I want to give a heads up to commissioners and members of the public that the first annual Sausalito Boat Show is scheduled from this Friday, October 13th through Sunday, October 15th. The event will run from 10 a.m. to 6 p.m. on Friday and Saturday, from 10 a.m. to 5 p.m. on Sunday, and will be held at the Clipper Yacht Harbor. It is an inaugural event that is a celebration of maritime excellence and local culture, offering a diverse range of activities for all ages, many of which will be boat related as appropriate, but some that will not, including local food vendors and live music performances.

We hope to see you all there.

00:04:25.17 Robert Busiek Good evening, commissioners. My name is Robert Busiek, senior planner here at the city of Sausalito. It's great to see you all again. Tonight, I'm discussing the approval of parcel map project number 2022-00175, located at 195 and 197 High Vista Road. The applicants who comprise the households currently residing in the existing duplex at the property are requesting final approval for the recording of their parcel map for this property.

This action is required in accordance with the Sausalito Municipal Code, section 9.55.040, prior to recordation of the parcel map. The Planning Commission did previously hear this project, the tentative map and condominium conversion permit, for these two units in June of 2021.

In the time since the project approval, the applicants have been diligent in pursuing recordation of this parcel map.

staff from the Southern Marin Fire District, the Planning Division, the Department of Public Works, and the City Surveyor have reviewed this parcel map and have found it consistent with the prior approved tentative map. Per the Sausalito Municipal Code, the Planning Commission is required to give the final approval prior to the applicant submitting the parcel map for signature and recordation. The certification is a procedural formality associated with this already approved project which staff have reviewed and determined to be in substantial compliance. Thank you.

00:08:42.87 Matthew Mandich Great, fantastic. All right. Yes, so as mentioned, the permit you'll be hearing this evening is a conditional use permit for 63 Bridgeway for the restaurant Suzette. Next slide, please.

This request is for the sale of alcoholic beverages at 63 Bridgeway pursuant to Sausalito Municipal Code. You can see here table 1044 requires that any restaurant located in the Central Commercial Zoning District requires a CUP for all alcohol sales.

Next slide, please. The site is located at the corner of Bridgeway and Princess Streets in a mixed-use building, primarily retail uses with the restaurant. It is surrounded by other restaurants in the area, notably the newly renamed Vecino's Pizzeria, Venice Gourmet, Angelino's, and across the street, Barrel House, as well, next to Itokchi Pocket Park and across Bridgeway from wonderful Bay views. As you can see here in this rendering, the restaurant will be located in the space previously occupied by Bridgeway Cafe. It will be known as Suzette, and that's just a rendering of their projecting sign there. And they have previous approvals for that, which we'll touch on a little bit in this presentation. Next slide, please.

This is just a site plan to show you guys how it all sits in that building there on the corner of Bridgeway and Princess. You can see the bit of a public parklet there in front, which we'll talk about as well. Next slide, please.

This is the floor plan of the space. It's a really small space that was previously occupied by Bridgeway Cafe. There won't be much going on as far as changes to any walls or interior space or exterior spaces rather, but there will be the addition of a bar

right in this area here and some seating here. Here's the ADA bathroom and we have the kitchen back there. It is a small space as mentioned, 638 square feet with a capacity for 29 patrons. Next slide please.

As mentioned, there are previous planning approvals in July of this year, the zoning administrator approved a minor use permit and assign permit for the restaurant here and you can see the minor use permit was for use of the adjacent parklet and the.

Sidewalk dining encroachment agreement was also required by this section of the code listed down below for special use requirements. There's also conditions of approval attached to a previous permit, CDD 13117, which was required for the construction of the parklet. As you can see here just in these images, the parklet serves four different restaurants. Those four I just mentioned previously, Angelino's Venice Cafe, Vecino Pizzeria, and will now serve Suzette. So again, they have previous approvals to use the parklet for outdoor dining service, but today we'll be talking about the conditional use permit for the alcohol sales. Slide, please. So in order to get a Type 41 ABC license for on-sales of beer and wine, the applicant must first obtain local approval and a local permit, so the CUP before the commission today. Operating hours of the restaurant will be from 7 a.m. to 11 p.m. every day. They'll be serving breakfast, lunch, and dinner, full service menu at all times, and in no times will this restaurant operate as a bar or nightclub. Food will always be on sale. Alcohol service is considered secondary to food. The applicant predicts that alcohol service will be about 30% of all sales for the restaurant, and they are anticipating to have two beers on tap and a selection of wines either by the bottle or the glass. Again, this request is for indoor and outdoor service. However, the permit that you'll be approving this evening will only immediately permit indoor service. It needs to go on further with a recommendation approval from the commission to the City Council as a consent item for the outdoor service. This is because any service of alcohol in the right of way is governed by the City Council. So tonight, if we get an approval that goes forward for the CUP indoor immediately and then outdoor once it reaches City Council, you know, pending the Commissioner's recommendation of approval on the permit. Next slide please.

Just a little bit of an idea to show you the layout of the parklet here and where they would be serving outside. This is just about four seats that'll be in the parklet there that is directly adjacent to formerly Bridgette Cafe and will be coming Suzette.

And recommendation staff recommends approval of this conditional use permit and a recommendation of approval for alcohol sales in the public right of way to the city council. Staff finds that the proposed project is in conformance with the conditional use permits finding from the Sausalito municipal code and supports the recommendation to city council approval for service in the right of way. The approval, of course, is subject to the conditions of approval listed in the draft resolution. And with that concludes my presentation. I'm happy to take any questions from the commissioners. I just wanted a clarification about the actual parklet. You said that they have the right to use the parklet, but do they not own that piece of the parklet?

00:13:48.97 Matthew Mandich Correct. So the parklet is on city property. It's in the public right of way. And this is kind of an interesting case of this parklet. This parklet was approved back in 2014, Sausalito's first public parklet, and has been in use ever since. So there are some conditions of approval attached to the parklet that required any business that wishes to use the parklet obtain both a minor use permit and a sidewalk dining encroachment agreement. And that was taken care of by zoning administrator approval back in July. So they do not own the parklet space, but they have access to it. And that minor use permit, as the commissioners are aware, will run with the land and will run with the restaurant going forward. Bridgeway Cafe previously, which has been out of business for several years now, never actually had a minor use permit to use that space. So we're getting our new tenant compliant and always possible and making it so that they can use that space legally and that any future tenants down the road could also do that as well if it ever changed stands again.
