2015 BRIDGEWAY - CONDITIONAL USE PERMIT AND DENSITY BONUS 📄
The item was introduced by Dan with an update that discrepancies were found between the plan set and staff report, including the number of affordable units and the project's SB 330 status. The applicant requested a continuance to June 15, but commissioners raised numerous issues. Commissioner Luxenberg 📄 highlighted errors in the staff report's interpretation of general plan land use policy, concerns about eliminating ground-floor commercial space, the unsuitability of first-floor affordable units due to lack of windows, requested concessions like side and rear yard setbacks, and the need for a complete analysis. members of the commission. And it was brought to the staff's attention about a project on 505 Johnson in which I sent I believe I sent code enforcement and building inspector out there. It was a job. It was a project that was approved.

for a major zoning permit and the building plan and, you know, the building permit, was also approved and they commenced construction, I believe in March.

but I will, Turn this over to Kenneth Henry, who has been out to the site a couple times.

and give you some feedback on what he saw and kind of where we're at.

00:05:15.51 Kenneth Henry Mr. Chair, I was able to make a few visits to the job site to determine the extent of the scope of the work. We have found that the plans do called for modifications to the roof system.

And the plans also show that there are no additional foundations being constructed for livable space. They do have an exterior patio.

that will be constructed and some decks that will move from one location to another.

Dan had sent me out, the director had sent me out to investigate the The scope of the work in accordance with the approved set of plans to ensure that they were building accordingly.

And my findings were that they are building per plan.

that was approved by the city of Sausalito.

Um, So that's what I know about the project. I did call the contractor to have a few conversations with them to understand and to ensure that my findings, as I shared with the director, were complete and accurate. And like I said, there is no, additional livable space being constructed on the outside.

And, um, there's some modifications to the roof. But what I understand through the contractor is that with the neighboring property to the uphill side, there was lots of communication about what would make both property owners amicably satisfied with Yeah.

the construction going on next door and then the construction and what the under construction is doing is that they are going to lower their system down to about 10 inches below where it currently is at.

and they're going to extend some dormers at the same elevation.

This made the neighbor behind the project on the uphill side.

quite pleased and he gave his approval to the 505 Johnson property owner because he was getting more of a view and from the neighboring property, that's a pretty pretty exciting view to get more of the marina shot, not so much just the landscape of Tiburon in the background, but actually to get some marinas.

That's what I understand about the project in my conversations with the builder and my review of the approved plans.

00:13:46.23 Nastassya Saad Sure, thank you, Chair Feiler. So our last housing element meeting was on May 23rd and our output was to finalize the opportunity sites. And we went through neighborhood by neighborhood, any site that needed more direction input, also discussing some preferences for mixed use or multifamily development.

and that was achieved at that meeting. Those sites are going to be included in the draft housing element. And over the course of the next two meetings, we're going to be reviewing the draft housing element. And that is where we will weave in our discussion for fair housing. So our agenda has changed slightly from a few meetings back. So I would encourage anyone to check out the virtual binder or go to the housing element advisory committee page on the city website. So you can see an updated schedule as well. The next meeting is going to be on the 27th of this month. And that's again, when we're going to start going over that draft housing element. And after all of our comments are taken into consideration, we will have a draft for public review, 30 day public review. So coming up pretty quickly, there are comments that continue to come in for the housing element and for opportunity sites as well. So any comments, any feedback that the community wants to continue to send, still reach us all at the HIAC at Saucelito.gov. And they're just being collated, so it's great to get public comment ahead of time.

And did I miss anything Chair Feller?
00:15:35.43 Kristina Feller The only thing I would add to that, and that's a great report out, is that these opportunity sites and our housing list is critical to start the EIR process, which is the Environmental Impact Report process.

I would encourage everybody to keep an eye out for that. That will be a parallel track to finalizing some of these sites. We are intentionally looking for a larger catchment area of sites to actually enter into the EIR process because we know that through the EIR, some of those might be discarded.

on the merits of environmental issues so i continue to be very impressed with the community involvement and everybody's sending their comments in i encourage you to please continue to do that it's so critical Your voice is making a difference in the process. As you hear in some of our discussions, we are eliminating or adding certain properties based on a lot of the community input. So it's very much appreciated and it's very much taken to heart. So thank you everybody for that.

00:17:04.92 Jeffery Luxenberg Sure. Thank you Chair Fowler. The Parkland Working Group made a presentation to the City Council on May 24th. It was well received by the City Council. We focused and made it clear, because there was some question, that it would be a ministerial process that was being recommended. The City Council did ask that a checklist be added to the proposed Parkland application.

00:17:29.47 Jeffery Luxenberg They also asked the working group to meet with the Chamber of Commerce, and that's in process being set up.

And they also asked that the staff look at each of the parklets that or established under the COVID emergency program to determine any modifications that might have to be made to those.

And then they also asked that for outdoor dining, that some sort of outline be established so that, when tables and chairs are moved around, that they stay and keep the sidewalks, basically that five foot minimum distance and sidewalks clear. So that process will be developed as part of this. So there's a little bit of follow up, but it all went pretty well, I think.

the willingness for the Chamber of Commerce to assist with a public outreach event.

is very helpful.

We're trying to work out what that date might be. And again, the working group is doing that on behalf of the city council.

And we, hopefully staff can assist with identifying the best time and date for that. And we expect that to be this month in June.

So for anybody listening in at home, we're hoping to get that information out to the public so your participation can be included.

And also thank you to Commissioner Graff for the incredible benchmarking process that went in before this report was put together, it definitely shaped, you know, how we looked at parklets for Sausalito and how it's appropriate to Sausalito. I just wanted to report out one other thing and I'll get to you, Vice Chair Junius, in just one moment.

But we will be hosting Southerman Fire District here at our public hearing in two weeks on June 15th.

We've asked them to come to certainly start a dialogue with the planning commission, but also to present to you, the public, about their new evacuation routes, any updates on their preferred planting programs and preferred species. And just we're coming into fire season, although I sometimes don't know that we're ever out of it, but certainly with the drought and the water restrictions that we're facing here in California and Northern California and Sausalito, it's best to always be prepared and keep that dialogue moving. So we will ensure that something is in the Sausalito currents for everybody, but mark your calendars. In two weeks, we will have Southern Wind Fire here.

to present to us and provide an opportunity for you to ask questions of them. So other than that Vice Chair Junius you had your hand raised.

I will attempt to make this brief. I want to focus on the tree case that you guys, that you highlighted in the previous meeting, that you wanted me to update you on. Pretty significant tree alteration case at the address of 75 Black Avenue. And I performed several site visits and an investigation, including speaking with finding the parties, It turns out there are several neighbors that were working together to achieve the result of more than 40 trees being severely altered. And essentially they were topped, the top half, the canopies of these trees were all removed.

Last week we had an arborist doing And, um, determine the extent of the work and the conditions of the trees and trying to identify where the other trees were located and the sizes of the trees.

And after measure the diameter to determine how it affects, how the code affects the tree. So, and also to determine whether these trees are, we need to know when we're applying the code to this case, to to determine the violation we do not only the size or the diameter of the trees at breast height but also what species tree and how many of each species and that the species will tell us if it's a protected tree or not And okay, so the result from the arborist, and I encourage you to read the arborist report is only three pages and also, that focuses on the trees in the public right away.

that were from the beginning of the public library. And then also read the one page letter for all of this regarding the trees to be altered in a private property.

So to summarize his, my results and also the, the, um, of these results.

The August Fundamentals was hired by the City Public Works Department.

And because of the nature of the case, it was determined that the city needed to do that. So, Thank you.

The arborist found 26 trees located in the public right of way.

you And then we both guessed that another 20 odd trees that were practically a private property The vast majority of the trees are black occasion, which is considered an undesirable tree And also the vast majority of these trees have a diameter, a breast height diameter of less than 10 inches.

So, and I'm sure you're gonna have a lot of questions about this, there are a lot of questions and it's a great learning opportunity in this case because it involves the public property and the private property, the sizes of the trees, undesirable trees.

Um, And also, and the the motive.

behind why the neighbors cut the trees.

So the history And then I'll try to wrap it up here I think I covered, so as far as code violation, if I wanna know that first, and then I'll tell you a little bit the history behind why they cut the trees.

AND I THINK THAT'S A So these trees are undesirable trees. The code violation is not that they cut them, top thing, basically cut off the top half.

it's that so many of these trees were in the public right away and that requires, if anybody wants to do anything in the public right away, You really need to contact the Public Works Department.

and get a permit to do that. And that also applies to these trees. So they cut 26 trees in the public library, whether they are undesirable or not, they needed a permit from the public library to do that.

So that's the potential code violations.

Um, And, um, as far as the history, behind, let me talk about the private property as well.

Since these are undesirable trees on the fire department that would cut those That's not a violation of COVID.

um, So there's some other questions that you have raised. When you look at our code, there are other impacts that even undesirable trees can provide benefits to the neighborhood, to the private property, residents or owners, such as windscreen, shade, neighborhood character.

So there's a lot of Sometimes the trees can block the headlights of passing cars. So there's a lot of reason why you might find benefit even with undesirable trees. And that's something that, we could discuss at a later date. But so the end result is they cut the trees down after interviewing property owners and residents. There's three properties, 72 Platt, .

which is uphill.

from the top of the trees we've cut and 66 flat. Both of those homes are uphill. And so those two homeowners along with the, the, the owner and resident of 75 flat were all in agreement to cut these trees on a regular basis. And it turns out these trees, after going back with old Google images and such, um, and interviewing the property owners, these trees have been cut routinely over several decades.

And I have recommended evidence that they were at least cut once in the last seven years or so. The same way, just completely the top half the trees were removed and probably about 40 odd trees were topped.

So that said, so that's the, it's a somewhat complicated situation. It's not like normally just have one person goes out, one responsible party goes out and cuts down a couple of trees, a couple of big trees. In this case, it's 40 trees that have been routinely cut in at the halfway point. And the trees are quite rugged, even with that severe alteration.

Thank you, Will. I think I'll just give you a very brief report on my other activity. This is for example, I'm just building a way to report a lot of information in this small space and I'm getting there. So, but I'll give you April and Mays will come soon after and I'm starting to get it down so it'll come quicker.

next time but in April for instance first just a reminder or if something you should know is that I work three days a week I could certainly have over 100 cases I could certainly work five days a week easily and still have you know still not covered everything I need to cover in that time but I do work three a week. So I try to focus on the most important cases, which is anything that's a health or safety, major health or safety hazard.

But at the same time, I do, if there's some low hanging fruit cases that I can close quickly, I will also, that maybe aren't as important, I'll also take care of those.

So, Yes, roughly over 100 cases in April, I opened 15 cases, closed 23 cases, and I did about 21 inspections, probably more. I'm working on the detailed activities like phone calls and inspections and meetings and such.

Trying to get that so I can just have that all in our tracking system. I can just push it back and it all comes out. A nice list.

And let's see what else, something I didn't talk about before is short term rentals, which represents a major part of my cases. And in the month of April, we had about 20, 22 letters go out notices to owners that we found evidence that they were, that they had an advertisement for short term rentals somewhere on the internet.

And the good news is about 13 of those owners Um...

responded and took down their ads.

And so they're complying now.

um, Several others were disputing whether they were actually advertising for less than 30 days.

and then about four more, no response. They're still advertising. So yeah, I can do it.

Anyway, that's good news. And that's typical of every month we send it out. We send out about that many letters and get that type of response.

uh so uh in the in regards to the staff report there was a mention of uh land use policy in the general plan i think it was 2.13 regarding neighborhood commercial uses and the staff report seems to imply that somehow this housing on the first floor of of this project which is not allowed by the zoning code is a is under land use. Whereas that land use policy is intended for, to provide, cause we have very few commercial neighborhood zones. The purpose of that section of the general plan was to ensure that we have enough retail commercial spaces. And so I understand that this project is being done for other purposes, but I think that that land use policy should be deleted from the staff report because it's just a wrong interpretation of that. And to that effort, there appears to be a number of concessions that this project is looking for, not the least of which is trying to eliminate commercial space on the first floor, which is only doesn't allow. And I think that's an issue. And then there was some discussion And this is where the confusion is of putting affordable units on the first floor they're all going to be on the first floor. Those spaces, which are supposed to be commercial, have virtually no windows. They're not a good place for apartments. And I think it's not in the city's best interest that the affordable units would be on the first floor at all. And if they are commercial spaces, one of the benefits of going down that road and keeping the zoning as it is, is at least the affordable units would have to be above the first floor. So that I think is something else that should be discussed with the project proponents. There are also side yard setbacks, rear yard setbacks. There's a whole bunch of concessions being looked for on the project, which I think are a little bit troubling. I realized that this is, they're allowed to get the density with the affordable units and they're allowed to get 12 units, but I want to flag that if they change two of the apartments on the upper level from two bedrooms to either one bedroom to a studio, they can still get 12 units above the first floor. So they don't need in order to maintain the density which they're allowed to do under uh under the section of the code that they're using for the state uh they can they can get that number of units but they don't have to take away the commercial spaces to do it or put affordable houses into the worst units so i want the those to be on the record for when that gets reviewed. There was also some concern I saw that the interim primary director sent out a revised uh things from marine fire i want to make sure that marine fire has been contacted has specifically contacted on the project which they appear to have done in the revised thing that was sent out but there is some discussion that the elevator needs to be able to be goingney accessible. I'm not sure the elevator that's shown on the plans is gurney accessible. Anyways, so those are just some of the issues. I flagged those because this was something where we keep advertising projects that don't seem to be ready. So I think that it's important that these issues be addressed and others that obviously will come out of any discussions and uh we need to get those those thorough analysis in the report for for the next meeting if it would be june 14th which seems a little bit quick but if it is able to get there so anyways at this point uh i called uh comments in case there are any public comments uh to reserve the right to give any additional comments after that but thank you chair

So I'm assuming that those setbacks will be explained as sort of legal non-conforming or something along those lines.

but I think it's really important that, you know, particularly when we get these kinds of applications, which are very important, you know, here in Sausalito, that we're also getting a complete application because I'm not sure that what we have is even deemed a complete application.

So I would really ask staff to focus on complete applications because what I see is not complete.

And I'm definitely happy to continue this to a date certain, but that date certain better be certain that it's a complete application before we hear it.

I mean for me Olive Street's a narrow street it's a dead end we have limited parking traditionally The people who work at the office buildings have parked on Olive Street because you cannot head north out of their parking lot.

Olive Street is a hard street to get onto from Ridgway because traffic is 35 miles an hour which really means 40 something in all fairness. People ride my bumper when I'm trying to turn. It's a blind turn.

because it's a sharp, It's a hill, there's vegetation, land, and you can't see.

So it's hard to get onto Olive Street. It's hard to get off of Olive Street because you have basically three lanes to navigate.

um, And bicycles.

Don't forget the bicycles.

I'm assuming Dude.

Because you know, the, the apartments asked saying that they're going to reduce from 21 to 18 parking places, but one of those is handicapped.

So if nobody in the units qualifies, that's really basically 17 spots only.

I'm assuming what's gonna happen is that the overflow parking is when all of the streets fall, which often is, is gonna go to the far side of Bridgeway.

We have no crosswalk.

for Olive Street.

The crosswalk to get across Bridgeway at spring is dangerous. It's super short.

And the people coming down spring have a green light and they turn onto you. They turn left and You're at their mercy.

So my question for everyone is what can we do to make, our intersection getting in and out of Olive Street, safer.

for both vehicle use.

And also getting across the street if we have to get to Park Tires on the far side of Bridgeway.

I know it sounds like I'm asking for a unicorn, but I would love a stoplight.

If it's under 3.30, I don't think it can have what's eventual on the first floor, but I don't know that for sure because I haven't had a chance to analyze that part of it. If it's under the number 9-5-6-5 that's another thing. And whether we call it a complete application or don't call it a complete application, basically before this comes before us, at whatever meeting we now decide, we need to know whether it's 3.30 or 6.5915. We need to know how many affordable units there are. We need to know where they are. We need to know what the deed restrictions are going to be. And we need a complete staff report. And so the applicant needs to update their drawings because they're clearly wrong. And let's go on Commissioner Junius's comments. Let's be real about this. In order for you to get something to us for the June 15th meeting, you need to send it out next Thursday or Friday. So you're gonna have a complete final staff report next Thursday or Friday. They haven't even revised their drawings. They don't even know what we've said tonight. They can go back and look at the tape and they can talk to you about that. But in order for them to get that to you and then for you to write a staff report and this to get on the June 15th date seems highly unlikely. And so my suggestion is we pick not the June 15th date because it just doesn't seem realistic.
