I would like to share a brief summary of the City Council's 2026 Strategic Planning Workshop that was held on January 31st of this year. The session was facilitated by Amy Haworth, Council Member for City of Manhattan Beach, and followed a presentation on public comment and, well, multiple presentations, public comment and city finances Regarding the city's mission, vision, and values, the council reviewed Sausalito's existing strategic plan, which runs through 2026, and reached consensus to pursue a new strategic planning process. On the mission and vision, there was no final language adopted. Those decisions were deliberately deferred to the upcoming full strategic planning process. However the council noted that the current mission statement is considered too vague and there was strong interest in language that more explicitly calls out excellent city services, public infrastructure, responsiveness to residents, and a clear acknowledgement of environmental threats such as sea level rise, fire risk, and climate change.

The Council affirmed the existing organizational values which include innovation, transparency, equity, excellence in public service, and responsiveness, and agreed to use them more deliberately in their decision making and budget development processes going forward. Regarding strategic priorities, the dominant theme of the session, I would say, was infrastructure and fiscal capacity. The Council acknowledged a significant infrastructure funding gap covering roads, storm drains, stairs, city facilities, buildings, and climate resilience, and agreed this must be a primary strategic goal for the upcoming year. There were also several revenue and economic development strategies that were surfaced for further study, including a potential ballot measure related to Ordinance 1022 with particular focus on the Marin ship, which currently significantly limits commercial and industrial intensification. Community development agreements were mentioned tied to upz and housing sites in particular specifically around measure K other housing element opportunity sites in the city. Specific tools such as stormwater fees and enhanced infrastructure financing districts that's EIFDs were also discussed as well as a commercial vacancy tax and opportunities in the maritime and waterfront revenue department, including hotel development and more generally broader downtown economic vitality.

00:12:08.25 Assistant City Manager Downtown revitalization in general, too, was identified as a high priority and a concern, considering the higher levels of vacancy that we've seen along that corridor, with interest in business license tax relief, streamlined permitting, and closer collaboration with the EDAC, PBID, that's the Property Business Improvement District, and the Chamber of Commerce. The council also recognized artificial intelligence as a cross-departmental strategic topic with policies needed around ethics, hiring, operations, and public communications, and assigned a council member to take the lead effort on that. And you know as far as next steps are concerned the agenda setting committee the mayor vice mayor will schedule and dedicate a Two to three hour follow-up session to narrow and prioritize the major strategic items before a broader planning process begins with the goal of integrating that work into the fiscal year 26-27 budget cycle. So I'll certainly continue to monitor these discussions as they may have relevance to future planning commission items, particularly including the Marin ship land use, housing element implementation and downtown design matters. So that concludes my summary. I'm happy to answer any questions from the commission. And I would be remiss if I did not thank our commissioner, Commissioner Moore for being present at that priority setting meeting as well and for providing his comments. I had the pleasure of sitting with our mayor the other day when we talked about a few items similar to what he had discussed when he came to our last commission hearing about working more closely together. So it's just very high level, but I most likely will tap a few of you which are already in existing working groups. I just made him aware that we have the code update working group with Commissioner Junius and vice chair. and then I made him aware, which my impression was he might not have known, could take advantage of our marineship working group so I do think that we can start to work more closely together there's no joint session on the table right now but we can potentially agendize something down the road. The item before this evening is an application requesting approval of a tree removal permit to facilitate the removal of one protected coast live oak tree located on private property at 802 Spring Street.

The lot is approximately 6,000 square feet in size and consists of a duplex structure constructed in about 1960 per Marine County Assessor data.

The parcel is identified by assessor parcel number 064-181-12 and is located along a private driveway which extends off of the Spring Street Public Road past 810 Spring Street. I'm not sure why it goes 810 to 802 but.

It extends off the public street, And it's one house behind 810.

The property is located within the R-2-2.5 two-family residential zoning district and has a general plan land use designation of medium-high density residential. And you can see the location of the tree proposed for removal just below 802 Spring Street.

So applicant and owner Andres Edwards has applied for a tree removal permit, requesting removal of one protected coast live oak tree. The tree measures about 28 to 30 feet in height and has a diameter breast height measurement of 17.5 inches.

An arborist report for this application was prepared by ISA certified arborist Sherry Fabricant with Savitree Consulting Group.

The Coast Live Oak is considered a protected tree This also is the municipal code since it has a diameter of breast height measuring four inches or larger.

And the request is brought forth due to concerns about the stability of the subject tree and its location nearby existing structures and power lines. You can see it adjacent to the residential structure, and you'll be able to see its location near power lines in the next slide.
00:22:32.12 Adam Blair So diving into that Coast Live Oak tree, you could see it located adjacent to those power lines to the right. You could see the canopy's been modified a bit to keep branches away from those power lines.

The tree was reported to be in fair condition by the arborist with vigorous growth and an asymmetrical and unbalanced canopy noted.

The arborist noted that there was some soil erosion around the subject tree. It has a bit of a downhill slope, and the soil is a little light, kind of on the lower side going towards the end of the driveway there.

Impact target if the tree were to fail, include the main residence of 802 Spring Street if it falls to the left, existing retaining wall structures which are located directly adjacent to the tree.

or adjacent power lines if it falls to the right.

The arborist note in the report noted that repetitive invasive management, including root zone modification, pruning and erosion control would be necessary for continued retention of this tree.

and ultimately recommended that the tree be removed to minimize risk to adjacent structures.

and soil integrity while reducing long-term maintenance burden for the owner.

00:23:44.65 Adam Blair So staff recommends approval of the tree removal permit applications since staff finds that the tree removal is consistent with the required findings outlined in the Salceleta Municipal Code in Title 11.

Staff finds the tree removal would ensure good professional practices of forestry while addressing potential hazard to property.

As noted earlier, continued retention of the subject tree would require invasive management.

and the retention of the subject tree will continue to contribute to the current deterioration of the downhill slope of that portion of the property.

Staff finds that the tree removal will not significantly affect neighboring vegetation, drainage, or land stability.

In alignment with the recommendation of the arborist for the removal, staff recommends that the stump of the subject tree be cut flush with grade and limited to shallow grinding as opposed to being removed since the stump serves to retain a lot of that slope on that portion of the property.

This will ensure the long-term stability of the site, particularly that slope.

Finally, staff finds that none of the findings of denial outlined in Municipal Code section 11.12.030, subsection B3 can be made.

staff finds that the subject tree is not able to be altered in a manner which would mitigate the long term impacts that the tree poses to the existing residents, power lines, adjacent retaining wall structures, and to the site itself. Next slide.

So as iterated earlier, staff recommends the Planning Commission approve application 2025-00227, authorizing the removal of one protected Coast Live Oak Tree at 802 Spring Street.

and adopt the attached draft resolution approving the requested tree removal permit.

Staff finds the proposed project is in conformance with the criteria listed in Salcelito Municipal Code Section 11.12.030, subsection B1 through 3.

I guess soil has been coming up and coming down, and so in order for the tree to stay in place, they would recommend extensive root modification just to mitigate the amount of effects that the routes have been having on the site.

And that, again, kind of ties into if the tree were approved to be removed, they would want that stump retained since that stump is holding a lot of that dirt up.

00:29:41.12 Andres Edwards Sure. Thank you, commissioners. My name is Andres Edwards, and I live at 802 Spring Street, apartment B, which is the upper second apartment, top floor of this apartment. It's off of Spring Street. It's actually called a private driveway because it's this bizarre thing where the house is at 810. Then I'm at 802, and then there's several buildings above me, 804, 806, 808. These are all duplexes. So there's two units in each one. So the real issue with this tree is you were talking, Commissioner Marlott, about, you know, what is the danger to the property? It's not, it's, yes, the tree could fall on it, but it's really the root growth.

I just had some seismic retrofit work done.

finished up a few weeks ago, and they discovered a crack already, two cracks actually, in my foundation. When the arborist came to my property, she said, you know, if this is going to grow twice as large, you're going to have some real issues in your foundation, and you already have some. There's also a pathway that goes up behind my building, so it's disrupting that. There's also the driveway that goes to all the other buildings, so it's uprooting that.

And my neighbor is the other. I mean, when Brian and I talked about it, unfortunately he couldn't be here. He's the house below me at 810.

And The tree is between our properties, about eight feet from my foundation.

another 8 to 10 feet from his garage, so he's also concerned about the tree as well. That's why he sent an email, which you all have, that supports the tree removal.

And there's the PG&E lines as well, but that's a maintenance thing.

I wanted to talk to you about a couple of other things. I learned from Brian about, I mean, from Adam about the the wave fee, the $1,250, I guess, involved with that. I'd like to share with the commissioners what I've spent to date, if I have a handout with the costs

It's actually higher than the cost for cutting the tree, which is $1,100.

And if not, if there needs to be a cost there, if there's any way that I could maybe donate some money towards a tree that could be planted elsewhere, not on my property. My property, the backside of it is very shaded, and it's very steep and sloped. And there's no real suitable place to plant another tree there, And that's mentioned in the Arborist Report. So my hope is that if another tree needs to be planted, that I'm able to work with the city to have it planted elsewhere.

um, The other thing about the retaining wall that you guys mentioned is there's a retaining wall that runs up the road in that photo The photograph did not show the retaining wall that goes, that divides my property with my neighbor's property. That's the retaining wall that the tree has an impact on.

Well, it is, but also, thinking ahead, this thing is going to get twice, three times as big, right? It's going to get huge. That's what the arborist said. It's going to become a real, real issue, and it's already shown some. It's hard to prove exactly the damage that's happened to foundation, but it's there because the seismic retrofit showed a crack. There's several cracks, one bigger one, right on the foundation of the building there. And the arborist said to me that, It doesn't look good looking forward.

So there's a report that you got from the seismic group. Did they say the crack is related to a root from the tree going eight feet towards the house?
00:38:40.93 Andres Edwards They said it's a concern. It's really hard to prove these things. You have to kind of get in there and start doing the science of the roots and all of it. But it's definitely a concern. And when I had that done, they said, look, you've got You've got a crack already, and they put a metal brace inside. Supposedly it helps some, but I'm concerned that more and more could come if, as the tree roots get bigger.

So I understand what your retrofit people said, but my understanding that wasn't submitted with your application or the staff report.

One is that that house has been recently bought, and there was a period there when it was the previous owners, so it's kind of a thing where you have to deal with the neighbors about it, and the neighbors weren't defined at that point because the person who lived there moved, and her family put it up for sale. So it was a period there when nobody really owned it and the new owner has been there very recently, just a few months.

I think that's it. It's mostly the foundation of my house, the path nearby, the driver for everybody, the power lines, and my neighbor. Those are the big impacts along there. And the other piece to reiterate is that there's no suitable place to put a replacement tree on my property per se. It's all shaded. It's very steep. Not a lot of room, suitable space for that. Sure. You know, just a couple of things.

The tree looks like it's really been cared for by the previous owner, so it's a nice looking tree. The physical situation it's in with respect to proximity to the house and to the power lines, don't seem to certainly not not as bad as about a thousand other trees I've seen in Sausalito.

I can't see that some of these statements made by the arborist are really that credible. At one point she says the canopy is in direct conflict with the secondary neighborhood power lines And it appears that the tree's been pruned away from the power lines, probably by the previous owner, and it wouldn't be impossible to continue trimming so that the power lines weren't affected.

Following up on Commissioner Moore's comments regarding the foundation and the retaining wall issues, I don't see any credible evidence here that the that the foundation of the house, which is quite a ways away from the tree, is being affected by the tree.

And these small wooden retaining walls do not appear to have been in any way damaged by the roots of the tree. So there's just a lot of things here that don't add up for me and I will not be supporting this application.

It's a fee to, since there's not land on this property to put a tree elsewhere in the city. I thought that's what was got approved by city council. I can ask if the commission's okay to ask Adam that question.

Having said that, I'm struggling with putting the words of the Arborist Report into what I visually see regarding the tree. The Arborist Report talks about the tree being very healthy. Pruning could easily remove it from the power lines. It says barely on the power lines. It's very far away from the existing house. It could also be brought down in height. I don't see any evidence of the retaining wall damage so I'm struggling with trying to understand how the arborists put that in their report where it looks like a one board maybe two board redwood there that doesn't even go past the tree doesn't look like any damage I don't see any root structures headed over to the retaining wall I don't see any roots uplifting the streets and we have plenty of evidence of that throughout the city down in the parking lots and some of the main streets where you can see where routes have done damage. I also don't see any routes uplifting any of the walkway I appreciate the report from the seismic group. Normally if there's evidence of damage, oftentimes reports that I have seen, they actually indicate what's causing the damage. I was heartened to hear that the sewer and the water lines are up property. That's oftentimes a concern where roots can damage sewer lines, which is very expensive. They can damage water lines. So I'm glad to hear that those two facilities for this property are nowhere near the tree. So those obviously aren't impacted.

The visual evidence of what I'm seeing, I'm not making those aligned with the Arborist Report, so I'm struggling with trying to find the findings in item 1, A through D, to support a removal. But it seems easier to find findings for the denial of the application based on the fact that you can easily do thinning in 3A, double I, triple I, and four with shaping it and even topping the tree to remove it from the power lines, remove it from both the downhill property as well as the uphill property.

And I just wish I saw visual evidence that comported with what the words were in the Arborist Report. So I'm on the fence at the moment.

can be avoided by reasonable redesign of the site plan. Yes. Thinning to reduce density. Yes. Shaping to reduce height or spread. Yes. Heading or topping. Yes.

I think the idea, even though I know the coastal live oaks have relatively shallow roots, the idea that a coastal live oak of that size has caused damage to the foundation up the hill eight feet away is frankly not plausible. I can't say, you know, it's absolutely impossible, but it's just not, it doesn't seem very plausible to me. So I don't believe I'd be supporting a positive resolution.

I think we're sympathetic to the fact when there's any type of distress in a foundation or for a safety of a home. But with that, I am, I think with my fellow commissioners here where I'm having a hard time being able to rectify what's in the report.
