimeter, which is normal eyesight. And then I did some zoom. So the photo above from the park balcony shows Zero obstruction.

This is from their lower living room level. From their upper level, obviously they're above this.

Here is the view at 100 millimeters.

The site line is blocked by building beyond and by green. So we're basically, we have minimized the roof This the building the front doesn't affect it. If that view angle the red dashed line is this view plane coming in. The parks have no view obstruction.

I'll go to the next building. I can go back to these if you'd like me to later. This is from the Murphy Quinn's.

This is their view. Obviously, when we get rid of the tree, they'll see the bay again.

But this is literally the view obstruction here. It is a two by six of height.

It's two by six, six inches. That's how much higher that is. That's what you're seeing there with that little bit of space.

Our study is actually to the side of their view. They have the same issues there. It's not something with blocks to view. It's the front of the building here, which is that six inch approximate obstruction.

Next I'll go to the DuFour's.

Now with the Dufour, Mr. Dufour, we did have a difference of opinion because he felt that his views from his yard, which is here, should be protected. This is in the middle of his yard, 20 feet in from the street, he felt he had a loss I'm sorry, I can't protect that view.

WITHOUT not changing my building at all, not doing an addition, not remodeling it.

However, from his entry, which is coming up the stair to his building on his living room level, you can see here there is zero obstruction. He has, again, here a two by six of height, Right here at the front, you can follow my cursor. In fact, the study doesn't affect this at all.

Another view here, this is the view obstruction. And I would say the DuPour's have the biggest view obstruction.

Consider this a view of obstruction here that shouldn't be there. That's the amount of it. And so I want this all to be really visible to the planning commissioners and you can visit this neighbors yourselves and see this for your own self, with your own eyes. Finally, the Mahoney Same thing, Mahoney side view on his porch. And he wanted me to take it from his porch from inside the house is even less of a view because he looks through his porch, but his view is actually mostly of the buildings across the street. But this is the sea level here. There's Angel Island beyond for the tree trunks and whatnot. And that's the view right there. We're getting six inches above the roof line. So finally, I'm gonna go through the issue of the culvert.

I talked to the city engineer. He felt that this map was probably might be off and it might actually follow this red line under our neighbors. Although it's been dashed in here, it's right along the property line. We'll do. I can't crawl down into the culvert. I'd like to track exactly where it is, but we don't know without cooperation with the engineering department. Our foundations are a good 10 feet away from this because we push our structural support for the building. I'll zip back up here.

our structural force for that building are they're pulled back from the building edge five feet.

And we'll be at least five or six feet off to the side with a helical piers. When we do this and we'll make every effort do not have any impact on this. And we'll do testing ahead of time to make sure there won't be any impact. We're very concerned with this as well. Obviously the culvert serves the entire neighborhood.

The car lift, you have questions about the car lift?

I did the first or we did the first car lifts which were put into Sausalito. They were at 88 Casano. They were done 13 years ago. They were perfectly functional when we installed them. They're perfectly functional today.

which we built again 13 years ago, perfectly functional. They're used all over the city and in East Bay and other places. This is how they work.

We've used it before. I've used it professionally, find it very suitable here. It actually is the only real way of getting parking on a tight site like ours to function properly. So I think it's a very innovative solution to providing housing in the city of Sausalito, which you want.

So I'm trying to find out if we can use this instead. I think it's a more attractive lift, but it just rises up straight and down. We don't need a trellis to hide the mechanism. And going to your point about relative nature, The previous plan showed a floor study elevation at 74 feet 10 inches and a maximum height of 83 feet 11 inches and the new plans are showing the floor uh of the the study floor at 74 inches nine inches so basically the same but showing the height at 84 uh feet four inches so in other words your study in the previous plan had a lower ceiling height than the current one does. And given that the biggest issue here appears to be blocking of the view, it would seem to me that this new design is bigger, it's currently bigger than the existing house. And that if you could have accommodated in the last set of plans, unless those were just wrong. I mean, you keep saying those plans are wrong and the previous plans are wrong.

but I don't get it given that this is the biggest issue and the front is clearly going up three or four feet from the existing house.

Um, further with a lighter weight roof, we're also going to be more efficient overall in the heating and keeping cooling of the home.

So I'm not sure where that came from. Tim was sharing some plans which are quite a bit different than the ones that were on the track hit.

He showed one illustrating a three-inch increase, and here he's showing it almost six-inch increase. You'll see that this is all deceptive because you have this peak here, which is a major source of view impacts.

So returning to my photos, this is the newest iteration. This is a simulation I did.

And this is actually a photo that Tim took at my house.

And this is the previous iteration of the design. So you can see there's not a substantial change At least not one that's 18 inches or any of it.

Um, Uh, And then this is the photo that Tim provided for his presentation just now. So you can see it's actually quite a substantial view impact for me. And I'll note that this is actually taken quite a bit further back than where he took his previous shot for the old iteration.

um i'll go ahead and stop sharing um you know i don't have that much more to say um i opposed to the view increase you know the one that affects me the most is the one at the rear of the house and you know we made a proposal that tim lowered at a certain amount i don't remember the exact number and we never really received a response on that um uh in terms of the fig tree i did all the legwork with lauren umbertus he said that if you remove the tree that just didn't encroach on permit um but here liz say that they're willing to trim it because you could trim it about for two hours with the pole trimmer and a lopper so that's great to hear um yeah you know we've had a ton of engagement on this project this is going on in 2017 this is at least my third meeting here um you know i think you guys have gotten the flavor of some of the frustrations that we've had on this project. I would really like it if the council person speak. is at least my third meeting here. I think you guys have gotten the flavor of some of the frustrations that we've had on this project. I would really like it if the council person could give clear guidance to the applicants. Ideally want to, you know, the concrete height reduction request and getting those numbers correct on the sheets. uh we took the tree out here's what here's what you would expect it to look like but the impact of the um the building and the structure particularly the study you can see it does have some impact here from our master bedroom this picture is taken uh with a 50 millimeter lens from our master bedroom uh we still do have impact in that area so as i said i do appreciate liz's um offer to bring the fig tree down so that we can really get a sense of what that is um and uh what once we see that we would like to have further conversations about what we could do with that uh with the study and with the rear end to just uh bring it down some more and let's see how that um you know, can help mitigate any view impacts.

I think the applicant really does need to get his drawings consistent with one another. If he can explain all these elevation numbers, that would be helpful. I think the height of the roof really does need you to come down a little bit.

I think that he talked about multiple types of lifts, some with concrete, some with metal. He really needs to decide what it is he's proposing to us because whatever we approve is what we approve. And I don't really want him to have to come back to us a year from now for a design change because he completely changed the lift.

in the whole thing that way. I think trimming the fig tree before our next meeting so we can better see the story polls is a great idea. I think him and her getting an application into Public Works for removal of that tree would be helpful because we can condition it, but if the Public Works doesn't approve it, then that's a problem. So it'd be good to get that to move along again i can't stress enough getting these drawings consistent because we keep seeing all sorts of different elevations and different drawings and also include in his package the what the what he's actually proposing for 3d elevations because uh we've seen multiple versions and the only one we saw this time was not what he's actually proposing for 3D elevations because we've seen multiple versions and the only one we saw this time was not what he was proposing. So anyways, I think those items can change, those items could get done before the next meeting, which would better inform what we could do at that meeting. At this point, it's even that much of an issue. It's pretty clear from the story polls If the story polls and all that are correct, that it's not too hard to determine what the view impact is.

I'm not able to negotiate a lot territory because of my disability.

and looked at it and frankly, I could see very little View impairment.

And I realized, I understand how you came to the solution for how that solution evolved but I'm not sure that architecturally it's really satisfying.

Um, I've got some frustrations myself. This is the third time that we've heard this project. The first was a study session, so we weren't gonna take any action anyway But you know, So many of the comments that we made in the study session are still you know, alive and kicking today.

I'm frustrated that we're not we're not maybe being listened to in terms of what what it is we're asking for what it is we require to make the findings And so I just think a little more cooperation on that level would go a long way.

I did listen to the January hearing again late this afternoon. And you know, the project sponsor did offer to trim that tree so that we could see the story polls better.

And, you know, that hasn't happened. So I'm a little bit frustrated that you know, things like that that are important, that can help neighbors understand view impacts and things like that can, you know, it's a useful thing to do.

Um, In the same light, at the last hearing, I was very clear in stating just what Vice Chair Julius mentioned. Nobody here in Sausalito is guaranteed zero impact to their views. It's just the fact of the matter. Nobody's immune to it.

And the definition for primary view corridors are really from your homes.

That being said, it's very clear that there are view impacts, but from certain primary views, but they're not, the views are not completely eliminated.

That's still very hard, I think, to quantify until we get that fig tree down.

to any kind of approval or flat out denial. It's not a good practice.

So even though we are not taking any action this evening I think the burden goes back to you, Cecilia, again. I mean, we can continue this to a date certain because of a procedural manner.
