00:27:41.17 Dan Porter Okay, thank you, Chair Feller, members of the commission. So from community development department, they have interviewed, I believe three additional candidates for community development director, and they are in negotiations with one, of those interviewees as we speak.

So, I'll keep you posted as I learn more.

We do have a new administrative aide that has replaced Maria, who has gone to the police department.

Um, Her name is Natalie Rojas. She is on the call right now. We're not on, well, she is. She's in the background of the Zoom call.

For code enforcement, I didn't, have time to get our code enforcement officer here tonight, but I did get a report.

So I'll give you a report and then next planning commission meeting, we're, we're scheduling him to attend. So you'll get to meet him.

And he'll give you an update on some of the other issues that I don't mention tonight.

So, Basically, he started in June, he replaced Quentin, and started in June or July, I'm sorry. And when he started, there were 88 open code enforcement cases.

As of August 31st, there's 27 have been closed.

which leaves 61 cases remain open and under review.

A lot of these cases are construction without a permit and short-term rentals. So we're working diligently to really tackle those. And next meeting I'll have Eric, I talked to you about the short-term rental issue and, uh, um, and an update on the other items that I brought up tonight.

Sergio Rudin is on vacation now, so he will still continue to cover your meetings in the ordinary course and advise some of the bodies that I see on the, and some of the subcommittees that are coming out. 00:30:55.08 Kristina Feller We are up soon for another meeting. Bob Brown, who is our consultant working with us, who has drafted the objective design standards report is on vacation till the end of this month and we will meet with him upon his return.

In the meantime, OptiCoast is continuing on on the 3D renderings.

for the various different housing sites, and SB nine lots throughout the city.

That is really a collaboration being led by the objective design standards with the housing element advisory committee, which we will report out a little bit later here under subcommittees.

And at this point, we're gonna have to extend Bob's contract.

A lot of the coordination with the housing element has prolonged some of his work so he has provided an estimate which the city manager and the mayor has and will need to very soon upon Bob's return provide an update to the city council.

hopefully in October we can get that on the agenda.

So that's where we are on the objective design and development standards or odds as we refer to it.

Moving on, let's go ahead and hear from our California Housing Legislation Working Group and specifically AB 2011, which I think Vice Chair Junius, you will report out on and anything else again, Commissioner Luxenberg, you sit on this committee as well.
00:32:18.39 Andrew Junius Yes, thank you, Chair Feller. Yeah, that's the big news.

AB 2011 has passed out of our legislature in Sacramento. I think it's sitting on Governor Newsom's desk for signature.

I don't have any doubt that he's going to sign it, but we'll be closely following that.

AB 2011 is a pretty big move in the direction of continuing the state's effort to streamline housing projects. This one, you know, parallels SB 35.

in a lot of different ways. I think one of the key ways is if you could qualify for AB 2011 status, you are exempt from CEQA, which is one of the big, I think, barriers to a lot of development in urban areas.

So that's interesting.

There was a parallel union backed measure called SB6 that was also passed. I don't really expect SB6 to be used much.

because it has higher skilled workforce requirements. And AB 2011 has prevailing wage requirements, but not skilled workforce requirements. So that's, I think, a big difference. But the real key here is that it expands the ministerial and streamlined processing for eligible projects in commercial districts.

I'm focusing on parcels that are office retail and parking.

But it does have a lot of the safeguards that SB 35 had. We're not going to be demolishing rent controlled housing. Deed restricted affordable units are going to be protected.

Uh, historic resources are also Listed historic resources are off limits.

So, it's very similar in some respects to how sites and projects qualify under SB35, but there are different and frankly lower affordability requirements that I think are likely to open up some additional interest by market rate developers to or housing under this law. It does not come into effect until the middle of next year.

So I think there'll be some time for us to continue to digest it, but pretty exciting news in the world.

the it focuses on commercial areas and we only have a select number of those, so I'm not sure how much it's going to affect Sausalito. But it will have a big effect on the Bay Area region.

There's also, if you're interested in Bay Area housing news, it's not a shock that San Francisco is under the microscope one of the larger cities in the state that really is getting um, It's close scrutiny by HCD from a state level in terms of their housing production.

the pace at which the San Francisco Uh, City government is able to process entitlements and issue building permits has been a real problem.

HCD is taking a very, very close look.

And, you know, just like every other city in the state and specifically the Bay Area, they are under the gun just like we are on housing elements. So there's a lot going on.

The next six to 12 months are going to be fascinating to see what happens. So that's my report.

Moving on to the Ferry Landslide Working Group. This is a working group that Vice Eugenius and I sit on This is a newer working group.

Public Works Director Kevin McGowan has been working with a larger working group and Councilmember Sobieski on grant funding that was received to improve the land side land side.

improvements to our ferry landing here in Sausalito.

We did have a meeting last month. It was the first meeting that was called with the planning commission and the historic preservation commission represented at the meeting and we provided a little bit of feedback There are two additional meetings this week. One is a walk of the site.

on Thursday, tomorrow, and the other is a Zoom meeting for the working group I on Friday afternoon.

So we're really just getting started on this and hope to have more robust discussion when we can bring back more after we really get into it.

Moving on to the Housing Element Advisory Committee or HEAC as we refer to it as. Commissioner Saad and I sit on this subcommittee or committee, I should say. Commissioner Saad, would you like to report out on HEAC?
00:37:43.95 Nastassya Saad Sure, Chair Fowler. Thank you. So we had a town hall on September 1st. The community was invited to review the housing element process and to give an update on the We're currently in the 30 day review period, which we are taking public comment until September 16th. It's Friday at 5 p.m. DeNovo, our consulting group will then take all that comment and put that back in for our final review at our next meeting. I will say at this point, I am unsure when our next meeting is. I thought it was supposed to be scheduled for October, but we might be in a holding period right now while we determine when our next regularly scheduled HIAC session is. But we are looking to receive written comment in from the public to our HEAC email address. There's also printed copies if anybody needs them, if they go to the library or to City Hall, you can also pick up a printed version. It is a big document. There is also our virtual binder. So everything is also available in the virtual binder that you can find on the city website.

But at this point, we are definitely looking to get as much public feedback for our housing element. We are headed towards submitting to the state. So we're in our final crunch time and getting towards the end of the process. So this is definitely the time to to join us.

the The housing element and the numbers that HTD have handed down to us from the state impacts every single one of us, whether there's a housing development next to you or down the road or another part of Sausalito it's fairly significant, so it is really going to change the traffic patterns and circulation and impact to the day-to-day.

that we're all used to. So I really wanna commend the public for all the comments that we've been receiving throughout this process. We have received a lot. They have been very valuable. They've been very thoughtful.

and just keep them coming is what I would ask for.

I also want to make note Just for clarification, The final list of housing sites is not completed yet.

What has been developed so far for the environmental impact report includes a contingency so extra sites just in case the state puns some of them back to us and rejects them.

So it's really important that the process is also understood.

beyond public comments in a written form.

this entire housing plan comes to this commission, the planning commission, for our review and approval.

at which time it then goes to the city council for final approval. So this is why we keep asking for comment and input.

and consideration because you are absolutely shaping the final product and we thank you for that.

And, We will wait to see if that can be achieved So nothing finalized yet from our position.

in terms of 12 El Portal, Commissioner Graff and I did meet with Mr. Rex on August 9th.

And we did decide on the colors that we were looking to change on the planters and the door and the exteriors. Those are sitting with...

Community Interim Community Development Director Hortert, but we had chosen a weathered steel for the metal canopy and the posts. The planters are going to be a dark brown. The door and windows are going to be more of a bronze and the exterior sconces are going to look as an old rust color that was decided.

I think we were really happy with those. So that was a successful meeting and that is all case closed from our position Anything else is needed from CDD, they could let us know.

And I think as far as VARTA landing, I believe Commissioner Graff, we owe, um, we need to reach out to the applicant on VARTA landing. Um.

So thanks again, Dan, for the introduction. And good evening, Chair Feller and Planning Commission. This request is for a design review permit at 100 Humboldt Ave.

And it is for the Sausalito Yacht Club. And again, as Dan mentioned, this is design review permit 2022-00146.

The address for the Yacht Club is at 100 Humboldt Ave. And the applicant is architect Jeffrey Butler on behalf of the Sausalito Yacht Club.

And a brief summary of the application is, or a broad overview, is a remodel of the kitchen, back of house storage, and refrigeration space, and replacement of the existing awnings with permanent roofing, and the addition of a new gangway, which would replace the existing gangway. Now, these bottom two images that you're seeing, on the left is the proposed floor plan, and on the right is kind of an aerial view of the larger parcel. So on the next slide, you'll have a bit more information on the overall parcel area, but the parcel itself is just over six acres. You can see right where my cursor is, that's the location of the Yacht Club. Just to the south here, you see the ferry landing as well. And on the left, this is kind of a more zoomed-in version of the floor area, and this is meant to show the area where the work is proposed to take place. Right here where I'm circling is kind of that back of house storage area. And on the left just here to the west is where the new proposed gangway is being proposed. And I will have a couple more slides that show a bit of a comparison as well. But you can also see here these blue awnings. That is the area where the applicant is proposing to replace those with permanent roofing.

So a bit about the existing conditions, the clubhouse stands on a freestanding pier, which is located on the central waterfront. This address is located in the open area zoning district.

And the parcel area is 273,992 square feet. And as I mentioned, just over six acres. The existing building coverage is 11,714 square feet. And the floor area existing is 5,469. So the proposal to add more floor area is under the existing awnings. It does not expand the aisle level above the building, nor the height. It just takes advantage of the existing areas that are located underneath this. AREA IS UNDER THE EXISTING AWNINGS. IT DOES NOT EXPAND THE AVAILABLE OF THE BUILDING NOR THE HEIGHT. IT JUST TAKES ADVANTAGE OF THE EXISTING AREAS THAT ARE LOCATED UNDERNEATH THIS EXISTING AWNING YOU'RE SEEING HERE TO THE RIGHT. THE BOTTOM PHOTO HERE SHOWS THE ELEVATION FROM THE WEST WHICH IS WHERE YOU'LL ALSO SEE THE PROPOSED CHANGES. AND I DID INCLUDE THE APPLICANTS RENDERINGS AND ELEVATION PLANS IN SOME LATER SLIDES.

So again, these are some site photos that show the context of the site. The photo on the right is that south elevation, which is the front of the Yacht Club. This is the main entrance into the building. And just to the left here, you can see these blue awnings, which are kind of open air. And you'll see in some of the later photos that area that the applicant has included. And one of the reasons for this project also is to modernize and make more efficient the gangway, which supports the junior sailing dock towards the rear of the property.

So at current, when they enter these doors, they have to make kind of a hairpin turn to go just to the left here.

and then go down this main dock.

So the proposal is to shift the entrance of that gangway so that it aligns directly with this exterior dock area.

These are some site photos that were included by the applicant in their application. Again, you can see the vaulted awnings here from the inside.

And again, this is that door that I was just showing from the outside where they come in with the dollies for the dinghies.

And that proposes to enclose that area with permanent roofing where there's currently those blue awnings. So they also plan to use a blue membrane to kind of mimic the nautical aesthetic of the existing awnings, but also to differentiate the new awnings or the new roofing from the original roofing.

And as for siding, they propose to use the same lap siding and that same pale blue color that is existing on the building. The existing gangway is four foot six inches in width by 18 feet in length. And they propose to replace that with the seven foot wide by 20 foot in length gangway, as I mentioned, just to the west. And then the minor glazing changes at the west side of the building is for a new door that would approach out to the west side there.

So here's the side by side comparison. The left is the existing floor area and right is proposed. So you can see in these gray areas, that's what would be added under that additional roofing for new floor area. It's about a 323 square feet of additional floor area. Again, all under those existing roof areas. And then on this left side, this gray area, that's where the new gangway would go. And you can see how that would align with the existing decking towards the building.

These are the proposed elevations which would be affected. Again, the south-southwest elevation, which would be the front of the building. The applicant proposes to mimic that same plywood bolted style and to match the siding with existing with that pale blue color paint. And from the west elevation, this would be the new gangway. And the minor glazing changes would just be this door right here. All of these window or existing glazing. So the only new glazing on this west elevation would be this door here.

01:02:59.32 Adam East This application or the application for historic resource determination did go before the historic preservation commission this year on June 16. The HPC found that the property did not qualify as a historic resource under CEQA and the staff report and HRE the historic resource evaluation were included in your agenda packet as attachments for your reference.

So in review of the design permit findings, staff concludes permit findings can be made. A summary was included in the staff report and is included here for your reference as well. Staff believes that the project design elements complement the original design of the building with the vaulted roof style and siding and also modernizes the existing use on site. The applicant is not proposed to expand the use or expand the area of the building, rather, nor the height. And as such, they do maintain protected views. And it's not anticipated to cause any view impacts or privacy concerns for adjacent properties. With the proposed 43% open decking system that the applicant is proposing, although there's additional coverage with the larger gangway, the project will actually reduce water coverage by six square feet with that open decking system. So in conclusion, staff does recommend that the planning commission adopt resolution to approve this request as stated. Alternatively, the planning commission may continue the hearing for additional information, direct staff to prepare a resolution of denial, or continue the agenda item with direction to the applicant regarding revisions of the application. 01:19:20.44 Jeff Butler Thank you. Well, let me just start with the, The next sheet, I think Adam would be great. Just the actually A-1-1, the site plan. So this is the existing site plan that shows the new ramp. And just to answer one of these questions in advance, we do plan to modify the parking. We know that there's going to be a fair amount of scrutiny on the accessibility component of the building permit in terms of the financial scale of the project to upgrade accessibility starting in the parking lot and moving into the building. So we will get into that. But the plan really is to move that one space number 14 over where the old ramp is being removed to provide, you know, 24...

seven access to the new ramp. So the gray area is the new ramp. The old ramp will be removed.

The area that you see there in terms of back of house with the dashed walls or the existing shed walls and fence basically that are being removed. To accommodate basically which is a new addition to the building in the same footprint and same roof profile as exists today.

So let's go to the next sheet, Adam.

And here you see the grade area is the area that's open air. And as you can imagine, that's really not the best framework for back of the house in terms of food storage and refrigerated storage and some general washing area and things like that. So it seemed to make sense to enclose this area formally and take some of the kitchen function out of the kitchen to make it more efficient and move it into the new space. We go to the next slide, please.
01:21:27.96 Jeff Butler So as you see in this area, the gray area again is the area that is formally unenclosed that will be enclosed as part of this new addition. And the new kitchen plan, which is quite substantial. One of the commissioners had a question about dishwashing. The dishwashing is being moved out of the kitchen to better provide more space. Okay.

for preparation and service and being moved into the new addition there in the lower right hand corner of the addition adjacent to the club office.

The addition also includes a race locker in the lower left-hand corner of the addition.

which is used by the race committee to conduct races. And their desire was to have a room for storage from the exterior so they didn't have to get into the building to conduct their business. And as you can see, the new ramp is located to enliven with the existing dock. This really solves multiple problems. One, it widens the service access to the kitchen. There are quite a few food deliveries and other things to the kitchen. Secondly, it helps the junior sailing dock be able to trailer the dinghies from the dock to the parking lot where they trailer them and take them to various regattas. So that's a plus. And thirdly, it really helps improve the emergency exiting of the facility by not sort of having to go through what is now back of the house. I think you saw on some of those photos that that's not really the best setup. So that ramp a number of problems. And the ramp proposal is to use a special perforated decking panel that allows light and air and water to filter through. That's why actually we have less square footage of water coverage with the new deck than we did with the old gangway.

Let's see, I guess we'll keep going through the, we can go up to the, maybe the elevations.

So actually, on this drawing here in the proposed southwest elevation, the first three vaulted bays on the left are the existing blue awnings. And we're adding a fourth over the flat roof of the office for aesthetic reasons. There's no addition there, but we thought that looked better. And Chairwoman, just to answer your question about the Burgies, historically that clear story has been glass. So that will be windows in the vault there to provide light into the kitchen and some of the other areas in the back of house.

And the sign, I think it might have, I might have been remiss and not requesting a sign permit for that. We just wanted to designate that that was the junior sailing dock there.

On the proposed northwest elevation, you'll see that we just have enclosed that wall and with the door on the right is the door to the race locker and the door on the left there is into the kitchen area for deliveries. And then at the east end of the building, we're just replacing sort of an undersized sliding glass door with a larger and taller door and a clear story window.

If we could go up to another, the next slide. And one of the reasons that we decided to continue the vault system was that There really didn't seem to be a great solution to add a sort of a flat roof building to this. And the vault allowed us to have maintained some volume in the kitchen where the flat roof of flat roof might make the addition look out of scale and too large. So we decided to continue with the with the vaults, which is fairly historic to this building. And the architect has used these in a number of, used these back in the day in a number of applications. I actually worked on a house in Mill Valley by the same architect that had the same vaults.

So that'll, I think, worked out pretty well.

And then the existing kitchen has the volume in the vaults there with mechanical system hung from the low sections.

And you could scroll up again and we can just, I THINK WE CAN JUST LOOK AT THE RENDERINGS NOW, ADAM, IF YOU DON'T MIND. SO THIS IS JUST A RENDERING OF THE front of the building showing the new enclosure and the gate and this junior sailing sign there. Next rendering.

And again, this is the enclosure. I think there was a little confusion in our presentation of the siding. At one point there was some discussion about trying to differentiate the addition from the existing building because the existing building had been historic and had won an architecture award back in the 60s. But we've decided as Adam pointed out to continue with the building the shingles into a blue color to match the entire building.

And you see in this slide that we've decided to maintain the blue color for two reasons. One is that we think it's a nicer look than the asphalt torch down roof. That's a nice nautical feel and it also kind of respects the addition to the building to the historic part of the building.

So I think that's really the end of my presentation, but let me go through and answer some of the questions that the commissioners had.

I think I've answered the one about the gate and the sign.

We are removing the old ramp.

The parking stall will shift down, but we have more work to do as part of our building permit for the entire parking lot itself.

We don't anticipate any additional roof fans or events compared to what is there today.

In terms of BCDC coordination, we had asked the city manager if we could try to save some time and submit a BCD application in concert with our planning application. But the BCDC cannot approve that application until the planning commission has approved the plans.

The slope of the ramp is less than 5% and it will be a prefab.

and craned in with the only physical addition being a bulkhead on the shoreline to hold the shoreline end of the ramp. And the ramp is fixed. It doesn't float with dock.

Let's see. The lease agreement was just renegotiated a few years ago, and I believe the lease, I think I submitted the lease as part of the application. But these improvements were anticipated at the time of the lease agreement.

And I believe that there's some language in the lease that addresses this addition to the building signage. And I think that's, I think I've answered all those questions that commissioner said. So that's the end of my presentation. I'm happy to take, uh,

But A primary question I would like to address is that when the Yacht Club was negotiating an extension of our lease two years, three years, four years ago, it took a while. The items that we are addressing with this project were clearly listed in the lease as being items that we wanted to pursue and they were allowed. The expansion into the not fully enclosed area of the breezeway was what we call it. The enhanced access for the junior sailing. Those two were the primary items that are addressed in this project. There were other two, one or two other items that we addressed in the lease that the city agreed to. And we're not approaching those items with this project. So this project has, is represented by what we asked for in our lease. So it is in the lease and I, that can be verified. I don't have the paperwork handy right now, but, um, our executive board director at the time, Kay Mitchell, um, and other people in the, our lease committee discussed these improvements and they are listed in the lease.

Those are the primary things. That's the primary thing I wanted to address. I, the other question, I'm not sure if Jeff answered this, but I think there'll be practically zero slope to the new ramp. I'm Jeff could answer that, but it's the height of the grade and the height of the deck that we're gonna build on is practically the same.

So that I just wanted to make sure that the commission knew that we are, we have previously asked for these items to be allowed as part of our lease.

I wanna congratulate Kay Mitchell and Courtney Gall for their diligence on this project.

It's taken many years and the lease was extended with the city of Solito in 2020 to approximately 2057 or 2058.

Yes, it's an expansion of our kitchen, but it's also an expansion of our youth sailing program.

And that's something critical for the club and our efforts domestically and internationally. We were just in Qashqai, Portugal. We have a sound, robust exchange between Sausalito and Qashqai in the reverse. Our used sailors were there around the end of June, early July. The Qashqai Portugal sailors will return to Sausalito in late June 2023. So I support this project. I support the diligence of it. And I thank you for allowing me to make a few comments. Good night.

01:46:15.19 Adam East I do chair and I apologize that I didn't discuss this with Jeff previously and we're doing it here but the ordinance does allow for some permanent permanent signs to be installed without permits. And that's for building directory signs which are pedestrian use for tenants or occupants provided that such directories do not exceed eight square feet in area. So I believe the intent of this sign is for directing occupants or the public for occupants of the site and not advertising the Sausalito Yacht Club as in use. So I believe this sign could fall under that building directory sign.

and be permitted without a signed permit by the Planning Commission.

Um, And then the question is about just the slight.

modification to the parking to allow for access to the ramp. I don't believe that there's a reason to hold this project up just for that.

And we can certainly either condition an approval or move to approve and assign a working group to to finalize that if that's what's needed. So I can I can make all the findings and The only caveat is just that one parking spot, and I think that can be handled either by staff or by a working group, and I'd be willing to entertain either, and I love to support and approve this project this evening.

And that way we wouldn't need another process here, I would think. And then any change to that would be ministerial on behalf of CDB, I would think.
